Taking It All Back

  • The plaintiff says the defendant, her foster and godparent, gave her an iPhone 6 and laptop as gifts, but after a disagreement, he stole them out of her bag and won’t give them back. Now she’s suing for the cost of the items. The defendant argues once the plaintiff treated him with disrespect, he took them back. He initially paid for them, so he shouldn’t have to pay her anything.

I think it really wasn’t about the phone or laptop. Kids are unreasonable and irrational, especially around her age and they want to hang out with their friends, go on dates, go shopping etc…the last thing they’re thinking about is calling their parents and in this case foster parents. Let’s be real, the foster father is a bit of a weirdo, what grown man gives a child candy then asks the mom if she can have sleepovers? Why is he trying to keep her tethered to him by buying her a phone and paying the bill but only if she calls him every day, and when she doesn’t he takes the phone and the laptop he gave her as a gift while throwing all her belongings out of the house? This guy seems sus.

It’s not a four year olds fault that she doesn’t have a good and loving father in her life and a mother who hands her off into another man’s house. It’s not her fault that she then spends years going back and forth between two households with possibly different partners. He’s not related, and he didn’t answer when asked when he became a foster parent. He was angry with her for behaving badly, and took back his gifts when she was leaving. However, I don’t think she should have sued him and she did have a snarky attitude.

Being a foster parent is hard, especially with teenagers. My neighbor is a foster parent, I would watch her foster kids, most of those kids are a mess. Most also as soon as they turn 18, or leave the foster home, run back to the bio parents, or turn into even bigger messes. You can't really discipline these kids. Even raising your voice at them, can get you investigated by the state. I give major props to the good foster parents that take in other people's children that are messed up for many reasons and treat them as their own.

There has to be a reason, one that JM did not get into, that the plaintiff is not with her mother, but my suspicion is her life would not have been at the same level as it was with the defendant and his family.
She is ungrateful and full of attitude. I truly hope that she has gotten her act together, because if she does ever need arms to run back to, she may not find them!

I adopted my son from the foster care system when he was 12. There were years of fear, anger, rejection and heartache.
He is now 25, and, fortunately, he still lives with me. He's a great person and easy to live with...now. I'm so glad he stayed with us and he has grown up and out of those really tough phases.
He's also forgiven me for the times when I didn't handle his bad emotions very well. He has such a huge heart❤!
Kids who come from hard places, and who have lived through abuse and neglect for most of their lives, come in with LOTS of emotional baggage.
It's HARD to be their caregiver, but it's not their fault. They are 100% the victims of the terrible adults who came before you.
They can't trust anyone for years!
Remember these words if ever want to foster or adopt an older child. It's not like "The Blindside" movie. It's not for the faint of heart.
The kids DESERVE a permanent home, but if you're unprepared, your adoption will likely disrupt, and the child will have one more huge rejection in their life.
We saw this happen in our adoption support group. Most of the adoptions disrupted. Maybe 3 out of 10 stayed together.
I'm sorry to be a downer but people need the know the truth to be able to stick it out and give your adopted child a permanent home.

A gift is a gift and she had the right to get it back however the whole situation is sad. Its so hard to find a reliable support system as an adult. People who will really be there for you mentally and financially. I hope she matures in a way that will show her that she had a great thing going and she learns gratitude. I remember at 18 i wanted everyone to let me make my
Own decisions and leave me alone. But now at 25 im so grateful for the support my family gives me even when it feels overbearing.

I love when Judge Milian speaks her wisdom at the end of theses cases… she sees so many relationships die because of small arguments that grow too big. But the big picture of what she says in all these moments is that life is way too short for long term grudges….😔

  • @kimberlyadorno280
    @kimberlyadorno280 2 ปีที่แล้ว +3

The defendant thinks because she hit the "magic number 18" she's grown. It's sad because 18 (even 21) is too young to consider these young people adults. They don't have the life experiences, intelligence, or biology/maturity to make decisions out of logic as opposed to emotion. I'm sure the defendants weren't perfect but no parent is. Her mother obviously had troubles of her own if all her children were raised by kind neighbors. I have teenagers and this has been the most difficult experience during parenting. Judge Milan said it perfectly...they're stupid. Stupid because they think they know better and think their birthday coming around for the 18th time changes anything. Any parent knows most people under 25 are just grown children, not responsible adults.

Yes, everyone is giving the plaintiff life lessons that she needs and so.
However... the "Godfather" has a schtick for a houseful of obedient, young female dependents. And I've seen a couple of red flags there. "NO! NO! IT'S MY HOUSE, I make sure that these young women are indebted to ME!"
King Baby vibes for sure, though he's made sure to keep it half legal.
Why is she so rebellious and defiant?
There might be a whole, unspoken reason there, Judge. And this young lady knows how to keep secrets. Ask me how I can tell.
I 100% agree with Judge Milian on the finding.
