International Court of Justice Orders Israel to Prevent Genocide in Gaza, Fails to Order Ceasefire

    In a highly anticipated ruling, the International Court of Justice at The Hague has found that there is a "real and imminent risk" that Israel is committing genocide in Gaza, and supported "at least some" of the provisional measures South Africa had requested when it brought the case in order to rein in Israel's military assault. Though the ruling falls short of calling for an immediate ceasefire, analysts say it is nevertheless a significant milestone. We discuss the "unprecedented" decision by the World Court with a panel of experts: Palestinian human rights attorney Diana Buttu, genocide scholar Raz Segal and scholar of colonialism Mahmood Mamdani. "It becomes imperative upon the world community to now act," says Buttu. "This is the beginning of a process of isolating Israel," adds Segal.

      It more complicated than that. Israel would never have listened to a ceasefire order. They would have carried on and it would undermine the court and create massive repercussions in the region. Now, the court has said SA is right and that there it is a plausible reason to believe that Israel is committing genocide. This means the case will go on, but Israel must not commit genocide. Israel is now officially and legally a Pariah state

      It will certainly try. However the ruling was better than many people are characterizing it. This ruling is an order for _more_ than just a ceasefire. The technicality - of not being able to explicitly order a "ceasefire," because Palestine is not a recognized state, and therefore can't be included in that language - was *_overcome_* by ordering Israel to stop (and actively _avoid),_ "committing acts of genocide." That means a ceasefire *_AND_* cessation of starvation, cessation of water-deprivation, cessation of blocking of aide & supplies... it's an order to cease *EVERY* act of genocide. There's no cause to resign oneself to the worst possible outcome.

      I'm not an expert myself, but from what i heard from experts, their jurisdiction in this particular case is to stop the genocide, which technically do not need the war itself to be stopped.
      They do not have the jurisdiction to stop Israel from pursuing hamas, but that can order Israel to do it in a way that does not cause a genocide.

    On the 7th, it is crucial to understand that there were no direct attacks on civilians, only collateral damage. Out of the 1148 total names, 403 were military personnel, 59 belonged to the police, and 668 were civilians.
    The collateral damage on the 7th was significantly lower than any of the ITf "mowing" operations, which had a ratio of 6:1. When including all casualties, not just deaths, the collateral damage ratio of the "mowing" operations is a staggering 162:1.
    On the 7th, with 462 military personnel out of 1148 total, the ratio of civilians to military personnel was a mere 1.6:1,
    which is a hundred times lower than the 162:1 ratio of the "mowing" operations based on analyzing UN OHC data from 2008 to 2022.
    A 162 :1 ratio means that for every 162 civillians, 1 military personnel is a casualty. The 7th had a ratio of 1.6:1, a hundred times lower.
    The reported ages of the victims are as follows:
    0-4: 2 civilians
    5-12: 8 civilians
    13-17: 14 civilians
    18-25: 132 civilians
    26-40: 119 civilians
    41-60: 55 civilians
    61+: 40 civilians
    Active duty military personnel:
    18-25: 258 active duty military personnel
    26-40: 60 active duty military personnel
    41-60: 17 active duty military personnel
    61+: 1 active duty military personnel
    From haaretz datasheet titled title: xsraxl's Dead: The Names of Those Killed in Hxmxs Attacks, Mxssxcres and the xsrxel-Hxmxs Wxr
    462 were military personnel, including 55 soldiers, 13 privates, 59 corporals, 200 sergeants (45 of whom were sergeant majors), 48 commanders, 32 lieutenants, 5 lieutenant colonels, 6 colonels, 37 officers, 10 inspectors, 6 intendents, and 2 Lance Corp.
    There is a more detailed report of of oct 7th titled "I scrapped the information about 1096 of the 1460 killed on 7th of October Attack. Children Less than 1%"
    Wrote it 2 months ago hence numerical discrepancy as it was reported to had been 1500 back then and not just 1148 as it is now.

He then kept firing. Both laughing merrily and casually at the recollection. In another documentary '1948: Creation & Catastrophe', a survivor speaks about women getting violated infront of their family members by iTf. She was a child at the time and still wept as an elderly woman. For more recent atrocities, "Breaking the Silence" record statements by the iTf themselves, they recount the events witht he same casualty their forebears do.
    The Costs of War study by Brown University in 2021 about past 20 years of engagement of US policy concluded withthese figures: indirect deaths 4.5-4.7 million, direct 905-940,000 , in other words 6 million deaths and 38 million displaced. This is relevant because of the Oded Yinon Plan.

    This ICJ ruling gives countries and peoples the authoritative backing to take direct action, such as seizing weapon shipments headed for Israel's IDF. It also makes it more difficult for governments and institutions to justify banning BDS and pro-Palestinian protests. And it places pressure on governments supporting Israel in its assault on Gaza and/or doing business with it in general to reconsider and change course for fear of becoming permanently associated with a highly visible genocide if not legally liable as an accessory to a genocide.

    The ruling seems a bit like too little,too late. Even if they had called for a ceasefire, would Israel have complied; and what would be the penalty if they refused? Secondly, a full ceasefire would equally require Hamas refraining from attacking Israel in order for any meaningful resolution to be reached. The ruling isn't sufficient but, it seems reasonable given the juncture we are currently at.

    The word "cessation" did not appear in the ICJ's judgment.
    No serious resolution upon Israel that requires it to stop its military operation.
    Israel can go on, and the Palestinians will not come back to their homes.

    I don't suppose the ICJ could dare upset the military industrial complex by ordering an immediate ceasefire. They might have found their lives in danger mafia style. At least they have found a plausible risk, they could hardly do other. Give the arms industry time to set up their next money spinner. Watch that space.     This is only the International court of justice ICJ the ICC international criminal court is where it has more relevance but that still right now does not help the people of Palestine remember this is the Hague and this is a start of proceedings thank you to South Africa for pushing it now

    But genocide is already committed. The court has not made any enforcement orders or for a ceasefire, they simply reiterated whether it fell in line with the convention and agreed with some of SA claims.
