- The High Court in Pretoria is expected to rule today on the admissibility of a recorded confession by one of the accused in the Senzo Meyiwa murder trial.
The judge is conducting a trial-within-a-trial to determine whether the confessions made by two of the five accused are admissible.

I don't know about SA But in my country confessions are initialled in every paragraph and every page is fully signed. A declaration by the attorney is also signed and attached to the confession. You can't just say there was legal representation without proof. Attorney's declaration must be signed and attached with the confession

From Reading the judgment, the Judge seemed lost and confused…like he is not the one who wrote the notes. When he went for the book I was confused bcoz he was about to list the reasons.

This woman said to have taken about or more than 50 confessions and statements..but failed to make a Ntanzi and his legal representative to put a signature as a proof of consent and that the statement was taken voluntarily....

Yes in court everything you say will & can be used against you. Always keep answers shirt, clear & concise but maybe because its trail within a trial things are different.

I totally agree. It's only in Africa where there's no such. In other countries, they have an interrogation room that has cameras and audio recording equipment.
In the US they have had that practice for years. I am not certain why this has not been implemented in this day and age in SA. It would resolve a lot of conflict, especially during interrogation of suspects and witnesses.

Anything done unconstitutionally is illegal, unlawful, null and void. Section 5 of Section 35 of the Constitution was flagrantly violated. They should have known better! Furthermore, can someone sign authentically, while handcuffed? Fair is foul. The Honourable Judge was correct.

Cronje as a magistrate should be looked at, didnt request mjiako's Qualifications just assumed his a lawyer based on his clothing, sies ,her conduct as well recording a confession illegally
The said lawyer produced his Fidelity certificate and the appointment card as a proof the Violent Cronje that he's really a lawyer but her only mistake was that she failed to get them made copies for those copies to be attached to be attached to the statement like those of the three police officers.

The defensiveness and passive aggression of the Magistrate cause for concern, versus being passive objective and of assistance to court especially in the context of all the indications of prosecution/investigation improprietary.
The defense is focusing on technicalities and if it happens they aren't found guilty, it will be not of evidence
It's impressive, technicalities, are very important, as to how the statement was taken....acts , sections , constitutional rights.....for this case following that line of defence, I must admit the statement might be inadmissible also. The police ,must be charged for defeating the hands of justice.....
I agree with you, Ntanzi still need to bring proof forward that he was forced to confess. Enough of this technicalities.
They want to prove that the confession wasn't done freely and voluntarily, that is the main point of departure for the confession to be admitted in the main trail...
