If Kenny was using the bobcat to do work for his boss then he should be responsible to return it to where it goes. Regardless of if the defendant claimed to have permission, Kenny should have verified that it was true before handing it over or opted out of participating.
The defendant seemed more credible and Kenny seemed to breath a sigh of relief that JJ couldn't determine who was actually driving when the vehicle got stuck, not that it mattered, as JJ held them equally responsible which seems like a fair outcome.
I don't believe Michael either. He just abandons Kenny and carries on with his day he said. Who does that when an expensive piece of equipment is at risk?

Kenny has a bad wig and he's not a very good liar. If you're willing to pay someone would easily come remove the Bobcat from wherever it's stuck. That's definitely a cheaper option than replacing an engine.

And if Kenny could easily reach his boss to inform him that the bobcat was stuck, why not call him to confirm if Michael had permission? I do honestly think the defendant was driving. Because when she issued the judgement he was shaking his head yes. If I was completely innocent, and had not gotten it stuck. I wouldn't have liked that judgement. He is just glad he didn't get stuck with the whole bill. I agree with the judgement though. Because the other guy was in charge of it.
