I was incorrectly (according to GDOL) denied by the Board of Review members Harvey K Persons III aged 74 and Xernona C Brady aged 92. I’m sure they’re both spry senior citizens but since they both incorrectly denied me I question the training and continuing education they would need to perform such and important job.
I first applied for Pandemic Unemployment Assistance (PUA) May 2020 with the Georgia Department of Labor. After being denied PUA, I appealed to the Appeal Tribunal of the GDOL. While waiting months for my appeal to be heard, I was finally called by a GDOL employee who assured me I would win my appeal that was scheduled for July 12, 2021. She told me that since I was in the appeal process there was nothing else she could do. Therefore, I was shocked when the expert with the Appeal Tribunal upheld my denial of PUA. After being denied in my appeal by that expert, I appealed to the experts at the Board of Review at GDOL and was again denied by the Board of Review members Harvey K Persons III aged 74 and Xernona C Brady aged 92. I’m sure they’re both spry senior citizens but since they both incorrectly denied me I question the training and continuing education they would need to perform such an important and demanding job. Again I was shocked since my reading of PUA regulations led me to believe I should have been approved. After these three experts denied my appeal I took my case to the Athens-Clarke County Superior Court. Once I appealed to the Superior Court I was notified, the morning we were supposed to go to court, that my appeal denial was reversed by GDOL and I had won my appeal. It took almost 2 years and the cost of a lawyer to have the GDOL approve my PUA. I would like to know how the Appeal Tribunal and the Board of Review, as experts (after having over a year to become experts on PUA) denied my request, then just hours before my appeal was going to someone outside of GDOL control, my appeal was suddenly approved. Then after having all my funds, $22,000, placed in the GoProgram debit card (when I requested it go to my checking account) I followed GDOL documentation and called the number, provided by GDOL, to have the funds transferred to my checking account. There is no option to transfer funds and no option to speak to customer service. After searching the internet I found another number to call with the GoProgram card and was informed the option to transfer funds had been discontinued. Another failure of GDOL Now the only way I can access my funds is making 44 daily $500 cash withdrawals at specific ATMs. Of course my local bank will be very suspicious when I make all these cash deposits and report me to the US Treasury Department with a Currency Transaction Report and/or a Suspicious Activity Report. Another failure of GDOL. Based on the suspicious way my case was suddenly approved just hours before it was going to be reviewed by someone outside of GDOL control, I would suggest engaging an outside firm to review all PUA denials by the experts at GDOL. I suspect most unemployed people that were denied by these experts would give up based on lack of funds to hire a lawyer or they mistakenly relied on the judgment of the GDOL experts. Also, I’m concerned as to why my funds were forwarded to the GoProgram debit card instead of to my checking account as I requested. Is GDOL or someone at GDOL receiving some kind of incentive for funds being sent to the GoProgram? I would have hoped to discuss this with someone from GDOL but it’s impossible to speak with anyone directly.
