What is the alternative? I mean, what is the practical legal method of gaining custody of the individuals. My limited understanding is that the US would need to pressure the foreign nation to arrest the individual. If the foreign nation did not act effectively, then the US would need to ramp up the pressure through sanctions, threats of war, and finally declaration of war. This puts hardships on all the citizens of the foreign nation for the actions of a non-state individual and the inaction of its government. This question can be extended. How does any nation legally and effectively protect its citizens from the actions of a non-state actor living in a foreign nation. Especially if diplomatic relations between the nations is tense. Looking at Ukraine and Gaza, we can finally admit what's always been known. There's no rules of war except those that the powerful dictate when it suits them.
Trying to put boots on the ground to capture a target can lead to dozens of needless deaths, but a drone strike delivers results with minimal cost... especially in human life. These people intentionally hide themselves among the civilian population (often intentionally finding places with lots of kids) to avoid one of these drone strikes, so it is their fault at the end of the day if there are needless civilian casualties.
This is the same issue that is currently happening in gaza. When the people who are attacking the country melt into the population. Then the country has to decide to either just take constant attacks, or go after them. Precision with a bomb is only so good. There will be innocents killed, especially when the 'enemy' is hidden among the innocent. And the ones being targeted, know that they are being hunted. But they think that hiding within a population will prevent an attack. To lessen death, USA came up with the gensei maverick missile, which is as precise as you can make bombs.

What is the alternative? I mean, what is the practical legal method of gaining custody of the individuals. Obviously once the US has custody, they can be tried using the judicial system, but how does the US gain custody? My limited understanding is that the US would need to pressure the foreign nation to arrest the individual. If the foreign nation did not act effectively, then the US would need to ramp up the pressure through sanctions, threats of war, and finally declaration of war. This puts hardships on all the citizens of the foreign nation for the actions of a non-state individual and the inaction of its government.
This question can be extended. How does any nation legally and effectively protect its citizens from the actions of a non-state actor living in a foreign nation. Especially if diplomatic relations between the nations is tense.
The only methods I can think of are as dystopian as the Disposition Matrix. ie world courts, trials in absentia, UN sanctioned drone strikes.

Considering the amount of (ex) importent people in the US who have committed serious breaches of international laws and have not been extracated/put on trial is staggering and if any other nation would implement a similar list targeting US citizens there would be hell to pay.

Trying to put boots on the ground to capture a target can lead to dozens of needless deaths, but a drone strike delivers results with minimal cost... especially in human life. These people intentionally hide themselves among the civilian population (often intentionally finding places with lots of kids) to avoid one of these drone strikes, so it is their fault at the end of the day if there are needless civilian casualties.

This is the same issue that is currently happening in gaza. When the people who are attacking the country melt into the population. Then the country has to decide to either just take constant attacks, or go after them. Precision with a bomb is only so good. There will be innocents killed, especially when the 'enemy' is hidden among the innocent. And the ones being targeted, know that they are being hunted. But they think that hiding within a population will prevent an attack.
To lessen death, USA came up with the gensei maverick missile, which is as precise as you can make bombs.
