      Proximity does not equal sovereignty. Just because something is close to you, does not mean it's part of your country. The Philippines never had control over these reefs and islands, and it was never recognized by any other country. The territory of the Philippines has clearly been delimited by Spain and the US. The Philippines should stop being surprised that China does not accept its territory from being stolen by them.

Please use "West Philippine Sea" instead of "South China Sea"when you report Scarborough Shoal as it is within the 200-mile exclusive economic zone of The Philippines and decided by the 2016 Arbitral Ruling of the United Nations Convention on the Laws of the Sea.       There was no such an "International law" or "international ruling" to begin with... it was a Court of Arbitration, which says on its own website that it's NOT AFFILIATED with the United Nations but only a third-party NGO. The PH government lied to its citizens by making it sound like a real international court in the UN that gave a verdict.

      Philippines lost its sovereignty to USA in 1898. Japan seized the SCS islands during WW2.
      And unfortunately Japan surrendered those islands to China, not the Philippines, which was still a US colony in 1945. The US made no claim. In 1946, the Americans reminded the Philippines at its independence that the Spratlys was not Philippine territory, both to not anger Chiang Kai-shek in China and because the Spratlys were not part of the Philippines per the 1898 treaty Spain signed with America.
      China exercised control over them after 1945. So the territorial rights to the SCS features have changed hands several times.
      Philippines didn't show that it has consistently asserted territorial rights. China exercise the control of the features for around 25 years from 1945 and Philippines have been keeping quiet about it.
      After oil/gas was discovered in the SCS in 1969, Philippines started to challenge China’s claims of territorial rights over the SCS islands, after having kept quiet for around 25 years prior. What a coincidence.
      Philippines old 1799 map has been superseded by various events happening after 1799. When Philippines lost control over the SCS features for almost 200 years, it loses its territorial rights over them.

The Philippines was first country & and it's real independent country before, the Spanish time era or colonized since 1521. Spain rename the Philippine name as what we called "De las Filipinas" and then all islands, cities, other names of philppines will change because of the Spanish time illegal occupation only.
      The source of information was given to the Philippines, although the names of those islands of the Philippines "rename the original names" but its the same also,
      China 2012 only, was claimed the spratly islands of the Philippines.
      (The real question is? How Tibet Country was an independent country & illegal occupied by China).
      The Tibet country was bigger than China? China was established as PRC. So therefore it's a not a country. It's organization. Please be research or reliable source of information. No need to share a fake news.

So some countries in South East Asia feel that it was unjust that their predecessor Colonial Powers, the Americans, the British and the French did not protect their interest.
      When Spain sold Philippines to US for $20M. None of the islands listed in the legal document. When PH files independent with UN, none of these islands listed in PH legal documents.
      In contrast, after Japan surrendered at WWII, UN and UN security agreed to returned all these islands to China. It is in UN record.
      Tibet was conquered by various parties such as the Mongols prior to the 20th century. In 1720, China invaded and conquered Tibet. Following the collapse of the Qing monarchy, various Chinese territories and local governments such as Tibet and Mongolia attempted to secede from China by unilaterally declaring independence in 1913. Only Mongolia recognised Tibet’s unilateral declaration of independence, whereas China n the international community did not. The attempt at secession eventually failed as the KMT and then the CPC sent troops to recover Tibet. The Tibet separatists surrendered and Tibet was reunified by China in 1950. The Dalai Lama today accepts Tibet as Chinese territory. Only some overseas Tibetan separatists are still trying to secede Tibet from China.
      Xinjiang was conquered by China in 1755. It also attempted secession after the Qing monarchy collapsed. The East Turkestan Republic was a short-lived satellite state of the Soviet Union in northern Xinjiang (East Turkestan), which existed from 1944 to 1946.
      Taiwan was conquered by China in the 17th century and ceded to Japan in 1895. In 1945, Taiwan was surrendered by Japan back to China via internationally recognised treaties.
      Most of China's territorial expansion, like Inner Mongolia or Xinjiang or the rugged mountain regions, took place when China was ruled by "foreign" dynasties, like the Yuan (1279-1368) and Qing (1644-1911). The story of Tibet is more complex. Tibet was first conquered by China under Mongols in 1244, but "enjoy[ed] considerable autonomy under Yuan Dynasty". In the many centuries since this initial conquest, struggles have ensued over Tibet's domination by the different Chinese governments, from the Qing to the republican government. It was only 1950 that Tibet was formally incorporated into the People's Republic of China. China's claims over Tibet therefore come with a highly contested history. This is a simplification of a rich and complex Chinese history, but the significant grain of truth is that for most of the past two thousands years, the Han Chinese have not been militarist or expansionist, despite the many wars they have fought, most of which were within China.
      UNCLOS
      the underlying dispute between the claimant countries since 1945 is one of territorial rights over the SCS islands. After oil was discovered in the SCS in 1969, Philippines started to challenge China’s claims of territorial rights over the SCS islands, after having kept quiet for 25 years prior.
      And UNCLOS is not the proper forum because it does not deal with matters of territorial disputes or to resolve issues of sovereignty, as that field is governed by rules of customary international law on the acquisition and loss of territory, which can be decided by the ICJ ONLY. No jurisdiction means no power to define the sovereignty rights over the disputed islands. If Philippines were serious about its claim, it would have commenced proceedings with ICJ and not a powerless UNCLOS tribunal.

      The Philippines keeps accusing China of “ bullying and intimidating smaller countries” without mentioning at all the Philippine occupation of and encroachment on China’s territory in Nansha Qundao. That is a real propaganda “trap”. On the issue of Ren’ai Jiao, it’s not the size, but the behavior of a country that determines who is right and who is wrong.
      Right after the Philippines deliberately grounded its warship on Ren’ai Jiao in 1999, which seriously violated China’s sovereignty, China made démarches to the Philippines, and the Philippines promised to tow away the warship several times. A senior official of the Philippine Department of Foreign Affairs made it clear that the Philippines had no intention of building any facility on Ren’ai Jiao and it doesn’t want to and will not be the first country to violate the Declaration on the Conduct of Parties in the South China Sea (DOC). But 25 years on, not only hasn’t the Philippines fulfilled its promise to tow away the warship, it has even attempted to send construction materials for large-scale repair and reinforcement of the warship in order to build permanent structures on Ren’ai Jiao. The Philippines has gone back on its words, and stirred up trouble to provoke China. This is not only breach of the understandings between the two sides on handling the Ren’ai Jiao issue, but also a violation of the DOC, especially its Article 5 on refraining from action of inhabiting on the presently uninhabited islands, reefs, shoals, cays, and other features. The Philippines is clearly responsible for the current tensions in the South China Sea.
      China and ASEAN countries have long been committed to properly managing and resolving disputes through dialogue and consultation between states directly involved, and worked together to jointly maintain peace and stability in the South China Sea, which has kept the South China Sea generally stable. But for some time, the Philippines has been pulling non-regional actors into the South China Sea affairs to back Philippine provocations and violation of China’s sovereignty. The Philippines has been pursing selfish gains at the expense of the consensus reached by countries in the region. This is the main reason why the situation in the the South China Sea has escalated and become more complicated.
      The Philippines need to respect the facts, observe the relevant understandings between the two sides and DOC provisions, follow the consensus reached between China and ASEAN countries, and return to the right track of properly managing and resolving disputes through dialogue and consultation as soon as possible.

      This is what the Permanent Court of Arbitration (which the Philippines often cited) actually says: "The Tribunal does not see that success on these Submission would have an effect on the Philippines’ sovereignty claims…" Even they themselves knew that it was just a show and cannot alter the reality.

    Singapore, the smartest country, as well as the most successful one in ASEAN, has been playing smart geopolitical balancing games between super powers for decades, for the maximum benefit of the country, without being squeezed and sacrificed as cannon fodder by the US or China.
    Filipino people always look at the success of Singapore with envy, and wonder why they can't replicate the best practices in their homeland and why their country is still deeply trapped in US colony mentality without a clear way out.
    Truth hurts. A smart leader plays smart geopolitical games and invites American and Chinese companies to build factories in order to generate jobs and increase revenue, while a clueless leader easily gets emotional like a kid, often is played by geopolitical players as chess pieces, invites foreign military to build bases in order to generate tensions and increase the risk of conflicts, and sacrifices the country's development and trade.
    Japan and S. Korea can sit down for negotiations and cooperations, despite of their long time disputes over the sovereignty of the Liancourt Rocks in the sea between them. That is political wisdom and diplomatic maturity on full display.
    Other countries such as China and the Philippines can definitely learn from S. Korea and Japan to manage their difference on South China Sea, Taiwan, MILF or whatever, and develop their relationship.
    Even the leaders of Vietnam and Malaysia are now much smarter, more resilient and pragmatic than P-Noy and BBM, embracing China's trade, infrastructure and investment with open arms, without sacrificing national sovereignty and dignity. Now the Philippines is the only ASEAN member that works as proxy for Uncle Sam in Southeast Asia, and puts itself into current awkward position of either losing face or losing opportunities for economic development.
    Soon, even Laos and Cambodia will become richer than the Philippines. The Philippines will only compare better than Myanmar.

    There is a lot of misunderstanding and misinformation about international law and the South China Sea. Below is something to help clear up the misconceptions perpetuated by the media and the Filipino government. I hope people will take time to read and digest it. This is important because the mistaken beliefs about international law and Philippines territory are significant obstacles to peaceful resolution of the SCS dispute. Thanks in advance:
    The UNCLOS treaty is about the maritime entitlements generated by undisputed sovereign territory. The treaty was never meant to be used to resolve disputes over territorial sovereignty. The South China Sea is a dispute about sovereignty.
    That is why
    1. China exercised her legal right to not submit to arbitration and reject the 2016 PCA UNCLOS decision;
    2. The PCA did not make any decision or express any opinion about the sovereignty of maritime features; and
    3. The PCA did not rule that China’s sovereignty claims were illegal per se ( the PCA had no jurisdiction to arbitrate on sovereignty ). The PCA could not rule out a possible legal basis for China’s claims .
    Just as one cannot build a house on a poor foundation, one cannot construct sovereignty claims from a treaty about maritime entitlements generated from disputed territory. The Philippines is abusing the rights and procedures under UNCLOS. This risks delegitimising the treaty and damaging international justice.
    Sovereignty disputes were usually settled by military or economic might. We hope diplomatic negotiations or international law will be used to settle territorial disputes. However, arbitration over sovereignty requires BOTH parties’ consent; to date, a few sovereignty disputes have been settled by arbitration (eg. Pedra Branca & Middle Rock).
    To cite the 2016 UNCLOS arbitration as the basis for Philippines’ territorial claims contravenes the fundamental legal principle of state consent for arbitration of sovereignty under customary international law. Law-fare in the ICJ or distorted narratives in the court of public opinion will not get the Philippines anywhere; it will only harden China’s position and provoke more physical confrontation on the high seas.
    A pragmatic solution to South China Sea disputes embraced by several ASEAN members is to shelve their sovereignty disputes (ie agree to disagree) and pursue agreements of cooperation over South China Sea resources through quiet diplomatic negotiations. This approach, initially suggested by Deng Xiao Peng in 1960, has achieved some progress between competing claimant states.
    An ASEAN-flavoured analogy to explain the SCS dispute:
    2 neighbours with mango trees are arguing about a fallen mango on the ground. They cannot prove which tree the mango fell from. Consider the 3 scenarios below:
    1. The neighbours fight, accidentally smash the mango and no one gets to taste it;
    2. The neighbours stop arguing and sit down to share the mango in peace;
    3. One neighbour decides to ask the village crime boss for help. The crime boss’ thugs take the mango forcibly from the other neighbour. However, the crime boss likes the mango so much he decides to keep the mango, collect protection money and tax all future mango harvests from both trees for himself.
    Despite sovereignty disputes over maritime features, the freedom of commercial navigation and overflight enjoyed by all states in the South China Sea under international law has never been threatened. The South China Sea currently contains some of the safest and freest sea lanes in the world, with more than 100,000 ships and one third of the world's maritime trade passing through every year. Over 60% of China's foreign trade and energy imports pass through the South China Sea; peace and stability in the South China Sea is as vital to China as any other country. China’s interests lie in ensuring that these sea lanes remain safe and accessible to all. 
    The UK & the US themselves blatantly defied the UN and ICJ rulings that affirm Mauritius’ sovereignty over Diego Garcia (which the UK took by force) for many years; they only recently negotiated a controversial settlement with the Mauritian government that excluded the original Islanders themselves to grant the UK and US another 99 years of occupation of Diego Garcia against the recommendations of the UN and ICJ court. Filipinos should also note the US herself has not ratified the UNCLOS treaty.

      I beg to disagree. Refer to the Velarde map, the first map that was made and first published in Manila in 1734 by the Jesuit Cartogrpher, the engraver Pedro Murrillo Velarde, Nicolas de la Cruz Bagay and the artist Francisco Suarez.The Spratly island was included.
