1-Ek HC mein husband divorce ka petition dala karan tha uski wife AIDS mareej hai; HC ne divorce petition reject kar diya yeh kah kar ' wife beemar ho gayi hai tho husband ka farz bannta hai use sambhale uski care karein'.
2- Yeh bhi case divorce petition ka tha karan wahi, fark itna hai yahan wife petitioner the aur husband AIDS mareej.
HC ne turanth divorce pass kar diya.
Woh time se mera man mein ek sawaal hai kya Hindustan mein law collages mein alag alag tariquon se kanoon sikhaya jaatha hai kya?

Secton 7 of the Special marrige Act is the only culprit , which obstructs the inter caste marriage by raising concern of families of both or either parties.
The aim of special marriage Act is to protect the intercaste couple from social ailments. This section 7 should be ammended Or ommited. It is the violation of personal liberty of the age martured boy and girl .under article 21 of The Constitution. MP HC decision is contradictory to the constitutional and fundamental rights.

If any innocent person (let's say "A") is doing or want to do something which is lawful but is illegally threatened by someone (let's say B) trying to prevent A from doing that thing then the court should restrain B and provide the protection to A from B if the threat is real.

Bad judgement by MP High court, courts have to understand the delicate situation and provide assistance to people who are registering under Special marriage act .
On western countries the concept of marriage is almost non - existing and people get married when they become grandparents, different family concept there , so in our country courts should protect such vulnerable groups

Special marriage act is a Himalayan blunder according to my view. Any one who born in to the world as male and female are bound to go in to marriage is biologically right. That is nature's law. There is no Hindu or Muslim. These are Socially created controversies so it is waste of time. Those who wish to marriage can do that according to their compromise.

Judge is perfectly correct. He has done the correct thing by educating the ill-informed Hindu girl ( who is being mis-led).
Not only is the marriage illegitimate as per Quran, this also means that the husband will have no obligations if he chooses to divorce her later. Even if the marriage sustains, the children born out of this marriage are illegitimate in the eyes of Quran and will have no claim of inheritance in the property of the husband. Finally she will be forced to convert to Islam.
The husband is anytime eligible to marry 3 more times without any seeking of permission from this wife.

Without knowing the allahabad court case details I can guarantee in that case the girl should be Muslim and the boy should be hindu that's why the court is given protection.

कई बार ऐसी खबरें मिडिया में आती हैं कि गैर मजहब में शादियां होती हैं, कुछ दिनों महीनों या वर्षों तक सबकुछ ठीक चलता है और बाद में किसी न किसी कारण से तलाक की नौबत भी आती है। चुकि इस्लाम धर्म में शरिया कानून के अनुसार तलाक़ देना आसान है इसलिए लड़के पत्नी को तलाक देकर दूसरी शादी कर लेते हैं, जबकि हिन्दू समाज में यह आसान नहीं होता। कोर्ट में आपको उचित कारण प्रस्तुत करना होगा। सभी फार्मेलिटी पूरी होने के बाद भी न्यायालय दोनों को एक साथ रहने और सुलह कर लेने के मौके देता है। यदि सुलह नहीं होता तो तलाक पर मुहर लग जाती है परन्तु यदि दूसरी शादी नहीं करती तो उसको पति से गुजारा भत्ता लेने का हक होता है।
