    Maine ye month me shop purchase kiya hai aur uska possession and agreement copy society me submit kiya hai and NOC and Share certificate ke liye demand kiya hai,..but unka kehna hai ki aap first month ka maintainance pay kijiye fir aapko letters milega,...is it correct??plz reply

      It's not correct. Society has to give you Share Certificate once you submit them Agreement Copy.
      Society can recover maintenance separately from you but cannot hold your Share Certificate.
      Give Society Legal Notice.

      Index 2 document is a proof of registration of agreement it's basically a summary. Whenever you want to take out valuation of your property this document is going to be important. Therefore it's an essential document.

    में ने अमदावाद में ntc एक्ट के तहत बनी सोसायटी में कर्मशियल दुकान शेर होल्डर से खरीद की है । सोसायटी मेरे नाम से सर्टिफिकेट नही दे रही है । मेरे से मीटिंग तक नही कर रहे । ट्रैफिक ओर पानी ज्यादा use होगा ये कह रही है पर मेरे साथ कोई मीटिंग नही कर रहे । मेरे लिए नगरपालिका समेत अन्य बिजनेस सर्टिफिकेट के लिए शेर सर्टिफिकेट आवश्यक है । अब में क्या करूँ ?       Yes because share certificate is given to Bank till loan is repaid.

    One flat owner purchased flat from other person 4 years ago, still he has not paid 25600/- Rs to society even after notices given to him. We also donno how bank gave them loan without taking share certificate. He has also rented that flat.
    Other members who paid Transfer chages to society are now angree and telling society to either legally recover money from him or to cut of their facililties like water or give money back to people who have already paid transfer charges.
    What legal action can be taken?
    Can society lavy 21% per annum interest of their pending money?
    Can society cut of their boaring water supply, not Drinking water supply?

    दादा आम्ही 2018 मदे वेंकटेश आयर ह्या व्यक्ती कडून पुणे मदे फ्लॅट विकत घेतला होता , पण तेव्हा आम्हाला शेर सर्टिफिकेट बद्दल पुरेशी माहिती नव्हती , आणि आता आम्हाला आस कळाल आहे की शेर सर्टिफिकेट वरती आमच नाव नसून वेंकटेश आयर ह्याच व्यक्तीच आहे , तर ते आम्हाला आमच्या नावावर करून घेयाच आहे , पण त्यासाठी सोसायटी चैर्मन , सेक्रेटरी कोणतीच मदत करत नाय्येत , तर आम्ही कोणती लीगल अकॅशन घेऊ ??????????

    Monthly maintenance receipts not given . Complient to. D. D. R. Also they saying same thing you are saying deposit the maitenance . Then also we ate deposit also then also they not given the receipts . I will stop the maintenance charges.

    Registrar of Co-op. Societies has given permission to open account in the name of Society. The form given by the Bank has no space for Society name and asks for individual names. Can you make short video on filling form.

      There is no particular format. Write in your language and style. You can write in letter format only thing is in the last mention what specific relief you want.

      Society barkhast nahi honi chahiye redevelopment mein bhi. Fir bhi agar aise hua hai toh New Committee ne share certificate dena chahiye. Nahi mile toh complain to DDR.

    Sir my building is 15 year old it's a single stand alone building of 6 floors. The building has received the BCC I.e Building completion certificate. But not OC. When I asked the architect of this building he says we dont require OC as we have already got the BCC please let me now is it true

    Even after direction of Dy. Reg. Share Certificate is not issued then what is remedy?

      DDR being a public servant his orders are binding. If committee members don't follow it they can be prosecuted under penal provisions of IPC for non compliance of order of Public Servant. You can also apply for dissolution of the body since it is not performing it's duties in accordance with the MCS Act and Bylaws.

      Agar Cooperate Housing Society registered hua hai toh Members ko Share Certificate Dena mandatory hai. Aap Secretary ko Application submit kar sakte hai for issuing Share Certificate. Agar Secretary ya Managing Committee aapko Share Certificate issue nahi karte toh aap DDR ko complaint kar sakte hai. Agar Flat pe Loan hai toh Share Certificate Loan repayment tak Bank ke paas rahega.

      First make an application to Society and ask under which General Body Resolution and Bylaws you are charging this fees. If you don't get any response make a written complaint to the DDR Office.

    We have purchased flat in April 2021 through housing loan. It was direct purchase from builder & society was not formed. Now the society is in process of issuing share certificate.However those who have taken loan those people share certificate will be send to their respective banks

    I purchased a flat in the month of March- 2023 and since the beginning, I have been following up on the share certificate society said would be distributed after the AGM which happened in the month of Sep -2023, and w.r.t it I have submitted the original share certificate on 10/09/2023 and dropped a mail for the same and i follow up on the same on 24/09/2023 and society came up with new issue that they will handover share certificate once i arrange for an authorisation letter from bank authorising you to collect Original share certificate from society on their behalf. Why do I need to get an authorization letter from the bank? Is it really required? please do help.

      If u take loan it goes to Bank
      If they send it to them
      Always take List of documents submitted to bank list written by bank. We have to know which documents bank have from us.

    We are facing similar issue where society is not transferring shares certificate on the ground that society is not freehold and only provisional ownership is given to primary owner so primary owner cNt sell the property to second parties till the time all clearences are not given by authorities.     2nd my name
    now my spouse passed away in 2020 I am asking for a share certificate from the society on my name only is it possible that by default as my spouses not present so the 100% share certificate will be on my name ?

      If your husband has made a Will in your favour transferring his 50% share then you have obtain a probate order from Court and submit to Society and they will record your name on Share Certificate.
      If your husband has not made Will then you have to obtain a Legal Heirship Certificate from Court and submit to Society.

    ours is a stand alone building containing only nine residential flats. will be getting completion certificate shortly. can we form society? if yes, what is the procedure?

      Yes you can form and register a Cooperative Housing Society with less members. Previously minimum 10 members or 60% of purchasers were required to register Society. As per the recent 2019 amendment even 5 members can also register cooperative housing Society.
      Process is completed in 4-5 stages.
      First a Chief Promoter needs to be selected.
      Then promoters have to decide name of the Society.
      Application of intention to form the society along with name is submitted to registrar for approval.
      Once the name is approved within 3 months the share capital and entrance fees has to be collected from the members and a Bank Account has to be opened.
      Then main application along with list of documents, affidavits is submitted to the Registrar.
      If everything found complete registration certificate is issued.

    Sale Agreement in name of 2 brothers in the year 1990. Share Certificate has name of only 1st brother.
    1st brother paid 80% of the amount but not explicitly mentioned in Agreement only bank and cheque details mentioned.
    Now in the year 2023, 2nd brother forcing society to put his name on share certificate and first brother objecting. Original sale agreement and share certificate with elder brother. No original document with 2nd brother. Elder brother only residing here since 20 plus yrs and paying all the maintenance. Younger brother not staying also and not making maintenance also.
    Pls suggest how can 1st brother stop society in putting 2nd brother name on share certificate

      Please understand names of both brothers have to be recorded by Society on share certificate irrespective of who has paid how much amount or who is residing there. Society has to go as per agreement.

      @@virajpatil5601 Thanks for your quick response. But society is saying to record 50% and neither the younger brother is staying there nor paying maintenance. Everything is by elder brother. In nominations maharashtra hsg act and bylaws clearly state that in death cases, society will transfer to Nominee. But here it was a conscious decision to not record younger brother name on share certificate as he hardly paid anything. Law doesn't permit society to intervene in share dispute matters and neither the flats are registered

I have purchased in resale and previous owner have handover me his share certificates.. but when I have requested to society to transfer the name - they're asking me to 25k for transfer fees.. this amount is only for transfer - is this correct?

      Yes they are right. You need to pay 25K for share transfer in the state of Maharashtra.

      Awaz ki vajah se Hearing damage ho raha hai aisa evidence agar aapke pass hai toh pehle Society ko written complaint kariye aur Society action nahi leti hai toh Guard aur Society ke khilaaf Public Nuisance ka karan batake Police Complaint kar sakte. hai

    Sir my father died without a will so for transfer of ownership of flat and ghar patta transfer we made affidavit as per officials advice and I gave NOC to my mom … the ghar patta was transferred on my mom name. Now for becoming member(mom) in CHS where that flat is this document enough or legal heir certificate is required ?

    Agar parents off ho gaye aur 1 flat ke 3 owner hai toh transfer aur share certificate 3 owner ka ayega ya 1 owner ke liye ayega..us property ke 3 bhai hai

    I am buying a resale flat in the society which was formed in 2010. The old two owners have not taken the shares of society.       You can but the Share Certificate should have names of earlier owners also in correct chronology with requisite share transfer fees paid to Society.

      Equal shares have to be given to all members. Society can charge Rs.500 & Rs.100 as Entrance Fees as per Bye Laws in Maharashtra. Maximum Share Transfer Fees is Rs.25,000/- as per the Government Circular.

    Sir kya agar sra ka flat ho jo society mein registered nahi hua hai. Annexure mein spelling mistake ki wajah se toh kya hame share certificate mil sakta hai k nahi almost 10 yrs se reh rahe hai. Aur allotment letter builder se mila hai.
    2) kya annexure mein spelling correction hoti hai k nahi agar hoti ho toh kaha jana chahiyeh. Pls coperate

      SRA mein Name lagana padega saare documents submit karna padega. Naam lag jayega agar Allotment letter hai toh.

      लाच मागत असेल कोणी तर Police Complaint करा आणी Share Certificate साठी एक साधा अर्ज द्या त्याच्या सोबत तुमचे Registered Sale Agreement ची प्रत जोडा Soft Copy email सुद्धा करु शकता. सर्व करून पण नाही दिले तर District Deputy Registrar कडे तक्रारी अर्ज दाखल करावा.

    Sir please guide me. In case of dispute between joint owners in a society, who has the right to keep the share certificate. The active member who has purchased or the associate member

      Who keeps the share certificate copy is not important. Even if the other person keeps the copy he cannot sell, take loan or mortgage the property without your consent. In case of dispute its the Competent Court who is going to decide the question of title to the property. Just because a persons name is there on the share certificate or he has the copy with him doesnt make him an owner. Ultimately if there is a dispute person whose name is there on share certificate has to prove in Court that he has brought the property by his own independent source of income or he has received the property in family partition or by way of Will or a Gift. Hope that clears your doubts.

He's not staying with me past 2.5yrs has abandoned me

    I have lost my share certificate due to flood, the same way the committee has lost some records including my share. So we don't have a share certificate and folio no. They are agreed to issue a duplicate certificate, there is no dispute between us, but problem is that they have to mention all details in the duplicate certificate. Where can we get the details? There is no loan on my property, so no record at the bank too. May the organizer or registrar have a record of the share certificate?

      Society has to maintain registers regarding membership, loan mortgage, share transfer. You can check if any information is contained in this.
      Procedure for lost share certificate:
      File a NC in Police Station
      Public Notice in 2 newspapers regional and english
      Indemnity Bond
      No dues undertaking
      After doing all this if you dont get duplicate share certificate make an application to DDR.
      Information for duplicate share certificate can be obtained from purchasers list given to builder + society has to tally the share numbers and see what serial number share certificate was issued before + Bank has to certify no loan is there.
      If you do all this you can get duplicate share certificate with updated information.

    Hello Viraj,
    In our society we have 2 , 2.5 and 3 bhks and while selling the flats some of the 3 bhks have sold as two 1 bhks. So At actual it's 3bhk flat but with two sale deeds with two unit number.
    Since only some of the 3 bhk has these issues we collect same maintenance like other flat from these flats as well.we are preparing shares for residents and each flat gets 10 shares . But for these units Kindly suggest if we need to issue 20 shares as they have 2 index 2?
    What are the way outs?

      Yes you need to issue them separate shares because even if physically they are 3BHK but in reality it is two 1 BHK flats having separate Index 2 and independent Registration with Builder too.

      Society ko Application kariye with Registered Sale Agreement copy. Some Societies also ask for Affidavit in their format along with application and agreement. If there is loan against the property Share Certificate will be with the Bank.     I have a query. Thankyou for the clarity so far.
    Let’s say, Two legal heirs (sons) staying jointly in 1 flat and for convenience sake the share certificate was on elder sons name.
    The property was purchased by their father (in late 70s) for both of them. There was no sales deed but flat were allotted as the building was built by relatives. The society was formed in early 80s and the share certificate was issued to elder brother only though both brothers are residing since day 01.
    Now this flat is sub divided (mutual understanding between brothers in 90s) into 2 individual flats with separate toilet, kitchen, entrance and electric meter.
    What rights does the younger brother have pertaining to the membership in the society and ownership rights of this sub divided flat.
    Kindly advice

      Yes declare him as defaulter if doesn't pay after serving reminders and notices and later apply for recovery certificate to the DDR of your area.

    *sir, our treasurer expired due to Corona,afterward so many issues occurs by few one nembers, as we were Hon.committee mmbrs, but new committee avoid to take the charge. In this case, we have no knowlege of accounts, which was our Treasure handle.Now what i do as i resgined long time back from as ex Ch..

    U said society is owner. Again not complete..they may be owner of excess area CHS has , other than that of your flat..many CHS office bearer behave as if they are the owner of every thing.though soceity bought or paid for nothing...they only take care of day to day needs like , water , cleaninh , electricity etc...

      Police NC is irrelevant for denial of Share Certificate DDR is the competent authority for this type of grievance. Society is Owner of land and building including common areas after their name is entered into property card after conveyance deed is registered. Flat ownership is not absolute for allottees they enjoy ownership only through the common ownership that they get by way of shares issued by Society which is the reason individual Flat owner name is not entered in the property card.       @@kingenterprise3703 You don't enjoy ownership similar to an open plot of land where your title may be established by name on 7/12 extract and mutation entry but at best one can say you have the best title to legally occupy your flat courtesy registered sale agreement and share Certificate. You don't have to take permission from Society as many believe but NOC is required before final sale, that NOC is only saying you have paid all dues and have not mortgaged your flat to anyone as per their records but is not implying that society is giving permission for sale. As per the byelaws member just has to give intimation of his intention to sell his flat or transfer his shares along with resignation form. You can watch another video on this channel regarding documents to check before purchasing flat and read the blog on the above mentioned website for more clarity on the issue.

      Building agar RERA registered hai toh documents aap Website mein jake check kariye ki kaunsa approval pending hai. Agar issue solve hone jaisa hai aap Flat buy kar sakte hai.
