      It's not just the phone call; it's the context that call is set in, its timing and temporal relationship with text messages from Schiller, etc. This is why even the prosecution apologists in the media are calling it a cross examination bombshell, which the defense has been rather slow in getting out of the gate. But the race is not always to the swift...

      @@-danR Cohen might have overstated his "certainty" as to the date he told Trump about him having "fixed' the Stormy Daniels problem, but come on man...there is a LOT of other evidence that Trump was in the know. So Cohen got the date mixed up? He only talked to Trump a few dozen times during the latter part of October before the election in 2016. So yeah, is it possible that Cohen got the *exact* date of the conversation wrong? Sure. But do I doubt it that, in the big picture of then ENTIRE set of events that surrounded this scandal and the cover-up leading up to (and following) the election? Not one bit.

      Payment of the NDA is not illegal and that is not what Trump is being charged with. The prosecution has not proved that Trump ordered his business records to be misleading (technically they are not really misleading anyway).

      At minimum it calls into question it’s reliability and when that call forms the basis of your case, you can’t get to beyond reasonable doubt without having 100% faith in the content of that call

      @@susieb7305BS. First off Cohen texts Schiller before the call asking to talk about the harassing issue he was receiving, nothing about talking to Trump or if Trump was even with Schiller. Cohen didn’t call Trump (although he had Trump’s numbers). The text messages right after the call only mention the harassing issue, nothing else. If Cohen had to explain to Schiller about the harassment situation and what could be done about it, that could easily eat up all the short phone call time. I think it is a real stretch to think Cohen called Schiller, explained the situation to Schiller got Schiller’s response, then asked Schiller to get Trump, waited for Trump to come to the phone and give Trump his message all in a minute and a half.

      Remember this entire case is based on a crime of how it was reported on financial statements. The checks mean nothing more than a lawyer was reimbursed for services. It's not illegal to pay for an NDA with a pornstar, the only thread they have is that is was for the SOLE purpose of election fraud, that means it had 0% to do with protecting his reputation, his relationship with his wife, or his other business dealings. In order for the charges to stick, he had to have no other motive than how it would impact the election. Every other fact in this case is misdirection if it doesn't provide clarity to that fact.

      ⁠Of course they have turbo. New York Penal Law § 175.10 stepped up to a felony from a misdemeanor under § 175.05. He’s also charged under New York Election Law § 17-152. There are very specific rules in NY regarding what is required to prove reasonable doubt under these statues in NY that involve Supreme Court rulings.

      Has the prosecution brought in any expert witnesses as to how the Trump accountants should have booked Cohen's legal fees? No! There is huge doubt that the accounting was in fact fraudulent.
      Give some of the specifics of NY Election Law 17-152. The prosecution has only intimated that Trump violated federal campaign finance laws and has not provided specifics. (NDAs and hush money are legal). NY's jurisdiction over federal laws has to be tenuous.

    This disputed Oct 26 evening phone call is much ado about nothing.
    It does NOT matter if Cohen was wrong about what was discussed on this 1 call.
    As long as Trump admits that he did authorize Cohen to pay Daniels and get her
    to sign the NDA.
    Whether this happened on Oct 25, 26, 27 or 28 doesn't matter. Whether Trump
    said this to Cohen in person or over the phone doesn't matter.
    As long as Trump admits it did happen.

    I think it sounds like his credibility was damaged, but without seeing it live it’s hard to say how much that landed with the jury. I agree that a meandering follow-up plays into the prosecution’s interests, but if the jury is looking for reasonable doubt and there’s no other corroboration (about which I am unsure) then, yeah, sadly I think this might be it. Fucking hell.

    Defense just has to show doubt in just one material fact in the case. If that fact is in doubt, you have achieved reasonable doubt and you must acquit. Kind like OJ. That sowed doubt that gloves didn't fit....hence you had reasonable doubt in material fact or a piece of evidence. Even if everything else is true, you would have acquit. The person must guilt beyond all possible reasonable doubt in the case. Reasonable doubt extends to any and all evidence and testimony in the case. Beyond a Reasonable Doubt is very very high standard in case and does get the credit iit deserves most of the time. The jury just can't think Trump is guilty. The jury just can't think Trump is very guilty. The Jury must know that Trump is guilty. The jury must be sure and the evidence and testimony must show that.

      The exact specific call in which Trump was informed is not a material fact. Showing that Cohen's identified call as to when it happened (also) had a plausibly different topic does not show he was not also informed at that time, or some other time.
      Clearly, Trump tasked Cohen to 'handle it' and Cohen told Trump he was already talking to Alan (Weisselberg) how to structure it. Trump's silence at that point was his assent.

      Guilty of what? What crime is he actually being accused of? Those papers are proof of an NDA with a pornstar, which is not illegal. It's all about the bookkeeping where the fees were recorded. In this case legal fees to a lawyer. The prosecution needs an articulable crime of election fraud which requires that those payments were for the sole purpose of election fraud, nothing to do with protecting his family, embarrassment, business relationships, or any number of other reasons you wouldn't want the story coming out in the tabloids.

    Prosecution should point out that Cohen talked to Trump many times in the days before and days after about the Stormy Daniels situation so this one call could have been very short like they got the check. Cohen said that he was in constant communication with Trump usually more than once a day.
