The SpongeBob Lego isn’t necessarily fake it’s by a different brand as Lego lost the license to it which transferred to megablox but the one five below has is a different brand too but the figures look like the megablox ones

I would say the situation is like the Lego Angry Birds one. Mega lost the license to the Spongebob IP and also lost the rights to their own mold, so any company that got the rights could use that same mold and Mega can't do anything about it
