Is this the same as a Delay Status when considering a Form 4 ? Asking because I currently have a Form 4 in Delay Status, and the FFL didn't say ANYTHING about having any knowledge of any kind about having to provide my address to the NCIS / FBI Delay. Should I inform my FFL? OR Iis that different from this video?
I just got a delay on a firearm in Florida. I have a CCW and have purchased many firearms over the years. Yet here I am, paid for the weapons permit and jumped through the hoops, and yet I have been delayed. This is beyond ridiculous and infuriating.

I am in the same position as you and have a ccw here in Florida. I’m on day 3 and always get approved. What could of gone wrong on the dealers end with paperwork
Today on day 30 the store called me this morning and told me the background check just came back clear this morning and I can come to pick the gun up. I have never waited longer than a couple of hours for a background check to come back. I will be heading up there shortly and will see if they have any idea why it took exactly 30 days to come back.
During a trip to a gun store the associates behind the counter commented every background check that day was delayed including himself. And this is more than one store and different days. This should be a class action lawsuit.

I don’t think people realize how huge of an infringement this is. They also don’t realize how often denials and days are issued. I’m a retired police officer and I stopped by academy about 15 years ago to pick up a new backup gun. I’m in a marked patrol car and full uniform. After about 20 minutes I decided on a little.380 and started the paperwork. By this time, there are several people waiting at the gun counter. Then the employee tells me in front of everyone that I was denied. People just stared at me like I was a dirty cop or an impersonator. Talk about feeling humiliated. It took me countless phone calls, letters from a district judge and district attorney, as well as my chief of police, to finally get my name cleared. Turns out, someone who spelled their name the same as me was a convicted felon and they thought it was them trying to buy a gun. Even though they had all my information, and drivers license, they denied me. If it can happen to an officer in uniform, it can happen to you. In my opinion, they need to completely do abolish background checks. Criminals ain’t buying their guns from reputable ffl’s. Every gun control law only affects us good folk.

Can we have NICS checks run on every state and federal elected official before each of their votes? Should not the public know whether they are clean enough to buy and own firearms? Name, office held, proceed, denied and delayed should be enough. No individual with a firearm is potentially more dangerous to the public welfare than an elected official with a vote.
lol we just need govt to stop growing at the rate it is. im still trying to process today, they dont make it easy and its clear theyre not making it easier for FFLs either. the only handout i got today was pretty much a threat and made it clear theyre coming for our licenses and we better be above par on everything or we will lose it. no excuses.
One time I was picking up a lower at my regular FFL, and the gentleman helping me said my check would probably come back as "Delay" because everyone that day had come back "Delay." He suspected that it was due to a lot of checks taking place. It was another record-setting month for NICS checks. Fortunately, mine came back proceed, and we were both surprised, since my checks seem to take A LOT longer than most at that FFL. If 9 of 10 "Deny" statuses are incorrect, how many "Delay" status turn out to be a "Deny" status?
My state uses NICS. The state denied me twice. Both times I appealed and was granted a "conditional permit", which FFLs are not required. And they don't. This all goes back to an arrest and two charges, which were dismissed in 1973. This is reflected in a NICS document I received from the FBI.
@peterk8909 It sounds as though you need a lawyer to expunge the arrest records. However, even this won't guarantee anything because expungements are a joke.
@@michaelragusa5138 The point is I was never indicted, tried or found guilty and my name doesn't even come up in Federal Records in that jurisdiction. The arrest shows in NICS but no dispensation.

Relative went in an Academy today and asked him why he was in a different city than his residence. He told them it didn’t matter because his residence is in Texas, same as the store. They gave him a ration of blather. Stay the Hell out of Academy when you buy your firearms
Just arrived from the Philippines last night into San Francisco intl airport... Was the only one on the whole plane set aside for additional screening (open your luggage for customs). I went to the B line expecting long snaking lines... It was ONLY me. An officer was watching, already knew who I was (they were communicating with the original customs that told me to go to Line B) and separated me from my traveling group but not far enough that they all heard "Do you know why you were sent here?" I said no. He said "We're you recently denied a firearm?". I said oddly enough yes. He said thats why. Your info is now sent to local law enforcement as well as Customs and Border Patrol. This is to ensure you didn't go abroad to purchase firearms." I said "Thank you for the info. First, if I wanted to illegally purchase I firearm... I wouldn't be doing it in the Philippines where it caught I would spent who knows how long down some dark hole of a crappy prison eating rats. I'd drive down to Oakland and pick one up thru the drive thru McDonalds." Anyway... That's what's going on now. And the reason for the denial FYI is they claimed I had a 273 DV (domestic violence) conviction. INCORRECT. I had 272 NON DV and a 10 year ban which ended in 2010. I have already purchased legally a Glock and only had to deal with a delay. So now the gov is directly LYING forcing me to jump thru hoops.

This is truly worrying.. a friend of mine who has purchased a gun previously with no issues, was denied this year when he tried to purchase a new handgun with no explanation. He requested a police background check which showed nothing... I told him about these new laws taking effect in August now he's afraid to even purchase a gun. He doesn't have a carry permit, he literally only owns a PCC which he uses for sport and home defense. I have a carry permit and even I'm worried about this bs law..
U have right to contest background check..also it's RUN BY STATES NOT FEDERAL GOVERNMENT...if you can legally own it who cares if name and address given to local police...

What does the status of they delay mean when it changes to "open". That's what the FFL just told me. 2 weeks now over the holidays and he claims an open means he cannot legally sell via the Brady Bill 3 day. What a crock of BS, they hold you in limbo to deny your rights. Every time I buy I get delay, but never heard back from anyone it came back deny or proceed either. It's no wonder people don't go through ffl's.
Michigan here... have cpl get delayed every time for a long gun but can walk out the door in minutes with pistol and ammo. Its annoying, didn't used to happen.
I just got denied yesterday bc I accidentally read a question wrong and put “no”, they said I can’t buy a gun from them at all. But for how long? will I never be able to buy a gun from another store as well?
I got denied today trying to buy a new rifle. I have several firearms that I've purchased legally and I have no criminal record (just a couple speeding tickets). It's very frustrating and I feel my right has been denied. Finding out why I got denied is a very frustrating process too. The background check center has to send me a letter to tell my why I was denied and couldn't tell me on the phone. I filled out an appeal to the denial with the FFL so hopefully I'll be good to go soon. I'm just curious what could have even caused me to be denied. And now I'm hearing this news and I'm even more po'd
That sucks! It is very frustrating. There was a recent report that the NICS check database has millions of incomplete entries and errors. A right delayed is a right denied.
@@Entropy106I put my ss# every time and they deny 1 out of every 4-5 background checks. Then overturn the appeal every time. I really think they are just trying to discourage people from buying guns because they can’t outright ban them
My ex wife accused me of domestic violence 25 years ago in 1999. In 2024 when I could not buy a personal protection hand gun at 63 years old. They first thing I thought was that I hate that woman that did that to me 25 years ago.
That is one of the reasons that I have never married; have never had a "live in" relationship; and have never had any children. I have heard so many horror stories from divorcees about marriage, child custody, and "living together." On a more humorous note, I majored in mathematics and physics in college. Mathematics is my wife, and physics is my mistress. Studying math and physics should never lead to a gun denial!
i'm in california i got delayed back in december. i waited 10 days then 30 days and nothing so they asked for a live scan i did the livescan. i emiled the doj and they pretty much said i have to wait unitl they get to my paperwork.... almost a year and still waiting.
Is the a process you can do to find out why you received a delay then proceed to see why and how to be sure they have correct information I received a delay twice law abiding citizen
Great video. I’m out here in California. Been delayed from bass pro shop. My 30 days are up tomorrow. I job requires a live scan so I’m clean. I purchased a Henry lever about 5 months ago with no issues. I purchased ammo about a week ago with no issues. We’ll see if I get the Undetermined dros.
Here in SC I went to buy a rifle. I did the 4473 electronically. Was issued a delay. No reason for the delay. But that was Thursday. By the following Thursday morning, I went to the store and finished the transaction. Even though I was delayed, I brought the firearm home. Nics has me on delay, but yet SLED cleared me for my cwp. Makes no sense.
I just got denied in Michigan but I just obtained a CPL a month ago, makes no sense, I had to do a background check and give fingerprints to obtain the Cpl. so I’m allowed to legally carry but can’t purchase.
3rd time I've had a delayed status, they tell the FFL dealer on the phone 7 days from the call for the background check and then I just go pick it up. Makes no sense they deny it but then give a date that I can just come in and get it?

currently dealing with a delay - No criminal record other than a contempt of court for non payment of child support (I was homeless at the time) - I got caught up on my arrears about 2 years ago. But other than that - I am squeaky clean, no arrests, no DV, nothing. Gun shop owner told me he had 2 other guys that got holds on their purchases as well and about 1/3 of all gun purchases get holds. Its f**king nuts
Got delayed indefinitely in California, 5yrs ago... I moved to Oregon soon after. Got delayed indefinitely here too 4yrs ago... Built my own! Soon I will attempt again and if again delayed, I will increase the private build's caliber dramatically and construct multiple. 2A was created for one purpose and I will perform the one and only "duty" required of us by the founders, when the time comes, and with a smile on my face.
To me I am like ok then come to my house, inform local law enforce and the FBI, just simply do my background check already. I have nothing that would prohibit me from owning a firearm. I feel like my Background check is just sitting on a dusty shelf somewhere in the NICS office. I don't know what to do anymore.

my last 8 transfers in 2 years are all delayed. I think because of that exact reason of another person in the state with the same first, middle, last name as me. a police officer told me about it once in a traffic stop, the other me that is. I've never been arrested, or jailed or convicted of a crime, I have my CCW and I get delayed every time. will this effectively stop me from buying firearms? we'll see I guess.

I pawned a firearm and have always been delayed but this pawn shop when I picked up they called in and did a check and they approved me within 20 minutes, I just did another background for another thing and it's been delayed and I'm sure I'll have to wait the 3 days
Went to Dunhams for Black Friday to snag the G3c for $200. Bought my first firearm (g2c) in 2020. Have never been in trouble , and got a delay. Today is Tuesday and I am still waiting. I'm in Michigan as well.
Cool vid. I think the issue is that the law sort of jumps the gun in treating delays as people who they think are going to turn into denials. It kind of punishes people way before the fact.
Hello friends, i got a denial in my first purchase and i appeal with fbi and they overturned, i go to the gun shop they told me all its fine and they call me when i can pick up the gun, they never call me i went to the gun shop and they told me i go denied again with the fbi original letter says i can receive a posses firearm from xxx. Went to pick up my guns today. I don’t understand how I can spend a pretty good amount of money on a couple guns and I was delayed. I pay taxes, stay out of trouble, raise my son and keep to myself but I get delayed on guns I’ve already purchased? There has to be a better system than this.
I have a record “no felony’s” but went to get my first gun got a delay waited the 5 days and the store said I could come pick it up because they honor the Brady act. But it’s frustrating because I Never received an approved or denied. So I still just feel uncomfortable like I’m not allowed to own the firearm. Also what if I want to get another one?

The FFL can legally transfer the firearm after 3 days of delay if they dont receive a response back. 10 days if you are under 21. I assume this gun shop is choosing not to. They dont have to transfer while you are waiting for a response, but they can legally do so after waiting 3 or 10 days for a response. Many gun shops choose to over regulate beyond what the law requires. @@jacobdrow300

Several months ago I purchased a handgun with absolutely 0 issue. Even utilized the E-Check, which was convenient and was a good experience for me as a customer. Fast forward to today: I went to buy another handgun and I was delayed. I figured no worry, I haven’t committed any crime, and perhaps it’s the fact that it’s later afternoon is why I had to wait. Come around 2 hours, I left the store with a grave thought in my head (denial for no reason.) Now it’s 1:39 AM next day and I’m seeing this video. With all the control and BS laws in place, it really deters people from wanting to exercise their rights. God help us all as our government is becoming more and more corrupt. Law abiding citizens are the ones who truly pay, and everyday we’re closer to losing our rights.
My first ffl called on the phone for my nics checks and I was delayed the last 4 times. My new ffl uses the computer and they go right through. Don't know if that's a coincidence or what.
I just purchased my 4th firearm and got delayed almost a week than when i called the ffl they said i got denied even tho i have my ccw and take a state background check to see and it came back no record. I dont know what to do since i bought the firearm online and its already fully paid for
I get delayed every single time I purchase a firearm from an ffl here in Kentucky and have since my first firearm purchase at 18. I have no idea why. I get the proceed a day or so later but it's so annoying.
@2a Edu just an update. I bought 2 firearms that day. One of them was ordered so I was not able to fill out the form until it came in. The first I bought that was in stock I was delayed given a proceed the following day. About 4 days later my other one came in and I was given the proceed after about 4 minutes and able to take it with me. I do not understand that crap at all.
How can an 18 year old walk out of a store with a rifle and a bull of ammo the same day, and a 40 year old with zero criminal record get told to wait? Makes no sense. 😤
Because that's the government for you, I have active cops who used to always get holds before NICS started keeping proceed records indefinitely, which is illegal.

@@2aEdu well I just found out I was denied because my record was not up dated when I went to buy . The FBI letter said if the Record has been corrected are the charge nullified The charge was vacated/dismissed and the letter told me to go to the court clerk and have them fax and or email the judge’s verdict directly to the FBI … even though I did that Friday night …. Once they get the vacated documents what happens next will they release my gun with a letter or do I have to DROS again .

I was buying a VRAD from a sporting good store, and I went through the process of answering the questions, and at the end of it, the person took the laptop away from me and said you’re gonna have to come back in 30 days now I have a CPL and I have a problem every time I buy a gun They have to do it seven day background check on me because somebody has my last name so they have to check me out but I guess the point I’m trying to get that is why do they have to be such idiots when something supposedly was wrong they refused to tell you what you did wrong on the paperwork and just tell you to come back in 30 days talk about gun control. I am former LEO, I live in Wyoming, I have had a current concealed carry permit since 1994. In 2001 I traveled to Billings, MT to purchase a new hunting rifle, I spent the entire day at the gun shop waiting for my approval, it took over 8 hours! About 8 years ago I wanted to purchase a 22 rifle for my then son in law for Christmas, I filled out the on line form at Cabela's in Billings, MT and my approval was once again delayed! I told them to cancel the transaction. I returned home and walked out of the gun shop within minutes after showing my concealed carry license. What a huge PIA!!!!

The last NICS check after the 4473 changed took over an hour. Outrageous. I have been delayed many times sometimes 6-8 months apart with no issues in between. When you are 100 miles from home and get delayed I abort the purchase. Prefer to always buy local on purpose or shipped to a local FFL for NCIS just for that reason. They are using this as A self imposed 3 day waiting period. This never happened three years ago.
You can tell your FFL not to give your address etc to NICS. It will stay in a permanent delay and they will not be able to transfer the firearm to you.
They are 100 percent keeping all nics proceed search records indefinitely. Federal law allows denial records to be kept indefinitely. A passed check, also known as a proceed, is only supposed to be kept by the ATF for 24 hours, and some partial info for 90 days then destroyed. Hold records are supposed to be kept for 90 days unless it gets a proceed or denial; if it's denied it goes to the denial records, proceed or passed it then follows the proceed rules. Here is the official ATF rule. § 25.9 Retention and destruction of records in the system. i) NICS denied transaction records obtained or created in the course of the operation of the system will be retained in the Audit Log for 10 years, after which time they will be transferred to an appropriate FBI-maintained electronic database. iii) In cases of NICS Audit Log records relating to allowed transactions, all identifying information submitted by or on behalf of the transferee will be destroyed within 24 hours after the FFL receives communication of the determination that the transfer may proceed. All other information, except the NTN and date, will be destroyed after not more than 90 days from the date of inquiry. The ATF is not destroying records from passed checks as required by law. I 100 percent know this. I have customers who would always get a hold on a gun purchase every time, I'm talking 20-plus transactions each over 2-3 year periods. They always eventually get proceeded after 1-3 days, they most likely share a name or DOB with a denied buyer. At the start of 2021 these customers got one hold, the first of the year; since that time all purchases have been instant proceeds. The ATF is keeping their proceed purchase records on file past the time allowed by law. When they come in to buy a gun, the system sees their last 5 purchases were proceeded, so it gives a proceed on the current purchase. Before 2021, when the records were destroyed as required by law, the background system didn't see those prior purchase proceeds, because they were destroyed, so the always got a hold.
I have NEVER not been delayed. I normally get a proceed 1-2 days later. This makes me uncomfortable. I will happily sign onto a lawsuit here in Missouri.
I have a couple different state permits and also a LEOSA card, I get delayed every time. In my current state, I have to wait 10 business days after a delay to pickup my firearm. Will getting a known person number or whatever help?
Question I have a few expunged misdemeanors the Doj said their not prohibiting me I had another charge that was and the Doj told me if the judge removes it I am fine .. well the DA and the JUDGE agreed the wrong charge had been on my record 30 years simple cocaine poss and it should had been for weed they screwed up but the judge vacated and dismissed the charges and said for all records to be destroyed and he said I am not prohibited anymore . I am a security office and need a gun for work ..I also mailed copies of the judges order to the DOJ and FBI I went and bought my firearm do you think I will have any problems picking it up I am no longer a felon I am
So you mentioned delays of minutes or seconds. Back in Nov 22 I was getting a S&W M&P 15 Sport II at my local gun shop, FFL Transfer from PSA. It took a good 90 mins or more. Would that have been a delay? Guy in the store said FL is just weird like this, sometimes it's done in a few minutes, other times it can take a couple hours. Was never visited by police after. Also in early Jan 23 I got a Canik Mete SFx from G4G, FFL at same shop, probably didn't even take 5 mins for the background to go thru.
I am 20, bout my first AR through an FFL in my town and it got delayed 3 weeks. Bought the rifle on June 3rd, delayed til the 10th, now it’s delayed til the 22nd.
I went to a FFL today to purchase my first firearm, I got a "Delay". The FFL told me to come back in 4 days if I haven't heard from them and I can pick up my pistol. Went to purchase my first lower receiver, currently active law enforcement since 06, purchased more then a few firearms in the past. Just as recent In Nov 2022. Got a delayed response and then a letter from the DOJ regarding possible name and physical descriptions match to a prohibited person. Don’t understand especially when I provided current Department credentials and current DL information. Any suggestions or advice?

It’s been every time Iv bought a gun ! Such bs. And in MN you have to do a full background check to even be able to get to the point to do another background check! So i obviously passed . That is the Federal law. Which has nothing to do with what I said in regard to them requiring your address. The FFL may transfer. But many FFLs will not until a processed is given.
Frank here, i have no felonies, nothing my record is clean, im 41 years old, Just went to buy my first gun today here in florida (miami) at 1pm, it is 6pm and im still waiting for approval denied or whatever, at this point i dont know what to do, i do have my CCW permit and everything, this is crazy

I don’t think people realize how huge of an infringement this is. They also don’t realize how often denials and days are issued. I’m a retired police officer and I stopped by academy about 15 years ago to pick up a new backup gun. I’m in a marked patrol car and full uniform. After about 20 minutes I decided on a little.380 and started the paperwork. By this time, there are several people waiting at the gun counter. Then the employee tells me in front of everyone that I was denied. People just stared at me like I was a dirty cop or an impersonator. Talk about feeling humiliated. It took me countless phone calls, letters from a district judge and district attorney, as well as my chief of police, to finally get my name cleared. Turns out, someone who spelled their name the same as me was a convicted felon and they thought it was them trying to buy a gun. Even though they had all my information, and drivers license, they denied me. If it can happen to an officer in uniform, it can happen to you. In my opinion, they need to completely do abolish background checks. Criminals ain’t buying their guns from reputable ffl’s. Every gun control law only affects us good folk.

Can we have NICS checks run on every state and federal elected official before each of their votes? Should not the public know whether they are clean enough to buy and own firearms? Name, office held, proceed, denied and delayed should be enough. No individual with a firearm is potentially more dangerous to the public welfare than an elected official with a vote.
lol we just need govt to stop growing at the rate it is. im still trying to process today, they dont make it easy and its clear theyre not making it easier for FFLs either. the only handout i got today was pretty much a threat and made it clear theyre coming for our licenses and we better be above par on everything or we will lose it. no excuses.

One time I was picking up a lower at my regular FFL, and the gentleman helping me said my check would probably come back as "Delay" because everyone that day had come back "Delay." He suspected that it was due to a lot of checks taking place. It was another record-setting month for NICS checks. Fortunately, mine came back proceed, and we were both surprised, since my checks seem to take A LOT longer than most at that FFL. If 9 of 10 "Deny" statuses are incorrect, how many "Delay" status turn out to be a "Deny" status?
My state uses NICS. The state denied me twice. Both times I appealed and was granted a "conditional permit", which FFLs are not required. And they don't.
This all goes back to an arrest and two charges, which were dismissed in 1973. This is reflected in a NICS document I received from the FBI.
@peterk8909 It sounds as though you need a lawyer to expunge the arrest records. However, even this won't guarantee anything because expungements are a joke.
@@michaelragusa5138 The point is I was never indicted, tried or found guilty and my name doesn't even come up in Federal Records in that jurisdiction. The arrest shows in NICS but no dispensation.

Just arrived from the Philippines last night into San Francisco intl airport... Was the only one on the whole plane set aside for additional screening (open your luggage for customs).
I went to the B line expecting long snaking lines... It was ONLY me.
An officer was watching, already knew who I was (they were communicating with the original customs that told me to go to Line B) and separated me from my traveling group but not far enough that they all heard "Do you know why you were sent here?" I said no. He said "We're you recently denied a firearm?". I said oddly enough yes. He said thats why. Your info is now sent to local law enforcement as well as Customs and Border Patrol. This is to ensure you didn't go abroad to purchase firearms."
I said "Thank you for the info. First, if I wanted to illegally purchase I firearm... I wouldn't be doing it in the Philippines where it caught I would spent who knows how long down some dark hole of a crappy prison eating rats. I'd drive down to Oakland and pick one up thru the drive thru McDonalds."
Anyway... That's what's going on now. And the reason for the denial FYI is they claimed I had a 273 DV (domestic violence) conviction. INCORRECT. I had 272 NON DV and a 10 year ban which ended in 2010. I have already purchased legally a Glock and only had to deal with a delay. So now the gov is directly LYING forcing me to jump thru hoops.

This is truly worrying.. a friend of mine who has purchased a gun previously with no issues, was denied this year when he tried to purchase a new handgun with no explanation. He requested a police background check which showed nothing... I told him about these new laws taking effect in August now he's afraid to even purchase a gun. He doesn't have a carry permit, he literally only owns a PCC which he uses for sport and home defense.
I have a carry permit and even I'm worried about this bs law..
they taught us how to run checks on the LTCs and also said its ok to still run you thru nics even with having the exception is we want too. hint hint

What does the status of they delay mean when it changes to "open". That's what the FFL just told me. 2 weeks now over the holidays and he claims an open means he cannot legally sell via the Brady Bill 3 day. What a crock of BS, they hold you in limbo to deny your rights.

I got denied today trying to buy a new rifle. I have several firearms that I've purchased legally and I have no criminal record (just a couple speeding tickets). It's very frustrating and I feel my right has been denied. Finding out why I got denied is a very frustrating process too. The background check center has to send me a letter to tell my why I was denied and couldn't tell me on the phone. I filled out an appeal to the denial with the FFL so hopefully I'll be good to go soon. I'm just curious what could have even caused me to be denied. And now I'm hearing this news and I'm even more po'd

My ex wife accused me of domestic violence 25 years ago in 1999. In 2024 when I could not buy a personal protection hand gun at 63 years old. They first thing I thought was that I hate that woman that did that to me 25 years ago.
That is one of the reasons that I have never married; have never had a "live in" relationship; and have never had any children. I have heard so many horror stories from divorcees about marriage, child custody, and "living together."

i'm in california i got delayed back in december. i waited 10 days then 30 days and nothing so they asked for a live scan i did the livescan. i emiled the doj and they pretty much said i have to wait unitl they get to my paperwork.... almost a year and still waiting.

Here in SC I went to buy a rifle. I did the 4473 electronically. Was issued a delay. No reason for the delay. But that was Thursday. By the following Thursday morning, I went to the store and finished the transaction. Even though I was delayed, I brought the firearm home. Nics has me on delay, but yet SLED cleared me for my cwp. Makes no sense.
I just got denied in Michigan but I just obtained a CPL a month ago, makes no sense, I had to do a background check and give fingerprints to obtain the Cpl. so I’m allowed to legally carry but can’t purchase.
Denials & delay are in error about 90% of the time.
3rd time I've had a delayed status, they tell the FFL dealer on the phone 7 days from the call for the background check and then I just go pick it up. Makes no sense they deny it but then give a date that I can just come in and get it?

currently dealing with a delay - No criminal record other than a contempt of court for non payment of child support (I was homeless at the time) - I got caught up on my arrears about 2 years ago. But other than that - I am squeaky clean, no arrests, no DV, nothing. Gun shop owner told me he had 2 other guys that got holds on their purchases as well and about 1/3 of all gun purchases get holds. Its f**king nuts

my last 8 transfers in 2 years are all delayed. I think because of that exact reason of another person in the state with the same first, middle, last name as me. a police officer told me about it once in a traffic stop, the other me that is. I've never been arrested, or jailed or convicted of a crime, I have my CCW and I get delayed every time. will this effectively stop me from buying firearms? we'll see I guess.

I have a record “no felony’s” but went to get my first gun got a delay waited the 5 days and the store said I could come pick it up because they honor the Brady act. But it’s frustrating because I Never received an approved or denied. So I still just feel uncomfortable like I’m not allowed to own the firearm. Also what if I want to get another one?
I’m on the same boat, the FFL honored the Brady Date and gave me my rifle. However I never heard anything else.

Not necessarily. 90% of the delays and denials are false.
The FFL can legally transfer the firearm after 3 days of delay if they dont receive a response back. 10 days if you are under 21. I assume this gun shop is choosing not to. They dont have to transfer while you are waiting for a response, but they can legally do so after waiting 3 or 10 days for a response. Many gun shops choose to over regulate beyond what the law requires. @@jacobdrow300

Several months ago I purchased a handgun with absolutely 0 issue. Even utilized the E-Check, which was convenient and was a good experience for me as a customer.
Fast forward to today: I went to buy another handgun and I was delayed. I figured no worry, I haven’t committed any crime, and perhaps it’s the fact that it’s later afternoon is why I had to wait. Come around 2 hours, I left the store with a grave thought in my head (denial for no reason.) Now it’s 1:39 AM next day and I’m seeing this video. With all the control and BS laws in place, it really deters people from wanting to exercise their rights. God help us all as our government is becoming more and more corrupt. Law abiding citizens are the ones who truly pay, and everyday we’re closer to losing our rights.

My first ffl called on the phone for my nics checks and I was delayed the last 4 times. My new ffl uses the computer and they go right through. Don't know if that's a coincidence or what.
I just purchased my 4th firearm and got delayed almost a week than when i called the ffl they said i got denied even tho i have my ccw and take a state background check to see and it came back no record. I dont know what to do since i bought the firearm online and its already fully paid for

@2a Edu just an update. I bought 2 firearms that day. One of them was ordered so I was not able to fill out the form until it came in. The first I bought that was in stock I was delayed given a proceed the following day. About 4 days later my other one came in and I was given the proceed after about 4 minutes and able to take it with me. I do not understand that crap at all.

@@2aEdu well I just found out I was denied because my record was not up dated when I went to buy . The FBI letter said if the Record has been corrected are the charge nullified
The charge was vacated/dismissed and the letter told me to go to the court clerk and have them fax and or email the judge’s verdict directly to the FBI … even though I did that Friday night …. Once they get the vacated documents what happens next will they release my gun with a letter or do I have to DROS again .

I am former LEO, I live in Wyoming, I have had a current concealed carry permit since 1994. In 2001 I traveled to Billings, MT to purchase a new hunting rifle, I spent the entire day at the gun shop waiting for my approval, it took over 8 hours! About 8 years ago I wanted to purchase a 22 rifle for my then son in law for Christmas, I filled out the on line form at Cabela's in Billings, MT and my approval was once again delayed! I told them to cancel the transaction. I returned home and walked out of the gun shop within minutes after showing my concealed carry license. What a huge PIA!!!!

The last NICS check after the 4473 changed took over an hour. Outrageous. I have been delayed many times sometimes 6-8 months apart with no issues in between. When you are 100 miles from home and get delayed I abort the purchase. Prefer to always buy local on purpose or shipped to a local FFL for NCIS just for that reason. They are using this as A self imposed 3 day waiting period. This never happened three years ago.
I have a full pardon to restore my gun rights do I answer yes on nics test to having a felony or no because I have been pardoned?

You can tell your FFL not to give your address etc to NICS. It will stay in a permanent delay and they will not be able to transfer the firearm to you.
They are 100 percent keeping all nics proceed search records indefinitely. Federal law allows denial records to be kept indefinitely. A passed check, also known as a proceed, is only supposed to be kept by the ATF for 24 hours, and some partial info for 90 days then destroyed. Hold records are supposed to be kept for 90 days unless it gets a proceed or denial; if it's denied it goes to the denial records, proceed or passed it then follows the proceed rules. Here is the official ATF rule.
§ 25.9 Retention and destruction of records in the system.
i) NICS denied transaction records obtained or created in the course of the operation of the system will be retained in the Audit Log for 10 years, after which time they will be transferred to an appropriate FBI-maintained electronic database.
iii) In cases of NICS Audit Log records relating to allowed transactions, all identifying information submitted by or on behalf of the transferee will be destroyed within 24 hours after the FFL receives communication of the determination that the transfer may proceed. All other information, except the NTN and date, will be destroyed after not more than 90 days from the date of inquiry.
The ATF is not destroying records from passed checks as required by law. I 100 percent know this. I have customers who would always get a hold on a gun purchase every time, I'm talking 20-plus transactions each over 2-3 year periods. They always eventually get proceeded after 1-3 days, they most likely share a name or DOB with a denied buyer. At the start of 2021 these customers got one hold, the first of the year; since that time all purchases have been instant proceeds. The ATF is keeping their proceed purchase records on file past the time allowed by law. When they come in to buy a gun, the system sees their last 5 purchases were proceeded, so it gives a proceed on the current purchase. Before 2021, when the records were destroyed as required by law, the background system didn't see those prior purchase proceeds, because they were destroyed, so the always got a hold.
Ive only been able to buy 1gun where I actually walked in and out the same day all others five days.
I have NEVER not been delayed. I normally get a proceed 1-2 days later. This makes me uncomfortable.
I will happily sign onto a lawsuit here in Missouri.
Many people get delayed every time. This is BS
It takes longer to fill out the paperwork than it does to run the check here in Georgia with a concealed carry.
I have a couple different state permits and also a LEOSA card, I get delayed every time. In my current state, I have to wait 10 business days after a delay to pickup my firearm. Will getting a known person number or whatever help?
I got a delayed phone call from turners yesterday 😔🤧 but I can't pick up my firearm till the 11 of this month but they delayed me early 😮💨
Question I have a few expunged misdemeanors the Doj said their not prohibiting me I had another charge that was and the Doj told me if the judge removes it I am fine .. well the DA and the JUDGE agreed the wrong charge had been on my record 30 years simple cocaine poss and it should had been for weed they screwed up but the judge vacated and dismissed the charges and said for all records to be destroyed and he said I am not prohibited anymore . I am a security office and need a gun for work ..I also mailed copies of the judges order to the DOJ and FBI

So you mentioned delays of minutes or seconds. Back in Nov 22 I was getting a S&W M&P 15 Sport II at my local gun shop, FFL Transfer from PSA. It took a good 90 mins or more. Would that have been a delay? Guy in the store said FL is just weird like this, sometimes it's done in a few minutes, other times it can take a couple hours. Was never visited by police after. Also in early Jan 23 I got a Canik Mete SFx from G4G, FFL at same shop, probably didn't even take 5 mins for the background to go thru.
My transaction was denied today with no reason given.
I feel very frustrated 😣

Because they are the ones who will be tasked to take them if or when the time comes.

I am 20, bout my first AR through an FFL in my town and it got delayed 3 weeks. Bought the rifle on June 3rd, delayed til the 10th, now it’s delayed til the 22nd.
That is terrible. A right delayed, is a right denied.

I went to a FFL today to purchase my first firearm, I got a "Delay". The FFL told me to come back in 4 days if I haven't heard from them and I can pick up my pistol. I have never been in trouble with the law ,, I also have my hazmat endorsement on my CDL which required a background check with the FBI that I passed. It really does suck to be forced to wait

I have DHS and FBI clearance for high security areas but sometimes I can’t buy a gun in a store and sometimes I can . Make it make sense
I get delayed every time also, someone commented that you should apply to get your UPIN? Anyone have experience doing this? Has it eliminated your delays? Is this a good idea?
Went to purchase my first lower receiver, currently active law enforcement since 06, purchased more then a few firearms in the past. Just as recent In Nov 2022. Got a delayed response and then a letter from the DOJ regarding possible name and physical descriptions match to a prohibited person. Don’t understand especially when I provided current Department credentials and current DL information. Any suggestions or advice?
Another ffl told me to go to the Oregon State Police, to see why I got delayed.
Just went to get my first gun since I got my ccw and thought it covered me , still had to fill out everything and stood around over an hour just to get a delay again! It’s been every time Iv bought a gun ! Such bs. And in MN you have to do a full background check to even be able to get to the point to do another background check! So i obviously passed . Garbage and unconstitutional
Hey 2A EDU, in the state of Louisiana if you were delayed and there is no response from the nics check for 72 hours the FFL can sell you the firearm
That is the Federal law. Which has nothing to do with what I said in regard to them requiring your address. The FFL may transfer. But many FFLs will not until a processed is given.

Frank here, i have no felonies, nothing my record is clean, im 41 years old, Just went to buy my first gun today here in florida (miami) at 1pm, it is 6pm and im still waiting for approval denied or whatever, at this point i dont know what to do, i do have my CCW permit and everything, this is crazy
Just wait for the gun shop to call you back. It is crazy....and happens a lot.
Last gun I had transferred to me here in Whorelando, NICS took 42 minutes to respond. I figured they'd gotten into my rightwing blog comments of the past. NICS told the gun store the system was down. Right.
