Yes, I think she was very articulate. I was impressed with all the young people on how they presented themselves (in court at least). However, it wasn't a matter of challenging JM, it was a matter of the law. I personally don't put up with people talking to me like JM and some other judges sometimes do. However, if I'm wrong and can learn something, I accept the lesson. Then I tell them about themselves and where they can go LOL. (Not in court thought because I'm not going to jail or getting fined).

JM was dead wrong for dismissing the plaintiff’s case. I’m no lawyer or judge but could tell she was confused with the terminology. What I believe happened is she pled guilty to the charge(s), paid restitution fees, and was told the charge would be expunged so as to not show up on her record. But she used the term dropped. JM favored the defendant in this case off rip.

Actually what she was having trouble explaining is that the charges were DROPPED from assault to battery. Which is a phrase used by lawyers and adjudicators. They offer to drop my reckless driving ticket to simple speeding. I took it. JM is an a hole sometimes
She probably was initially charged with a greater offense, so when it was "dropped" to a lower offense, she understood it to be that way. Judge should have been more understanding. People don't understand lawyer jargon. She plead what was told to her to be better for her.
I think this was a fair ruling. How do you claim your charges were “dropped” but you know you pleaded guilty? Don’t use legal terms if you don’t understand the legality behind it. Also, I do believe that the defendants friend pulled a gun out but it seems they never mentioned it when the police was called and certainly weren’t scared enough because the cousin confessed that she fought the gun-wielding friend.

It’s possible she pleaded guilty to get in diversion program. Which could be should she complete the requirements of the program, pay restitution, etc… the charges are dropped as if it never happened. It’s usually for first time minor offense such as this mutual combat situation
I don't think the plaintiff purposely perjured herself. Sounds like the "they said it was better to pay restitution" and "charges were dropped" meant that she was told by a public defender or other attorney to take a plea deal in which she assumed responsibility for the couch for lesser charges. Sometimes i wish His Honor was a more patient with these young people. He knows what it's like to be a young and ignorant defendant.
Also her boyfriend just happened to be there...in her defense and with a gun. The defendant was definitely prepared for a fight but I also think that the plaintiff overstepped with disposing of her groceries. I can't speak to JM's judgement but let me be clear, the law is not fair. Behind the emotions, it all boils down to properly explained arguments and evidence so even an innocent individual can go down as guilty. We know this. For the plaintiff, even if JM or tvland didn't see you, I see you. But you allowed yourself to slip with this one, always try to rise above the pressure. Stop falling entrapped to petty issues. What I believe happened is she pled guilty to the charge(s), paid restitution fees, and was told the charge would be expunged so as to not show up on her record. But she used the term dropped. JM favored the defendant in this case off rip.
I disagree that he favored the defendant from the jump. I was thinking he was favoring the plaintiff. But neither your nor my opinion is the point. It is important to know the difference between "charges were dropped", "case was dismissed", "plea bargaining, pleading no contest, pleading guilty, etc. They do not have synonymous meanings.

JM missed a teachable moment and sent her back into the world as uninformed as when she entered his court. And he typically does better than that.
Judge must’ve had a bad day. There have been many times that he took the time to explain things, but he wasn’t in the mood today. I do understand that it’s also not his full responsibility, but these girls were young.

Actually what she was having trouble explaining is that the charges were DROPPED from assault to battery. Which is a phrase used by lawyers and adjudicators. They offer to drop my reckless driving ticket to simple speeding. I took it. JM is an a hole sometimes

She probably was initially charged with a greater offense, so when it was "dropped" to a lower offense, she understood it to be that way. Judge should have been more understanding. People don't understand lawyer jargon. She plead what was told to her to be better for her.

I think this was a fair ruling. How do you claim your charges were “dropped” but you know you pleaded guilty? Don’t use legal terms if you don’t understand the legality behind it. Also, I do believe that the defendants friend pulled a gun out but it seems they never mentioned it when the police was called and certainly weren’t scared enough because the cousin confessed that she fought the gun-wielding friend.
This definitely was a fair ruling, the plaintiff was convicted of those chargers and lie , they were antagonizing the defendant causing her to respond the way she did

It’s possible she pleaded guilty to get in diversion program. Which could be should she complete the requirements of the program, pay restitution, etc… the charges are dropped as if it never happened. It’s usually for first time minor offense such as this mutual combat situation
I don't think the plaintiff purposely perjured herself. Sounds like the "they said it was better to pay restitution" and "charges were dropped" meant that she was told by a public defender or other attorney to take a plea deal in which she assumed responsibility for the couch for lesser charges. Sometimes i wish His Honor was a more patient with these young people. He knows what it's like to be a young and ignorant defendant.
Also her boyfriend just happened to be there...in her defense and with a gun. The defendant was definitely prepared for a fight but I also think that the plaintiff overstepped with disposing of her groceries. I can't speak to JM's judgement but let me be clear, the law is not fair. Behind the emotions, it all boils down to properly explained arguments and evidence so even an innocent individual can go down as guilty. We know this.
For the plaintiff, even if JM or tvland didn't see you, I see you. But you allowed yourself to slip with this one, always try to rise above the pressure. Stop falling entrapped to petty issues. And remember to forgive.
