      I do think a more sobering question is can Joe Biden be arrested and incarcerated for treason and other more serious crimes related to the millions he and his family received on his behalf selling out the United States to hostile foreign actors.     As I did tweet when I had a Twitter account I was referring to the case in New Mexico. There are also current members of Congress in the House and the Senate that should be removed from Congress and prevented from ever running for at any level. If this does not happen what is the true value of the Constitution if we allow them to get a free pass. I personally swore an oath to the Constitution and honored that in the United States Marine Corps, served in Vietnam and was honorable discharged. My life threatened, while first being exposed to contaminated water at Camp Lejune and then exposed to the agent orange in Vietnam. I still have to fight for justice while dealing with illness after honoring the oath that I took to uphold and respect the Constitution. Donald Trump should not be allowed to on any ballot for office in this nation that I fought for.

      I'm a vet too and you are 100 percent right! My brother is a Vietnam vet and served in country in 69. He said he couldn't believe what he was seeing on TV the day of the insurrection and he said it brought tears to his eyes. Trump is a snake and his followers need to grow up.       Obviously not. And why (and which branch of government) would Sec. 3 of the 14th Amendment NOT be enforced? That's a great question, isn't it? Because there is strong evidence that Sec. 3 of the 14th Amendment does not apply to the President of Vice President. I put a full explanation here on this channel commentary last week but it appears Professor Reich pulled it down. I'm sorry he does not support opposing views. But by all means, KEEP ASKING THAT QUESTION!! In the meantime, I guarantee you Donald Trump will be on the Republican primary ballot of EVERY STATE, and if he wins the Republican nomination, he will be on the general election ballot of EVERY STATE.     Generally speaking, a provision in the Constitution like Section 3 of the 14th Amendment, requires an activating statute and a legal proceeding. For example, 18 U.S.C. 2383 makes it a crime to participate in a rebellion or insurrection against the United States, but Trump would have to be tried and convicted of violating this law in order to be barred from running for this. A state might pass a law giving its Secretary of State full and independent authority to bar a candidate on grounds of insurrection without a trial, but none has. Alternatively, an individual or group might file suit to keep Trump off a state's ballot, but lacking a criminal trial and conviction, it seems unlikely that such a suit would succeed. Remember, Trump was impeached by the House for insurrection but was acquitted by the Senate, so he might be immune from further prosecution for this offense under the shield of double jeopardy.

      The only time I've heard of this actually being tried it was Arizona and it was to keep Obama off the ballot. The issue was dropped when it turned out the AG was ALSO the head of the Arizona campaign for the GOP candidate for President. Last I heard he was the Arizona Senate Liason to the "audit" of the Maricopa county election in 2020 where Trump lost. He shouldn't have been allowed anywhere near an election.

    There is a national organization called "Citizens for Responsibility and Ethics in Washington": (CREW) that was responsible for the lawsuit mentioned in the video, that got the Republican official in New Mexico removed. Now, buoyed by this test case success and the recent article from the two conservative Federalist Society scholars that lend political gravitas to this 14th amendment Disqualification idea, they will be filling suit in a number of states to keep Trump off the ballot.       @@T.R.R.Jolkien Hi! The New Mexico State Supreme Court upheld that in that case of removing a public official, that the defendant engaged in an "Insurrection" and that is was an "Insurrection". Judge Matthews of New Mexico’s 1st Judicial District Court.wrote, "The riot and the planning and incitement that led up to it “constituted an ‘insurrection’” under the 14th Amendment to the Constitution.
      So, I respectfully add that one person was...however its unclear that SCOTUS will cite this as case law. It should be noted that its not binding precedent.

      @@T.R.R.Jolkien Yes, they have made it very open and clear that they believe the former president participated in a coup, and is a danger to democracy, and should never be allowed near the white house or hold office again. And yes, at every level the former President is facing numerous indictments in court. Call it desperation if you will, but that does not do anything to mitigate the charges against him. We simply do not know how the juries will find in the respective indictments, or what the district courts will decide, or even SCOTUS, if they weigh in with the disqualification. There are a lot of questions, and it will certainly be unprecedented.

      @@yourdaddy-mq4km I mean, January sixth happened, Trump encouraged it by his own admission, you can try to reduce the impact of that if you want, but it’s pretty messed up to try to start a coup to hold power. As for assault, Trump’s been accused by over 25 different women over the years. I don’t think they’re all lying, and someone in his position over the years would have plenty of opportunities. And he’s caught on video saying he likes to grab women in a pretty bad place, was he lying then? Why would he lie and say that he assaulted women when he thought he was in private? Bribery is a bit of a miswording on my part, my apologies, but over the course of his presidency many members of foreign governments stayed in his hotels and paid a crazy amount of money for his rooms. Like, way more then they’re worth. That seems like a pretty clear case of accepting bribes from other powers while in office. I encourage you to research that further because a lot of people could do a better job explaining that than I have. As for tax fraud, I think everyone already knows about that by now. If you are fine with him lying on his taxes, good for you, but it’s pretty well documented that it happened. Hope this was helpful, would you like links?

    I think it's kind of ridiculous that the rule that says your barred if you've been part of an insurrection only applies to those who once held public office. If you were part of an insurrection, you should be disqualified. No ifs ands or butts about it.

      I didn't hear anything about 14A only applying to former officeholders. Violating an oath of office is one way to be excluded, but not the only way. (Edit: this comment of mine is WRONG, I just read Section 3 and it DOES only apply to former office holders)

On that parameter, after MTG became a Congress member, her video recorded speech to a CPAC that had she "led" J6, "we would have been armed and it would have succeeded" unequivocally is incendiarily fomentive speech that should be the legal basis for 14th Amendment impeaching her.

    Okay, so I realize that this theory of invoking the 14th amendment is a long shot. First, I’m thankful that at least a Republican has grown a moral compass and has taken this action. And for those who say that technically Trump himself has not been officially charged with inciting an insurrection, I would advise them to look at and honor the letter of this amendment. ‘having engaged in an insurrection or REBELLION against the same (the government)’. And yes, several instigating participants have been directly charged with insurrection, and claimed Trump as the instigator, there is seriously NO DOUBT that Trump actively incited, inspired, abetted, and allowed this direct rebellion to occur. There should literally be no doubt here. I say this as a wholehearted former Republican. 😳

      Relax. He won't be on the ballot. His criminal charges take precedent over elections, no matter what you read here. His trial includes Jan. 6th insurrection. The Constitution is clear, very clear. If you have incited, or was involved in an insurrection against this country after you have taken an oath to protect it, you are automatically unqualified and could even lose citizenship. It's in the constitution. Read it. Let him weep. I am including one last comment, Criminal charges take PRECEDENT over elections, or campaigns. So, he will lose the money spent on his campaign and anyone elses money that he so willfully grifted from them. Keep your pocketbook close, you wallet closer.

    The Constitution, Amendment 14, Section 3 does not expressly require a criminal conviction, and historically,
    one was not necessary. A New Mexico state court, however, has removed Otero County
    Commissioner Couy Griffin from office and prohibited him from seeking or holding any future office
    based on his participation in, and preparation for, the January 6 interruption of the election certification.

    I am all in for this. Trump disqualified himself by instigating the insurrection on January 6th. His family and advisors told him to put a stop to it, he refused and did nothing. It would be awesome if we were able to do a collective lawsuit against Trump to remove him from the ballot boxes.

    There's a slight technical problem here.
    The specific people who are barred from holding office after engaging in insurrection or rebellion or giving aid or comfort to the enemies of the US are those "who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States."
    To disqualify Trump, he would have to be one of those people. He has not taken an oath as "a member of Congress," as "a member of any state legislature," or "as an executive or judicial officer of any state." He would have to fall under being "an officer of the United States." There is a serious question as to whether the presdent of the United States is an "officer of the United States." Some have made the claim that the president is an "official," not an officer (elected, not appointed by the president). The Constitution talks about "officers" a lot, but never calls the president one, and it is the president's job to appoint "officers."
    Then there this: "But Congress may by a vote of two-thirds of each House, remove such disability." In 1872, the Amnesty Act was passed by a two-thirds vote in each house that "all political disabilities imposed by the third section of the fourteenth article of amendments of the Constitution of the United States are hereby removed..." (There is a list of those for whom it is not removed, but none of them is the president.) There is a debate here as to whether "all political disabilities... are hereby removed" means "whoever now falls under this act has their disability removed" or "section 3 no longer applies except to the offices listed (which doesn't include the presidency)."
    While I would LOVE to see Trump disqualified from holding office, invoking the 14th Amendment is a far cry from a slam dunk and is likely to fail.
