I feel bad for elderly people because the cognitive decline does leave a lot of them unable to understand certain concepts or even take care of themselves. And for her it’s such the case. Adulting may be hard, but it doesn’t mean we get to be free of responsibility.

Smoking in an apartment building is such an evil thing to do. I live in an apartment (I'm in a major U.S city-buying a house is not an option for most people) and I'm about to have a baby. There are smokers in my building and sometimes they stink up the elevator and hallways. It stresses me out that they could harm my baby with their nasty smoke. I was a smoker in my teens and early 20s and never realized back then how truly vile it is to force those harmful chemicals on other people. Second and third-hand smoke can cause lifelong health problems for newborns.

I was a property manager for 7 years. Now I live in a building owned by a real estate company that my late husband and I used to do stuff for at her other properties ( she knew we had managed properties before). We just did odd jobs at her other properties, not manage them. The apartment building of theirs that I live in now has 4 units in it. I live on the first floor (I can't do stairs anymore). There is a family that lives in the other 1st floor unit. The complex is Rural Development ( disabled, low income). The family that lives on the first floor by me ........smokes nonstop. The mother has seizures so the husband stays home all day, while the son works a couple of hours at night 3 or 4 nights a week. The father smokes these cheap cigar like cigarettes and the son also smokes pot. My door is at the back of the building right next to the laundry room. Their door is right by the front door to the building. I can't even go the 8 or 9 steps through the hallway to the front door......without reaking of smoke!! We have a front loading washer and have to leave the door open on it, so it doesn't get mold and mildew. Leaving the door open lets all that smoke smell get in the washer. The apartment above them reeks of smoke too. My bedroom ends up smelling like pot, cuz I share a wall with the son. I have to fabreeze the hell out of my mattress and box spring, since I can't wash them. I was using the unstoppable"s in my laundry so they wouldn't smell like smoke, but I started breaking out......and it didn't help. I'd stay at my boyfriend's for a couple of days, and when I took clothes out of my suitcase......they reeked. Since I know the landlord well (as I said I used to do some stuff for her) I told her that I'm well aware that a tenant has a right to do what they want in their apartment, but what about when it effects everyone else. There are of course noise ordinances.....but not smell ordinances. She got me a air purifier, I appreciate it, but it's like throwing a cup of water on a huge fire.

Family and friends of mine who don't live in Mass (I didn't grow up here) seem to think it's weird my husband and I are still renting a one-bedroom and we're about to have a baby. I'm like.....um, the fact that we can afford to rent a one-bedroom apartment in our 30s is actually kind of an accomplishment lol Boston housing is wild. Most people I know here have roommates or live in much more sketchy/slumlord situations. Only one of our friends owns a home and she's a scientist.
I'm sure asshole, I'm gonna punish this lady for a pencil on the ground lol, plaintiff submitted the notarized lease which is proof she was there, and not living as a friend rent free, or if she were a squatter. Judge has to take the landlords side, if there are no receipts, which the receipts are her defense out of back rent etc.. or signed proof or evidence she is leaving in advance, whether she was living there or not. She's responsible as asshole anal leaf and pencil on the floor landlord, didn't have time to find another tenant. I believe her about the smoke and sketchy people in the building, poor woman.
The last known address is supposed to be used if there isn't a forwarding address. If the post office doesn't have or catch a change of address order and mail goes to the old address, write 'wrong address' on mail and stick it in an outgoing mailbox.
So even Harvey's answer at the end says that the old lady had every right to have a smokeless home and therefore was allowed to leave as she had already brought it up with the landlord, so why was the judge so biased against this old lady?...

Why do people always use the excuse of paying cash for not having a receipt? If you pay for an item in a store using cash, do they not give you a receipt? Also, I’m confused as to why the plaintiff would not have been required to mail any documents to the defendant’s last known address, i.e., his building? Even if he didn’t know her new address, the post office would. Lastly, there are free sites/services such as *“Watchdog”* that will alert you if a predator sex moves into your area. I’ve been using that one for years, but since moving out to the “boonies”, I never receive notifications.

They don’t give a forwarding address!!! They are supposed to mail it to the address the tenant is leaving. If it’s returned “no forwarding address submitted” then he has proof of no forwarding address..and proof he tried to send the letter.
Landlord was supposed to be the one who correct the smoking tenant especially if it's against the law in the state. He should be happy that she left peacefully. Usually when landlords only collect cash they are skimming books not paying the property taxes. She should report him to the IRS to make sure he's paying property taxes on all income from that building

The landlord didn't have an address to notify the tenant regarding the deposit, but was able to locate her for the lawsuit. Did he know where she worked when she left? If so I think she should of had interest on that deposit deducted from what she owes.

I feel for women that are older and aren't wise to the ways of the modern world....well the ways of the legal world anyway. My dad dealt with most (not all) of the money situations and I know my mom would be like this little lady and not understand why she had to give notice when the landlord wasn't upholding his end by making the smoker move out or stop. I've been in my place for 27 years and my landlady wasn't bright enough to charge me a deposit. She'll end up way better off as I installed a ton of outlets, breakers, new light fixtures, new flooring, a new toilet, new paint every 5 years, a deck, a big sided shed with 2 doors and 4 windows, all shelving in the basement, and the list goes on and on but she still keeps raising my rent. She even got a new furnace, new ductwork, water heater, insulation out of me because I was low income so the state paid for it and when the work was done she tried to raise my rent a month later. She couldn't by law raise it for a year after the work was done. I've stayed here only because it is a little house and it easy to heat and cool and has a huge yard and a garage. Otherwise I would have gotten out of here years ago.
That's not bright on your part. As stated, it's not your property. You are a renter, not the owner. If you did all these things, you should have discussed it with your landlord to deduct the amount you paid from your rent. Without permission, you've put yourself in a bad situation. The landlord has a duty to do upgrades and replace things as they are needed. You shouldn't take it upon yourself to decide these things for yourself (nor for your landlord).
The moment the defendant said she had moved in with her daughter, that is the proof she wanted out and no longer wanted to pay rent. The smoking issue was just an excuse. It only bothered her when she wanted to leave without paying.

I'm like.....um, the fact that we can afford to rent a one-bedroom apartment in our 30s is actually kind of an accomplishment lol Boston housing is wild. Most people I know here have roommates or live in much more sketchy/slumlord situations. Only one of our friends owns a home and she's a scientist.
If she has no receipt for the rent, then where is the proof that she actually lived there, and must give 30 days notice?
I'm sure asshole, I'm gonna punish this lady for a pencil on the ground lol, plaintiff submitted the notarized lease which is proof she was there, and not living as a friend rent free, or if she were a squatter. Judge has to take the landlords side, if there are no receipts, which the receipts are her defense out of back rent etc.. or signed proof or evidence she is leaving in advance, whether she was living there or not. She's responsible as asshole anal leaf and pencil on the floor landlord, didn't have time to find another tenant. I believe her about the smoke and sketchy people in the building, poor woman.

If the post office doesn't have or catch a change of address order and mail goes to the old address, write 'wrong address' on mail and stick it in an outgoing mailbox.
In some states you can’t smoke in any housing building.
That is for government building. In apartments, that is at the discretion of the owner of the building.

WHAT? She didn't have proof that she had paid but he didn't have proof that she didn't, so how is it that he won this case. And it is for HIM to enforce the no smoking regulation, not her. This landlord was wrong on so many levels and the judge was so wrong on this decision...
Why do people always use the excuse of paying cash for not having a receipt? If you pay for an item in a store using cash, do they not give you a receipt? Also, I’m confused as to why the plaintiff would not have been required to mail any documents to the defendant’s last known address, i.e., his building? Even if he didn’t know her new address, the post office would. Lastly, there are free sites/services such as *“Watchdog”* that will alert you if a predator sex moves into your area. I’ve been using that one for years, but since moving out to the “boonies”, I never receive notifications.

If she tells him earlier then he probably would telling the people to smoke outside unless if their state passed the law for not allow to smoke in any buildings. In here, Colorado passed the law forbidding to smoke in the buildings except for the casinos. I’m not sure about the bars. Anyway I hope everything works out for them.

They don’t give a forwarding address!!! They are supposed to mail it to the address the tenant is leaving. If it’s returned “no forwarding address submitted” then he has proof of no forwarding address..and proof he tried to send the letter.
Landlord was supposed to be the one who correct the smoking tenant especially if it's against the law in the state. He should be happy that she left peacefully. Usually when landlords only collect cash they are skimming books not paying the property taxes. She should report him to the IRS to make sure he's paying property taxes on all income from that building

I lived in one apt complex where the rule was tenants were supposed to smoke outside. But, when they went outside, the smoke came in through the (even) closed windows & doors. So I understand that.

The landlord didn't have an address to notify the tenant regarding the deposit, but was able to locate her for the lawsuit. Did he know where she worked when she left? If so I think she should of had interest on that deposit deducted from what she owes.

Recent lawsuits, ticket information at the court or forwarding address at the post office. Evidently this lady maintained her employment on the rental application over the years.

The defendant didn't pay her rent. She didn't give 30 notice, didn't leave the keys, and didn't even leave a forwarding address. The smoking issue may or may not have been the reason she was moving, because it seems she was short on funds every month to begin with. The plaintiff did exaggerate the damages left in the apartment however, but I'm glad he won. I do feel bad for her however, being elderly and having money problems.

I feel for women that are older and aren't wise to the ways of the modern world....well the ways of the legal world anyway. My dad dealt with most (not all) of the money situations and I know my mom would be like this little lady and not understand why she had to give notice when the landlord wasn't upholding his end by making the smoker move out or stop. I just don't like to see the elderly suffer in any way especially when they're nice people. I'm sure her daughters will help her sort this out.

I've been in my place for 27 years and my landlady wasn't bright enough to charge me a deposit. She'll end up way better off as I installed a ton of outlets, breakers, new light fixtures, new flooring, a new toilet, new paint every 5 years, a deck, a big sided shed with 2 doors and 4 windows, all shelving in the basement, and the list goes on and on but she still keeps raising my rent.
She even got a new furnace, new ductwork, water heater, insulation out of me because I was low income so the state paid for it and when the work was done she tried to raise my rent a month later. She couldn't by law raise it for a year after the work was done. I've stayed here only because it is a little house and it easy to heat and cool and has a huge yard and a garage. Otherwise I would have gotten out of here years ago.
You can't just go ahead and do as want in rental property without permission from the landlord. Your a tenant there not the owner.
That's not bright on your part. As stated, it's not your property. You are a renter, not the owner. If you did all these things, you should have discussed it with your landlord to deduct the amount you paid from your rent. Without permission, you've put yourself in a bad situation. The landlord has a duty to do upgrades and replace things as they are needed. You shouldn't take it upon yourself to decide these things for yourself (nor for your landlord).

The moment the defendant said she had moved in with her daughter, that is the proof she wanted out and no longer wanted to pay rent. The smoking issue was just an excuse. It only bothered her when she wanted to leave without paying.

Having your very own home excludes you for having to go through any of this back and forth between Tennant and landlord. When you have your own place you can do exactly what you want unless by chance there is a home owners association.

I've been pretty consistent on my beliefs irrespective of the subject. Home ownership, renting, women or anything else. Obviously, owning your own home comes with it own set of pitfalls and problems. But as an owner that's what you should go in expecting. Nonetheless I wouldn't have it any other way. Renting is not an option for me. No way
