    Good explanations Madam.. I am a former Philippine realtor for over 20years before becoming a USA 🇺🇸 Citizen and I have been warning some foreigners buying real estate in the Philippines the wrong way and not even consulting with the lawyer or realtor. I find them only listening to their girlfriends or boyfriends they met online. I hope they find your video. More power .. Mabuhay 🇵🇭.

      As I know a foreigner cannot own a property in Philippines ( land , house ) resort ) .you need to be married to Filipina or Filipino .

    Thank you for your informative video.
    Yes, foreigners can own condo units in the Philippines since a condo unit is just a 'sky space' in which the buyer doesn't own land, except as part of the collective corporation to which the foreign buyers will belong to as a minority of the total ownership.
    While some foreigners who buy condo units may also be intending to live or retire in the country as owners of quota immigrant visas, business visas, investor visas or retirement visas, some will buy condo units for repeat winter visits only. The investor visa doesn't cover the latter as it has other requirements.
    It can only be hoped that there will be some extra leeway, encouragement and security in the form of a special visa type for repeat visitors who buy condo units for that purpose.
    All foreigners who buy condos in the Philippines are part of a win-win for buyer and the country.

    This Law was written so the Natives in this Country will not be losing their own lands. It already happened in Hawaii that their natives are homeless and the rich foreign investors enjoying their own lands.

      Why are these problems (Filipino Citizens, born in the Philippines ) appearing now. There should have been Laws whenever a land is purchased by a Filipino, born in the Philippines or naturalized citizen in another Country ( USA).

    Since then , I am now 74 years old dual citizen and I firmly believed I am lucky more than most.
    The UNLUCKY PART IS THE NON ATTENDANCE OF TRANSFER OF TITLE ON BEHALF OF MY WIFE'S INHERITANCE .. WE SPENT A LOT OF MONEY AND ALL THINGS RUN IN CIRCLE AND MY WIFE DIED NOW AND I DO NOT KNOW WHAT TO DO WITH OUR MONEY SPENT IN THE DEVELOPMENT OVER 13 YEARS .
    THE TITLE HAS NEVER BEEN TRANSFERRED TO HER OR TO US AND WE SPENT LOTS.. AND LOTS IN HOUSE REBUILDING.. APPROXIMATELY OVER SEVEN MILLION PESOS AND THAT SMART DELAYED FOLLOWING THE CONVOLUTED PROCESS

      If foreigners are allowed to own property in the Philippines, it will be the start of modern day invasion and slavery. We Filipinos will be outcast in our own country. We will become servants to foreigners who own our lands and beaches. Not to brag, but the Philippines is a resort country or a bigger Hawaii but way cheaper. So if foreigners are allowed to own land, the Philippines will be their vacation home while we become thier servants. Foreigners however can own condominium because technically you do not own the land.

    Look up how a Usufruct Agreement can be used to grant a foreign national indefinite use of land in which case the foreign national can own all assets built on the land including property... but only for the duration of the Usufruct Agreement

    I'm glad, and not to worry, I inherited my parents 25 hectares land with my 5 siblings. I am planning to go home planning to get dual citizenship because of my share. Retiring next year and probably stay there...right now, the estate is in form of a Corporation. Currently, The property is rented by DOLE, my siblings and I have equal share of the income.     Honestly id rather not to buy or own in the philippines a property very disappointed. We bought a condo and suddenly my agent signed ad Spa which i dont trust at all why? I read a lot of complaint that SPA can do whatever they want on your property or condo whatever ,there is even one person her aunt is her mom spa and she pwan it tobthe bank and now is having big trouble . I read in the philippjnes if we are abroad need of SPA whic is sucks id rather invest my money here in the US .

    Real property does not only refer to land. Buildings are also real property. The prohibition is only in ownership of Land.

    foreigners can own the property in their name(buildings) and land in the wife's name. Sometimes it is better to do a contract for each. Husband can be on the deed of sale, as the owner of the building not on land title.

    I would like to kindly seek clarification/interpretation of existing Philippine Laws governing *former natural-born Filipinos (e.g. non-dual citizen).
    1. I ownership limited to “Condominiums,” but not for single-family homes (ie houses on top of lot/land
    2. Does the 1000 square meter maximum only apply to 1 property? For example, can a former Filipino own 2 condominiums and/or houses (on different locations), as long as the cumulative total does not exceed 1000 square meters?
    3. Does the 1 Hectare maximum only apply to 1 parcel/lot of land? For example, can a former Filipino own 2 parcels/lots of land (2 different locations), as long as the cumulative total does not exceed hectare?

    I was born before 1973 in the Philippines with full blown Filipino parents. I was immigrated in the US as a young kid and had kids before I became a US citizen. My husband was American. My kids are now in their late 20’s and are making a good living. I am now a widow and been debating and trying to find out how to obtain real estate in the Philippines without paying taxes arm and leg for both countries. Questions and let me know if I am making any sense.
    *knowing how taxes works we should not obtain Filipino /American dual citizenships to avoid paying taxes for both countries.
    *I could obtain a dual citizenship and own land in the Philippines when I turn 60 (when I collect my late husband social security) that way I can only pay taxes in one country (you don’t pay SS in US in my understanding) and I will be able to pass on my property to my American citizen children.
    Please let me know if I am making any sense and if there is a better way. Thank you.

      Hi. You can reacquire Filipino citizenship and be a dual citizen. Re: taxes, if you're dual but you don't have income from PH, you won't be taxed in PH. You'll only be taxed in US based on your income from US.
      As a former Filipino citizen, you can buy land but subject to limits. If you're dual, no limits re: size of land. If you are not dual when you buy the land, you'll have to make an Affidavit that you're a former Filipino - your realtor should know about it.
      Since your kids were born while you were still a Filipino citizen, they were born dual. If you want them to be acknowledged as dual, you (or they) should file a delayed Report of Birth at the PH consulate which serves the state where they were born.
      You can buy and own land as a former Filipino. As for your kids, they can inherit land if they are dual citizens. I'm not sure if they can inherit your land if they are purely US citizens, since they will be considered as foreigners.
      Since your kids are already adults, ask them if they want to be dual citizens. Many younger ppl are opting to have multiple citizenships as backup plan. If they don't work/ live in PH, then they won't be taxed in PH.
      If you intend to retire in PH, another option is permanent residency (13G visa). You will not be a dual citizen but you'll be a PR in PH. You'll still be considered as a foreigner and will have to visit a BI office yearly.
      When you plan to buy land, always do your due diligence. If possible, conduct a site visit. You can opt to buy (raw) land, a subdivision lot or a rent-to-own unit in a subdivision - something like Camella, Lumina, APEC homes, etc. You can also opt to buy a condo unit. Good luck.

    This land belongs to Filipinos. Kung magbebenta kayo sa mga foreigners dapat mga condo units Lang. Kung gusto nila ng land like beach resorts, upahan na Lang nila long term pwede nila tayuan ng facilities ayon sa kasunduan ng land owner . Yan ay upang hindi mawalan ng tirahan sa sariling Bayan at Bansa ang mga Filipino.

    Well. being a Pilipino born in the Philippines, I have the right to vote and a right from want as long as it is lawful in the Philippines. But my suggestion is let some good foreigners own land but only for residence and not for business. And lawfully follow the law of the government. But if it is only to SPY just to give information to their country, it is different. So we must be aware for it.

    Hello Joselyn. Concerning cell phones bought to the Philippines. Does it matter if the items are new or used? For example my wife has a large family and we usually take many USED , mostly outdated, phones to give to her relatives. As many as a Dozen is usually requested. Is it ok to bring this quantity if they are used, some damaged or broken(to be repaired) to the Philippines? Thank you and we really appreciate your valuable information to travelers!

But wondering if any exceptions for me if I apply for Dual Citizenship ??? And do know there may be some benefits for me if I do end up a dual- citizenship !!!     Q: Former Filipina, currently citizen of S Korea for 20 yrs, was gifted 2 hectares of agricultural land (rice paddy & coconut) by her family (both parents are still alive). The land does not have a residence thereon. Is this use for agriculture alone considered "commercial" under Philippine law, the term "commercial" does not apply to strictly agriculture land in the US. What about the Philippines.

      That's kind of suspect. All Filipino studied English. English is basically considered a second or third language in the Philippines.

      @lucy - short story: pag naturalized citizen ka po ng ibang bansa, as a former Filipino pwde ka bumili ng land or magmana ng land pero may limit. Kung may anak ka at di sila dual citizen, di sila pwde magmana ng property/ land mo sa Pinas.

      @@alcab4855 not all Filipinos who have naturalized in other countries are good at English. Yes, they may speak/ understand it but it depends on their educational level and exposure to English. Some Filipinos have naturalized in countries where English is not the main/ 1st language. They may know/ speak the other language better (example Italian, French, German, Arabic, etc) instead of English. Try to be more understanding.

    I am a natural born citizen. In 1990 i immigrate to Canada got married and became a Canadian citizen in 1992.
    I got divorced in 2000.
    In 2006, I purchased a small house in a 89sqm lot iin a residential subdv. however when I paid off the property the subdv developer issued a title to my maiden name with note that I was married to a foreigner. The developer argued that there is no divorce in the Phils.
    As a natural born citizen, I am allowed to own a small property right. And foreigner name should not be in the title, Correct?
