Supreme Court On Child Porn: SC Says Watching, Storing Child Porn Offences Under POCSO Act
SC overturns Madras HC judgement that ruled mere storage of child pornography is not an offence. The HC judgement ruled mere storage of child pornographic material, without intent to transmit, is not an offense under the POCSO Act. Supreme Court held that storing such material without deleting or reporting implies an intention to transmit. It observed that the Madras HC committed an 'egregious error' by quashing the criminal proceedings against the accused. The SC bench, led by CJI DY Chandrachud and Justice JB Pardiwala, set aside the High Court's decision and reinstated criminal prosecution. The Court noted that failure to delete, destroy, or report the material establishes a prima facie case of culpable mental state which is necessary to invoke statutory presumption under the POCSO Act.
