Yes, a judge, at sentencing could, in effect, do that. Judges today don’t just declare insanity. They rule for the person to have a totally independent psych eval. He’ll scream, he’ll cry, he’ll insist “it’s not fair” that he doesn’t get to pick his own docs for the eval. No matter. Judge will require it. One way or another. The judge gets the report, and if necessary, testimony, then rules. If 45 keeps deteriorating like this up to September 18, the sentencing that day could include a mandate for a psych eval. Unfortunately for us who want him just plain gone, such an evaluation takes time.
