      @Erikj-fd8pz Actually, my case does set precedent, specifically within the 10th Circuit. It’s already been quoted in 4 other cases, reinforcing its importance in shaping how qualified immunity is approached, especially in New Mexico, where it has been abolished. This case wasn’t just about winning; it’s about creating lasting legal impact and holding law enforcement accountable under the new standards. Precedent isn't always about being the first-it’s about the influence and effect it has on future cases.

      It is my opinion that ,the lawyers SHOULD be paid separately by the city,state or county. The settlement should be yours, for all the pain, suffering g and humiliation endured, for the past whatever number of years, plus interest on that payment, dating back from the day you were wrongfully arrested.

      Require public servants to maintain insurance that pays for their malfeasance. Why should the public pay for the actions of an individual officer? No insurance, no job, no retirement. Problem solved.
      End qualified immunity.

    • @CeanStrauss
      @CeanStrauss 2 หลายเดือนก่อน +9

      Even without Qualified Immunity cops still receive indemnity. And QI only applies to civil litigation so even if it was abolished cops still wouldn't be charged for their crimes and they still wouldn't pay a dime for lawsuits. Not lawyer fees, not court costs, not even judgements. Although it should be abolished it wouldn't solve anything, or make LEO's any more accountable.

    It's sad that people have a sense of entitlement to your money. Very very sad.

      Probably due to the fact civil lawsuits have nothing to do with criminal charges. You need to ask the prosecutor why they refused to press charges or the police department for not creating charges. We cannot charge someone criminally

      I have heard from other 1st Amendment Lawyers that if you press to go to trial , you may still win, but the jury may only award you $1.00
      Settlement still makes a statement and if he goes back & does it again, then the cops will lose qualified immunity as this is now Case Law in that county/state.
      Only the truly stupid cop would arrest ANYONE again doing the same thing as they will most likely be fired and then can be sued personally. Settlement is still a win.

      Completely separate. Ask the dept and DA. It's been 6 years so I doubt anything will happen. They've probably been promoted several times by now for doing this type of criminal activity.

    That’s an awesome settlement and it’s great that Stray Dog can TALK about it! I wanted to shout about the surgeon who disabled me thirty years ago, but the settlement didn’t allow me to discuss it with anyone. He’s dead now- I won a measly 600K for my life being destroyed. Even last night, still and after over thirty years, I was I so much pain I didn’t sleep at all. His “nightmare” was personally paying me after getting kicked out of the hospital for having no malpractice insurance. The lawsuit was hard and depositions were brutal. Lawyers are ridiculous. I felt like I was on trial after all I’d been through! I’m thrilled for Stray Dog! ❤️
