As a 30 year mechanical engineer, I am questioning why Engineering Australia, whom all practicing engineers must be registered with, are sitting on their hands whereas they should be launching investigations into members questionable activities.
- pointing these guys out to EA as well as state authorities is a great ask... OR at the very least - coack professionals in the space to be more competent going forward (don't treat everyone as a failed competitor - work within the profession "you" can' cope with all the business out there) Sure I/one can write code to solve most of these theoretical issues, getting the guys to build it is the problem 100%...
When you are already getting paid by the government there is no incentive to get off their a$$es and do actual work to ensure the safety of Australians.

I know it will be tough but we must fix our current min standards issues across the board. Personally as a former commercial building manager I did everything possible to be a better person with self reflection. I had an excellent relationship with all my clients and contractors but we were always fair if something was clearly over site a correction to price if required ..
Removing council inspections for new properties was the end of decent housing in Australia. The certifiers are all buddies with builders and there’s no legal repercussions.
Council compliance inspectors can be doggy too... the ones that still exist. eg. signing off on drainage and landscaping works in accordance to permit plans PRIOR to start or completion of such works.
I design overhead powerlines in the US. You would be amazed how second nature it becomes to memory specific tables and rules that you use on every other project or so. It's easier when it's organized in a manner that makes sense which NESC is but still I will admit it is impressive his level of detail. After a while though it's like memorizing formulas from school repetition and understanding makes it easier.

The civil engineer who signed off is a disgrace and his license must be cancelled immediately. His other previous jobs must be checked aswell. This site has alot of safety concerns there from whats pointed out in the video. The builder has no idea what hes doing aswell. Just ripping peoples money off. Both should be disqualified and work some easier professions. How can they even sleep at night.

I know it isnt allowed to say on youtube but that had been my house - and the responses and actions from the builder was happening as theyre told from the customer... lets just say he probably wouldnt be able to build houses for a long period of time. I'd be willing to catch a case for that amount of money. And what about the engineer?! No f-ing chance he's ever been on site and done a survey. I'd be suing that engineer for lying out his ass and signing off on this build. Absolute furious watching this.

This was a very informative video ! I really feel for this home owner , unfortunately they signed bad contracts and they will likely be tied up in legal red tape and a whole lot of $$ for the next few years 😢. As I see the outlined non compliance it won't be your stated $100,000 more likely $300,000 rectification works ! This makes me so upset for them , the builder will just go broke and start up under a new name next week . The system is completely wrong 😢🤬

Urm... I am a commissioning engineer, I have been for over 25 years. In my state in Australia, if I sign off on something and it is incorrect, I can (and will) be prosecuted years later. Even if I wasn't an anal asshole, it simply would not be worth it to fraudulently sign a document. And this is how it should be!
Any civil engineer signing off on such a horrible job should, with the builder, lose their license and be held financially responsible for all work required, up to and including complete demo and rebuild, to bring the building into full compliance. Without such penalties, licensing and "certification" means nothing.
I am a Boilermaker intermediate rigger and have worked with many different construction projects. The steel work on this project is under size and the wrong materials for taking loads. These poor people are in for world of hurt.
In Victoria, it appears that certificates are issued without thorough verification, as individuals are aware that their work is not subject to scrutiny.
I’ve seen this a few times, people who have worked in or around the building industry and they think they know a lot more than they do, sometimes they’re just scaffolders or plasterers, they get their building ticket and to get the contract they under quote the job not allowing for variations or little problems that pop up along the way, they start cutting corners and this leads to further problems and before they know it they are losing money hand over fist.
When I looked at the BCA volumes the problem is clear. They were written by lawyers. The text needs to be simple and bullet point with lots of drawings and photos of compliant and non-compliant examples. It is not because lawyers can't read drawings. But mainly because it would mean less work for them interpreting ambiguous text they wrote to feather their nests.
Wow yeah the contract also says the builder will treat a private inspector as a 7 day delay, meaning another $4000 addition. What a scam. These people suck
We also signed On 250 per week in case if delays however our house is almost 9 months past due date since can we negotiate this or possibly get in increase after consulting a lawyer as we are payinguch more due to these delays - bank interest rates , rent

"I'm ganna be honest" is a bad way to begin every sentence that comes out of your mouth in response to a question, it can put many people off and even have them suspect that you are, in fact, being dishonest. Someone needs to teach people how to present themselves in situations like these so they can get the most favorable outcome for their given problem.
@ yeah it's a little contradictory, i believe the builder said he'd match or beat the other estimates, another red flag when he is doing that, especially with the cost of materials today.

@siteinspections Hi Zeheer, Site access question - do you have your own master/inspector's key to enter the property for inspections. Or would I need to contact the builder to get the main door unlocked to enter the house? My previous PI had this key, there was no need for us to ask the builder for site access. There is no fencing around the house.
Too often it seems that home owners put a lot of trust in the builder. A building contract is a large and sometimes complex document and the builder is supposed to be an expert so their word is trusted.
This is the most frightening channel on TH-cam. I’m not, BUT if I was building a ‘home’ in Melbourne I’d be terrified of what was happening and who was making sure my interests were being maned by. Victoria has become the state where accountability and consequences for actions has all but vanished. From the Premier down govt corruption and failures to do what is expected and proper is now the norm. Sadly until there is a massive change in leadership and accountability is enforced with fines and gaoling nothing will change..
Spot on - you need to be a special breed of person to believe the VIC Govt authorities have the 'consumers' best interest at heart. It just seems the whole industry is in on the scam.....the govt and council take your fees, the builder does shonky work, you engage lawyers and head to VCAT and you go around in circles.

The largest purchase in your life and you get no quality, no protection and the VBA and Building Surveyors take no responsibility. It shows you how piss poor the government and regulators are. I think people now need to think outside the box and prepare separate contracts of responsibility for the surveyors, builders and engineers and if they won't sign, don't use them.
It's the responsibility of the builder to engage engineers and surveyors. This is for their quality assurance 😂 You can engage independent professional services at your own cost. An independent surveyor should be included in your budget at a minimum.
I have built several properties and totally agree. My point is, people should have the builder sign a contract stating you will have an independent inspector allowed in any time and that in the event of defects, payments will be held until rectified. That would separate the good from the bad builders because if they are good enough, they won't worry about signing. The only trust in these contracts is the forced trust by the builder so ppl need to circumvent that issue. The VBA is a just that, Victorian Bullshit Authority.

I've got a lot of questions about Aussie const and engineering(I'm in USA).what's with gravity held roof tiles? I'm in Florida we use complete roofing membrane 1st then tiles are permanently attached with urethane foam it works quite well. Roof just survived its 3rd hurricane not 1 tile lost. What about tilt slab cons for fire and wind damage anything like that.
When I built back in 1997 there were arguments with the builder over delays due to weather. They claimed wet days when they weren't. Between that and other issues I had quite a file of paperwork and QBSA (Queensland) got involved.
That's the problem in Australia. Once the private certifier or engineer signed off a document builders are free to change things and cheat and they will show signed off work paperwork, in Singapore and Dubai if engineer signed an approval and builders cheated after or change the materials or made any changes to reduce the costs they will be accountable and responsible.
Where do the reference documents come from? Are they freely available? Im just starting on a build, but building regs are non existent and I want a build that is an investment and not a liability.
Is not just the builder, is much tradesman’s fold they don’t have pride,skills or self respect is all about the money, no laws to stop them close today opens tomorrow under different name, government pretends of not seeing them.
UK watcher here, in the UK you cannot sign away statutory rights in a contract, it makes the contract unenforceable and unreasonable, why can you do that there?
@ Pretty simple. The Law says as the owner you and your nominees have a right to access the building site. The example given for clarification even says you do not need the builders permission. That supersedes the contract terms. My point is those terms indicate to someone familiar with the relevant law that the contract is terrible and unprofessional, dangerous.
@stuartlaird7341 I understand but trying to make a gain using a false instrument (ie an unenforceable contract) is criminal fraud under both the fraud and theft act. We would call the police, have the builder removed for criminal trespass and report them for fraud and if any payments had been made then theft as well.
i believe when the builder told the home owner he’s previous company has built 500 homes , well yes the ‘company’ built 500 homes - he may have only contributed his efforts to 5 !

I would question the legality of that contract, beyond the numerous “ unfair” terms there are several conditions designed to deny basic consumer rights and others that imply illegal activities such as not complying with building regulations , practices and/ or the licensed bodies.

A Performance Solution is a customised way to meet National Construction Code (NCC) requirements without following standard Deemed-to-Satisfy (DTS) rules. It’s not a specific document but a method that may involve engineering reports, testing, expert assessments, or alternative designs to prove compliance. It must be approved by the relevant authority and demonstrate that it meets the same safety and performance standards as the NCC.
Basically a certified and qualified in the field Engineer does the calculations to prove that the solution is adequate. Provides the documentation and signs off. This would tale some time, a lot of expertise and probably a bunch of expensive modelling software to provide a proof and it would be quite expensive for a one off.
Hey Zeher . I know a couple of builders adding up $5000 if a client wants to hire a private inspector during the construction . Also they will add atleast 2 months to the construction time frame due to delay ( will be caused by building inspector even for minor items) picked during construction. I was checking the domestic building contract act 1995 and it does not state anywhere that a builder can delay or charge extra for hiring a private building inspector.
Sounds like the builder knows he’s cutting corners, and an experienced building inspector exposes the builders sins, he’ll use that extra $5K to do the job PROPERLY…what a scam!
@@kamalthakur2040 as far as i know you are free to let an inspector come and the builder cannot charge you extra. Simply because you dont need to inform the buildet beforehand. So if he were to try to add 5000 to a bill, because someone let an inspectpr come, that would be illegal.
There is a good chance the engineer was given the specific concerns and assessed based on photos and dimensions. Probably the stuff the building surveyor picked up.

Never sign any building-related document that you haven't first run by the best solicitor you can afford. That bill will look like chickenfeed compared to the possible downsides of not doing it.

I'm only 12minutes in, I feel as though the engineer needs to be un-certified, de-registered and should be facing criminal charges for negligence.

As a painter I can say we are competing against people who are not qualified which means I get one out of 6 quotes.

That would be the best outcome for the owners. They would then access the home owners warranty insurance and get a decent builder to fix the mess.

"I'm ganna be honest" is a bad way to begin every sentence that comes out of your mouth in response to a question, it can put many people off and even have them suspect that you are, in fact, being dishonest. Someone needs to teach people how to present themselves in situations like these so they can get the most favorable outcome for their given problem.

@ yeah it's a little contradictory, i believe the builder said he'd match or beat the other estimates, another red flag when he is doing that, especially with the cost of materials today.

@siteinspections Hi Zeheer, Site access question - do you have your own master/inspector's key to enter the property for inspections. Or would I need to contact the builder to get the main door unlocked to enter the house? My previous PI had this key, there was no need for us to ask the builder for site access. There is no fencing around the house.

Too often it seems that home owners put a lot of trust in the builder. A building contract is a large and sometimes complex document and the builder is supposed to be an expert so their word is trusted.

This is the most frightening channel on TH-cam. I’m not, BUT if I was building a ‘home’ in Melbourne I’d be terrified of what was happening and who was making sure my interests were being maned by. Victoria has become the state where accountability and consequences for actions has all but vanished. From the Premier down govt corruption and failures to do what is expected and proper is now the norm. Sadly until there is a massive change in leadership and accountability is enforced with fines and gaoling nothing will change..
Spot on - you need to be a special breed of person to believe the VIC Govt authorities have the 'consumers' best interest at heart. It just seems the whole industry is in on the scam.....the govt and council take your fees, the builder does shonky work, you engage lawyers and head to VCAT and you go around in circles.
At minimum all inspectors/engineers who sign off on things like this need to have all licences revoked and permanently banned from the industry.

The largest purchase in your life and you get no quality, no protection and the VBA and Building Surveyors take no responsibility. It shows you how piss poor the government and regulators are. I think people now need to think outside the box and prepare separate contracts of responsibility for the surveyors, builders and engineers and if they won't sign, don't use them.
It's the responsibility of the builder to engage engineers and surveyors. This is for their quality assurance 😂
You can engage independent professional services at your own cost. An independent surveyor should be included in your budget at a minimum.
I have built several properties and totally agree. My point is, people should have the builder sign a contract stating you will have an independent inspector allowed in any time and that in the event of defects, payments will be held until rectified. That would separate the good from the bad builders because if they are good enough, they won't worry about signing. The only trust in these contracts is the forced trust by the builder so ppl need to circumvent that issue. The VBA is a just that, Victorian Bullshit Authority.

I've got a lot of questions about Aussie const and engineering(I'm in USA).what's with gravity held roof tiles? I'm in Florida we use complete roofing membrane 1st then tiles are permanently attached with urethane foam it works quite well. Roof just survived its 3rd hurricane not 1 tile lost. What about tilt slab cons for fire and wind damage anything like that.

When I built back in 1997 there were arguments with the builder over delays due to weather. They claimed wet days when they weren't. Between that and other issues I had quite a file of paperwork and QBSA (Queensland) got involved.
That dwelling looks like it's in a fire zone. Is it AS3969 compliant? I can't see how that roof would prevent ingress of embers to the roof framing.

That's the problem in Australia. Once the private certifier or engineer signed off a document builders are free to change things and cheat and they will show signed off work paperwork, in Singapore and Dubai if engineer signed an approval and builders cheated after or change the materials or made any changes to reduce the costs they will be accountable and responsible.

Where do the reference documents come from? Are they freely available? Im just starting on a build, but building regs are non existent and I want a build that is an investment and not a liability.

UK watcher here, in the UK you cannot sign away statutory rights in a contract, it makes the contract unenforceable and unreasonable, why can you do that there?
Generally you cant to that here either, but unless you know your rights, you don't know the contract is dangerous.

@ Pretty simple. The Law says as the owner you and your nominees have a right to access the building site. The example given for clarification even says you do not need the builders permission. That supersedes the contract terms.
My point is those terms indicate to someone familiar with the relevant law that the contract is terrible and unprofessional, dangerous.
@stuartlaird7341 I understand but trying to make a gain using a false instrument (ie an unenforceable contract) is criminal fraud under both the fraud and theft act. We would call the police, have the builder removed for criminal trespass and report them for fraud and if any payments had been made then theft as well.
i believe when the builder told the home owner he’s previous company has built 500 homes , well yes the ‘company’ built 500 homes - he may have only contributed his efforts to 5 !

I would question the legality of that contract, beyond the numerous “ unfair” terms there are several conditions designed to deny basic consumer rights and others that imply illegal activities such as not complying with building regulations , practices and/ or the licensed bodies.

Basically a certified and qualified in the field Engineer does the calculations to prove that the solution is adequate. Provides the documentation and signs off. This would tale some time, a lot of expertise and probably a bunch of expensive modelling software to provide a proof and it would be quite expensive for a one off.
Hey Zeher . I know a couple of builders adding up $5000 if a client wants to hire a private inspector during the construction .
Also they will add atleast 2 months to the construction time frame due to delay ( will be caused by building inspector even for minor items) picked during construction.
I was checking the domestic building contract act 1995 and it does not state anywhere that a builder can delay or charge extra for hiring a private building inspector.
Annoying but $5 k sounds like a small price to pay.
Sounds like the builder knows he’s cutting corners, and an experienced building inspector exposes the builders sins, he’ll use that extra $5K to do the job PROPERLY…what a scam!
@@kamalthakur2040 as far as i know you are free to let an inspector come and the builder cannot charge you extra. Simply because you dont need to inform the buildet beforehand. So if he were to try to add 5000 to a bill, because someone let an inspectpr come, that would be illegal.

The biggest issue with Australian Standards is they are behind an overpriced pay wall, being SAI Global. These should be freely available.

There is a good chance the engineer was given the specific concerns and assessed based on photos and dimensions. Probably the stuff the building surveyor picked up.

Never sign any building-related document that you haven't first run by the best solicitor you can afford. That bill will look like chickenfeed compared to the possible downsides of not doing it.
Fair dinkum, imagine signing a contract for 3/4 of a million dollars without having a lawyer go over it with a fine-tooth comb!
Also make sure you have a lawyer go through the contract, not a conveyancer. I learned that the hard way 😅

@danaveye3977 never again. Missed the fact the builder did not have DBI and a few other major issues with the contract and then when I requested they follow this up with the builders lawyer they wanted to charge me for it.

Owners need to stop being so trusting. All they can think about is getting their sand castle built. Inspections at every stage from an independent inspector.
