As someone who did gymnastics for a long time, the foam pits we used were at least 6-7ft deep and used thousands of blocks to fill. The fact that anyone in charge thought this was acceptable for people to use is mind blowing.

Even shallower foam pits usually have a trampoline or some foam structure beneath to cushion people

@@Yurio Man, that's what I was thinking too, that they either would've had a very thick foam pad under there or a trampoline the whole length of the pit.

One of the worst things I've heard from Twitchcon so far (besides this): Twitch staff wouldn't let a disabled person sit down in the line, despite the person insisting they were going to pass out. When they DID pass out, their service dog started doing DPT (deep pressure therapy) to help. Twitch staff then literally TOOK THE SERVICE DOG OFF OF THE PERSON, causing them to be passed out for over a minute. Mind you, the dog's vest clearly said on it DO NOT REMOVE FROM HANDLER. Absolute disaster all around.
Edit to add: This happened to lounaticlive

    • @spoopyvirgil4944

Twitch staff committed a misdemeanor there. Edit: I'm not recommending people jump in at all (even feet first). I don't think the pit should exist with 2% foam in it. I'm just saying, the workers let people jump in weird ways knowing there wasn't a lot of foam and that's weird!

I worked Twitchcon this year. I live in Japan and I HATE flying. Also, I don’t like big crowds and am pretty introverted. I gotta say, I was very presently surprised from the good vibes at Twitchcon. From the people who stopped by my work’s booth to the creators in artist alley, every person I met was incredibly nice. I would absolutely, 100% go to a con again. The only dark cloud (for me, I know other people experienced a number of issues) was the fact that the foam pit stayed open until Sunday afternoon when the injury occurred on Saturday. That was shocking.

I legit almost died in a foam pit one time in 7th grade. A friend i was there with playfully buried me underneath a bunch of them while i desperately tried to shovel them off. While this was happening and i was completely hidden from sight, a high school senior was jumping down the trampoline track and did a flip into the pit. This man had no idea where in the pit i was and a did a flawless fucking axe kick that resulted in his heel striking me right in the center of the forehead. I felt the crack of my skull through my entire body and it swelled to the size of an egg. I amazingly did not get a concussion and that senior actually broke his heel on my face when it happened. Shits crazy dangerous pretty much all the time
Edit:i am in fact okay thank you for all the retroactive concern. When i went to the doctor a few days after that incident they told me if i hadnt been as heavy set at the time i likely would have died without the cushioning. (152.4 cm.), and it is only permitted to dismount into a foam pit from normal trampolines, NOT allowed from high performance trampolines.” Considering that the foam only went up to their knees, and 60 inches is 5 feet that definitely isn’t up to standard. Of course, they weren’t jumping from a trampoline, but they were still jumping into the foam pit regardless and that shouldn’t change anything.

my mom had gotten a back injury about 2 years ago now that she still deals with. Surgeons are too afraid to do surgery because apparently her injury is super rare and a surgery has a 70-80% chance of leaving her paralyzed. So with surgery out of the picture all she can do is weekly therapy to make sure she can get somewhat better this way. She deals with so much pain and it is awful to see her like this. To be more specific, a waiver can limit liability, but cannot absolve them of it. In this case though, it probably would be considered an assumption of risk because it looks like they had to walk through the foam pit to get to the platforms and could therefore tell how shallow the pit actually is, though I guess she could argue that foam pits are meant to be able to catch your fall and she relied on this knowledge when she jumped and it is therefore a faulty/ negligent design. So it would depend on the judge, though I suspect they would side with the former rather than the latter.

    • @-yeme-
      @-yeme- 2 ปีที่แล้ว +1

as far as im aware, even a signed waiver cannot absolve the organisers entirely, and specifically not in the case of gross negligence. even with waivers in place, they have to meet minimum safety standards. lots of people get payouts when stuff like this goes wrong, and you can bet they all have waivers because insurance companies will demand it. the waivers are basically saying the company or organisers will take reasonable precautions, and the participant absolves them from responsibility for freak accidents that happen in spite of those measures, acknowledging the inherent risks in stuff like this that are impossible to entirely eliminate no matter what safety measures are taken. but when those minimum standards are NOT met, then the organisers are on the hook, for sure.

This hits very close to home for me.
4 years ago, we had a school trip to a nearby party/activity centre, and there were a bunch of foam pits with acrobatics trampolines leading into them, among a whole bunch of other stuff.
Pretty much the fun went unattended for about 20 minutes, and a classmate of mine jumped in head first, from one of those trampolines into the massive foam pits.
Except so many people had jumped in the same place, that there was essentially a density hole he hit spot on, and he crashed with pretty much full speed to the floor, hitting his head and just about folding his neck in half.
He completely fractured vertebrae 4 and 5 if i recall correctly, and was left at the bottom of that pit for about 15 minutes before people got wise to what was going on.
Immediately upon being found, he said "i can't feel my legs, my back hurts".
He ended up being airlifted out of the pit, his head in a stabilizing brace and everything... Traumatic shit.
After months and months in the hospital and years of rehabilitation, he's able to walk again, if only barely, but he's physically still a mess, and has lost feeling in a lot of his lower body.
One disc higher and he would have been dead.
People often think that foam pits are cool and fun and super safe, but they're not without risk.
What i just described happened to a 17 year old, under the supervision of 2 teachers, professional on-site entertainment staff, with certified safe equipment and setups.
It was on national news, and one of the two teachers who was present still has trouble accepting that it wasn't his sole responsibility.
Don't think that risk is entirely nonexistent when it's been mitigated.
You are the pilot of your own body; Don't fly blind on the instructions of others.
    Stay safe.

It’s absolutely horrific. You can see the exact moment she realizes what’s happened as the pain hits her. And all the while the commentators are laughing at her like she’s just being a wimp. It’s downright abhorrent.
The look in her eyes is chilling to me, because I know just how bad a back injury can be. My dad has been dealing with one before I was even born and I see it hold him back every single day, and it breaks my heart. I hope Adriana recovers well…at least she seems pretty young and healthy, so there’s a chance she might be able to live a relatively normal life if the care is good enough. Not perfect, but she wouldn’t be getting a lifelong challenge like my dad did. Exercising will be considerably harder for her, best-case scenario.

I broke my back in 3 places. I'm now 22 and i take pain meds whenever my back feels worse than other days but there's always that lingering pain that's like a thorn in the side. Carrying heavy things is a no-no, standing for too long is a no-no and being able to sit down and actually be comfortable is now extremely rare. Lifting weights at the gym is possible, but only lower weights and more reps instead of heavier ones. Deadlifting etc. is definitely impossible. I live a relatively normal life still, i sometimes just get very sad that after i've worked a full day, i get home and i cant even sit in my chair comfortably and relax to play some games, so i just give up and go lay down instead and do shit on my phone haha.

But instead, i accidentally lay my feet on the board again making me trip and landing 90 on my ass. My back was extremely hurting. I saw a friend of mine infront so i screamed for help. It's really not unrealistic to expect that you could jump into it. You're right, it would've been completely avoidable if the pit had been adequately cushioned as expected. This could've easily happened with someone just being shoved off. Even in this video, he says other people got injuries from just falling in, dislocated knees and back pain. They signed a waiver before being able to enter the pit, yes. But in California, the State Supreme Court found that while waivers will remain in force when ordinary negligence was involved on the part of the service provider, the waiver will be invalidated by acts of gross negligence. Gross negligence is defined as “an extreme departure from the ordinary standard of conduct.” This includes serious injury or death. I'd say breaking your back in two places classifies as a serious injury without a doubt. Foam pits tend to have a trampoline at the bottom with foam "supports" between that and the bottom of the pit to prevent this kind of thing, and are much deeper. This was just a lazy construction and should have been inspected prior to it being approved for use.

I was in grade 6 and was walking home for lunch during a really bad thunderstorm (lived literally across the street from it) and thunder cracked SUPER loud and I jumped and something popped, and I've never been the same since. Seemingly random times it'll twinge up and paralyze me. It never shows up in any scans or anything but it's somewhere about the center of my back, a little bit under my shoulder blades area. I have a friend who survived falling from a 7th floor balcony during a grand mal seizure several years ago. I truly hope this girl is able to take whoever is responsible to the cleaners and can get herself properly fixed up so she doesnt have to spend the rest of her life suffering due to someone elses incompetence.

I'm so very sorry for your loss. I hope you find reassurance with the knowledge that your father is no longer in pain - he is at peace. Pain, especially chronic, unending pain like your father endured, is one of the worst types of torture. Your father was a strong, strong man to keep going, to keep living for as long as he did. He was truly a warrior, and you deserve to be proud of the decades-long battle against his own body that he fought. He is at well-earned peace, after a long battle.

Wavers don't cover against gross negligence.
If you sign a waiver to an amusement park, and you get hurt from a bolt falling off a coaster, no waiver will protect against the gross negligence of the lack of maintenance. Same thing here. The people who operated that should have known that there was not enough protection to prevent injury from a fall.

@@aniyilator it’s actually pretty easy to mess up a foam pit if you as the organizer aren’t willing to put any money or effort into making it safe. thing is, foam pits need to be like 11(? correct me if i’m wrong) feet deep, with a lot of layers of foam cubes, a trampoline under those, and foam pylons under the trampoline. they’re not something you build casually and i assume it would be difficult and expensive to set up a proper, safe foam pit at a con. which is exactly why they didn’t do it, and went with the cheapest option which was literally one layer of foam cubes on top of concrete floors. which they *kept open* even after someone got injured

I used to be a gymnast and I went to several different gyms. The foam pits were all required to have 6 feet of foam blocks and a trampoline underneath to absorb the impact, not just a slab of concrete. That was definitely not up to code. I've done hundreds of flips into foam pits, even landing head first. There's no way anyone should be injured jumping into a foam pit.
