    Mam mera question yah hai ki Incom Tax Authority inspection aur annual return regular without complain sabhi fulfill karte hai aur nahi fulfill karne par Income Tax Authority immediately action leti hai vese hi Co.Op. Housing Society ka audit aur inspection regular yearly basis par authority ko without complain as a procedure karna chahiye ya nahi ? Aur jab society ka building maintenance proper nahi hota hai aur building jarjar halat mai ho jati hai tab Municipal Corporation notice issue kar only building ke girne ka intjar karta hai aur Bahut jan hani ho jati hai. Authority ka koi procedure nahi hota ki vah society ka regular audit aur building inspection yearly basis par kare because Municipal Corporation sabhi flat holder se vera vasuly tau yearly karta hai. Vese hi Authority ko chahiye ki sabhi Co-Op Housing Society ka annual inspection automatic regular basis par jese society fund aur building ki condition etc ka hona chahiye ya nahi. Aur yadi esme truti / fraud paya jaye tau society ke karta dharta se immediately vasul karna chahiye. Dhanyawad.

    1. Mam my society amend the Bye-laws but never apply for approval to the registrar,
    2. Society DOES NOT allow Inspection / gives copy of the records,
    3. Society DOES NOT allow to inspect accounts,
    4. Society DOES NOT ACCEPT correspondence / reply,
    5. After submitting Probate, society is demanding Records & Proceeding of the High Court,
    6. Society Manipulates AGM Minutes,
    7. Society DEFY the letters of the Dy. Reg.,
    8. Society Does Not File "O" report,
    9. Society appoint advisor on yearly basis for advice, but pays unlimited without approval of the AGM,
    10. Many more .......

    Namaste Ma'am, aapki baat bilkul sahi hai, hamari society mein yahi ho raha hai,secretary apni post chhod ne ke liye taiyaar hi nahin,aur apni manmani karta hai, hissab nahin deta,na hi documents dikhata, next week aapse baat karta hoon.thanks.

      Make a Complaint in writing along with the evidence if you have any to the Dist. Registrar, this should work out, do acknowledge the copy of complaint which you present it will be a proof

    What you say is right
    But it is not practicabe in reality
    Registrar do not take any action and ultimately I fed up after great follow up
    And decided to leave it.
    It is a shee waste of time money and energy

      In any circumstances and before any authority there is always hierarchy , you can make a complaint before that authority, there is always appellate authority

    Mam one thing...what ever is written in MCS Act, no body follows. REGISTRAR will take money and say everything is OK. All these stuff spoken by you sounds good but Practically it's not possible after all REGISTRAR is also a human being.

      @@onlinelegalinformation4587 Mam in my society, my society is going for redevelopment. But what kind of redevelopment these people are planning god knows. Some real estate brokers are always favouring the Builder and talking in favour of builder not in the favour of society. Managing Committee, PMC, some real estate brokers are all corrupt and always favouring the Builder. I asked them question like..
      1). We are having .4 FSI, so at what rate you will give to builder.
      Ans: Free
      2) Society land
      Ans: Free to builder for development
      3). I also own a city civil court dicree which is in my favour.
      Ans: We don't recognise it.
      4). Corpus?
      Ans:5 lacs
      5). 250 sq feet Garage??
      Ans: 7.5lac builder will give (mam Rs7.5 lac for garage in chembur, naka 🤣)
      6) As per old building 🏢 plan balconies are external/open what about that, will that area be included at the time of construction??
      Ans: No it will not be included.
      Last tym registrar came for voting on redevelopment, i told registrar about court dicree, registrar said, voting can be conducted bypassing court dicree (which is not executed by the society).
      Mam I don't know how can I get my right with real value in redevelopment.
      The society has property tax Rs.19lacs outstanding (not paid), previous construction amount is due Rs15 lacs...
      Ans: Builder will see all that 🤣
      In our society nobody speaks exept me and being a society of relatives, i go in minority.
      Society: Guru Krupa Terrace, Near basant park, chembur naka. Pls help

    Members filed complaint against the committee to challenge the audited accounts of society before sub registrar but didn't proceed against committee for four years whether this complaint can be reopened again by members before sub registrar. Pl. Reply Mam . Thanks

    Maintenance cash se lete he aur wo Paisa society ke account me nahi jata to kya kar na hoga. Koi hisab nahi batata he to proper aur galat bill rakh deta he

    Greetings ma'am,
    A society did not do any repair works from 2007 to 2020, so there was too much repair works to be done, the total amount collected from 2007 to 2020 would approximately be above 2.1 crore (120flats in a wing apx) 2500 aprx per month painting charges...
    So now they did start the painting but charged 32000 extra per year apprx for every flat for 2 years...
    What can be done over... I highly feel that funds have been used wrongly...
    Please help

    Society maintenance pay kiya hai but management change ho ne k wajha se who record mai nahi aaraha .
    Bar bar batane pe bhi who update nahi kar rahe aur penal interest bhi charge ho rahi .
    Is mai kya karna chahiye..
    Jab payment kiya tha to society form nahi huwi thi

    Mam please guide us. Our society is charging extra orbinant amount of Non occupancy charges. Society secretary has passed in AGM. We are forced to pay. Before also one of members have complained to regist rar but still secretary is charging according to his wish. We threaten to pay more than 10 percent. Interest is also charged on extra orbinant amount. Please guide us mam

    Mam please video on non occupancy charges... My society asking for 500 rs ... Service charges is 500 rs.. actually charges comes to 50 rs.. but some society members are jealous because we are earning rent from property...they are saying you earning money from flat ...

      It is 10% of maintenance charge 500 rupees is proper if maintenance is 5000

      Be very careful of adminstrator take on him , sit on his head, examine all account books , funds, many administrator are of thief loot funds of society and you can complain registrar,deputy registrar, joint registrar

      You don't need rti to inspect take copy of documents however you cannot access particular of other members like share certificate, wills etc however account,agm minutes, building documents,bills you can see nobody can stop

    Madam, ex Commite not produced balance sheet from 3 years ...Gave 10 request letter to Registrar but no action taken till date ...When we meet registrar he gave order to NEW Managing commite as punishment for complain and told to producce balance sheet of old comitee other wise legal action taken...
