    Good am. Atty. ang lolo ng lolo po namin ay may OCT ng lupa. Nung namatay po siya ay hindi niya nahati ang nakasaad na tract of land...ito din po ay pinirmahan talaga ng dating Gen. Governor Leonard Wood...Sad to say nalaman na lamang namin ngayon na may nag file sa court na lost and destroyed ang OD copy po namin at nakalagay po CANCELLED na ang lalabas na nasa Titulo...at isa pa,nag donate ang datu kuno na son ng kapatid ng lolo ko....kaya nag file kame ng petition & protest na kaso sa court(isa ay lolo ko na pinakamatanda sa heirs ng may- ari ng lupa)sa SCAM na ginawa nila(kasama engineer,at mga relatives sa side nung papa niya as witnesses)....maibalik pa ba sa dati ang titulo na na cancel gawa na pinag interesan ng mga in-laws ng lolo ko?
    Pati ang ROD,,,hindi rin makapagbigay ng Original
    copy ng tirulo, wala nmang naka annotate na nwala o nasira sa vault nila? Please....

    Good day po atty. question: a person who received kasulatan ng pag prenda ng property però walang titulo na pinanghawakan. Itong KASULATAN lamang kung Saan nangyari 50 years ago na at naka position sa lupa at sila ang nagbabayad ng Amelyar under the name of the original owner ,yong kasulatan nag sasaad ng isang Bahagi ng portion però HINDI KABUOHAN NG PROPERTY. ngayon po yong taong na hawak ng kasulatan at pinag prendahan patay na po. Ang problema po ginamit yong property at inangkin na kanila però walang titulo po sila .. paano po yon puydi ba po magawaan nila ng Titulo yong taong nagkahawak ng kasulatan?? DENR Certificate name the original owner and receipt ng amelyar name ng original owner.. puydi po nila itong magawaan ng titulo kasi po mga malalaking tao at politiko sila sa lugar namin.

    Atty, may minana si misis ng house & lot sa Los Banos, Laguna pero itong mga pamangkin at Brother in law namin ang nakatira for over 25 yrs na. Ang Property ay naka pangalan pa sa aming mag asawa. Sa awa ni misis ko sa kanila kasi wala silang Property halos binigay na namin itong house & lot. Pero itong last December 2023 ay enembezzled ni Brother in law ang funds ng business namin, malaki po nakuha. Pwede po ba namin bawiin ang Property tutal hindi pa namin Napa notaryo ang contract namin at walang change of ownership na nangyari.     Pano naman po kung yung share ng surviving spouse binenta sa isang anak ang share nya pero hindi alam ng ibang 4 heirs/anak? Pero ngayon parehong deceased na po sila (seller and buyer). At ngayon lang nalaman ng ibang heirs ang naging bentahan and they are questioning the legitimacy of the transaction. Yung mga heirs ng namatay na buyer are claiming they are entitled to the previously purchased shares plus the remaining shares from the balance of the estate equally divided among the heirs. Kaya up to now hindi pa rin ma settle / partition ang estate.

    Good Day Atty, Tanung ko lang po kung makukuha po ba nang mga heirs Ang binebentang lupa nang papa nila. Ang nabentang lupa sa Deed of Sale at Tax Declaration ay mas maliit Kay sa sa Actual na lupa, kaya gusto I claim nang mga heirs yong sobrang area. Ang transaction po nang sale is way back 1996 at Ngayon year 2024 ay I claim nang heirs Ang sobra dahil 54 sq.m. lang Naman Ang nasa Tax Declaration. Thanks po atty

    Atty medyo hawig sa topic mo kaso ko (March 3, 2023), my case, 3 sila nagbenta, under contract to sell, ako hindi pumirma, ang sabi ng lawyer nila, "anyway you can buy it back within one year", why should I buy it back, hindi naman ako nagbenta?

    Hello po Attorney,
    May tanong po ako may binili po na lupa ang parents ko way back 1980, may mga humabol po kaya nag file ng kaso ang parents ko nong 1996, nanalo po kami sa kaso . Enexecute po ng Sheriff ang court order, pina survey po namin kasama yong levy. Ngayon po attorney hindi ginawan ni Sheriff ng documentation yong levy which is 200 sq/m, ang tutal na area na po dapat ay 860sq/m. Ngayon po patay na po yong May Ari ng lupa. Yong pinamanahan po ng lupa na natitira ay benenta na niya sa tenant nila.(parte lang po ng total land area yong nabili ng parents ko) Ngayon po yong bagong nakabili is pumasok sa lupa namin na nabili. Ano po ang dapat naming gawin? Sana po matulungan nyo kami kasi po stroke patient na po tatay ko. Maraming Salamat po and God bless 😇

    Hello atty , seeking advice po in terms of legal redemption, nagbenta po yun tita ko ng share nya with offer to sell na sobra mura for a beach resort may pirma sya at notarized , pero di pa po tapos ang ejs kasi mga di pa nakumpleto pirma ng lahat at di pa rin paid binayaran installmen,may nkasulat subject for completion payment upon ejs execution.Pwede pa po ba mabayaran ko as pamankin kasi now lang naunawaan ng tita ko ang halaga ng propert.Kasi sabi nun buyer nagbentahan na daw sila, parang rent to own nangyari sa pagbbayad nya.Thank you and God bless☘️

    Legal redemption parang walang kwenta attorney dahil meron time frame. Kase hindi lahat nang tao may alam sa bagay na yan. Katulad sa mga tita ko hindi na pala nila maredeem yung mga binenta nang father ko before ejs o partition agreement. As of now malayang naeenjoy nang mga nabentahan ni father ko yung lupa. What about po sa mga tresspassing o squatters sa lupa ni lola pwede po ba gamitan legal redemption? Slamat oo sa sagot.

    Goodafternoon po Atty..Raymund ask ko lng po kng pano mailipat sa pangalan nmin ang Tax Declaration n2ng bahay..meron na po akong Titulo ng lupa at nasa pangalan na nmin ang Tax Declaration kaya lng po e2ng bahay nasa pangalan pa po nong binilhan nmin. Kya kpg ngbbayad po ako ng buwis nsa pangalan pa rin nong binilhan nmin..
    Need pa po bang mgpagawa kmi ng new Deed of Sale n2ng bahay? Ang problema po ndi na po nmin alam kng nasaan na ang taong binilhan nmin..pano po kmi mkkpgpapirma sknya ng deed of sale..sna po matulungan nyo kmi kng anong dapat gawin nmin para mailipat sa pangalan nmin e2ng bhay .maraming salamat po atty..hintay ko po ang kasagutan nyo..

Syam ang mga anak niya bali parents namin patay na lahat kami nlng mga apo naiwan mga heirs bali mag pinsan. Ang tanong ko isa sa pinsan namin inangkin niya ang buong property at dahan2 niya binenta portion of it kasi sa kanya daw buong lupa instead of dividing it to 9 shares at basta nlng sya magbenta kung kailan gusto niya pwd ba yun?

    Good Morning Atty. ! Tanong ko po ano mabuti gawin para makuha ko sa madaling panahon ang Overdue cash refund ko na 104,000 sa San Jose Builders Corp? About 6 years na mula ng mabigyan nila ako ng refund amount. Ang lagi na reply sa mga followup ko by email sa After Sales Department ay ganito " we are still waiting for the funding of your refund.

    Atty. May subdivision na IP ang may ari , 1st husband nya is an ilocano na maaga namatay, dowry daw nya eto pero napa title eto sa Bureau of Lands in 1974 married na sya sa 2nd husband na IP din maybe in the middle of 60s. Pressume namin na di narehistro both marriage since IPs in the 60s marry thru their elders. Years after they died also the children of the first husband also gone. In 2018 the children of the second husband requested for a reissuance (holder not known) of the title and made an EJS na sila lang ang heirs hindi na sinali mga apo sa 1st husband. Considered ba na conjugal property ng second husband and the wife ang property ? Di ba kasali din mga apo ng 1st husband nd sa lola nila na syang nakapangalan sa title.?

    Atty ang property po ng tatay at nanay namin na pareho nang patay ay ibinenta ng isang kapatid namin. Hindi namin nalaman before selling. Nalaman na lang namin natransfer na title sa bumili. Yung mga documents used for the transaction nakita namin hindi tutuo, fake kagaya ng mga pirma.mahahabol/ mababawi p ba namin yung property?

    Sa legal redemtion po atty, nagbenta nga po father ko before ejs, hindi po alm nan mga auntie ko about redemption, dumating ang panahon nagpagawa na po sila ejs, paano po yung nagbili s father ko pwede pa ba bawiin, in fact hindi pa nga po pala yun fully paid sa father ko hanggang kinamatayan nya yung bentahan at waa pa pala proper kasulatan piece of paper lang advance payment daw at may pirma ni papa received payment naman. Until now naooccupy nila lote wala sia deed of sale. Pls advice us po

    Hi atty, i am one of your new fan from Switzerland. May tanong po ako Atty. About sa tenant po sa lupa nang father ko. Patay napo father ko 21 yrs ago. Recently yun tenant po namatay at cya po nag tenant since. May isang adopted child po cya but not interested to takeover. Nag aasawa po yung deceased tenant but she is not the tenant of my father.     Hello atty... May I ask regarding pasalo.
    Ganito kasi situation.
    May pina assume na townhouse tapos naka loan sa pag ibig. nagkasundo na magbayad ng 200k si mag assume(buyer). nag down ng 100k , tapos yung balanse ay hulugan within 5 yrs. May deed of sale na ginawa. Ngayon, ilang months after, ayaw na i continue ni buyer magbayad kasi daw meron pala daw na contribution naka include sa pag ibig loan. Di na daw nya bayaran ang balanse kasi sa seller daw mapunta yung contribution na naka include sa loan na 30yrs. Di na magkasundo. Gusto ng buyer ipa refund daw ang 5h monthly addtl contri. Si seller naman, di pumayag parang lalabas sya magbayad sa nag assume. Ano pwede gawin para mabayaran yung balance ni buyer kay seller?

    Magandang araw atty. new subscriber po ako....puede po ba makuha ang share ng lupa ng bayaw ko na may portion na beninta sa akin at sinanla naman sa iba at sanla benta daw...at ang pinag sanlaan at benenta sa iba...sabi ng naka bili completo daw sila sa papel pero ayaw naman nila ipakita...sa ngayon po patay na yung bayaw ko at kapatid ko at mga anak nalang nila na pamangkin ko ang puede mag claim...paano po ba ang gagawin namin kasi mayron pang portion ang mga pamankin ko na pag kakaalam nila dipa na benta...pero sabi ng nakabili...nabili nadaw nila lahat....Salamat po ng marami...

      Hello Attorney,
      My Grandpa owned a certain property for more than 100 years. The property was not transferred to his children and no title was issued to date. I've learned last year that the property is classified as Timberland for the preservation of Forestation. The only document on hand is the "Tax Declaration of Real Property" still under his name. Do you think I should pay the delinquent taxes and continue paying the RET until a prospective buyer decides to buy the property? Or is there a chance to transfer the Declaration of RET to my name as a legal heir?

      Thank you for your prompt reply. So they just send notice of rescission to the buyers for the illegal sale citing the transaction as void for being illegal? Wouldnt this be admitting to an illegal act committed being the one who offered and sold the lots and cause seller more harm? Also sellers recourse for buyers who would refuse and already in possession.

    Paano po kung walang notice naa ibibenta niya ang share niya? Nalaman na lang po kasi namin na nabenta na sa iba o stranger? Valid po ba ang deed of sale pero po nalaman namin na buo pa po itong lupa ng lolo at lola ko? Inalam po ni mama sa bureau of lands.

      good day Atty, Ano po ang mahalaga at tamang nagmamay-ari? Yong nasa cadastral map o ung taong nakapangalan sa taxc nang matagal na, siya nagbabayad ng buwis gang siya ay buhay pa? Nabili ko ng 26yrs ago na in good faith and may deed of sale na pirmado ng nagbenta at mga anak, notaryado ng atty, nagka taxdec na rin ako at nagbabayad ng buwis in 26 yrs na nakapangalan sa akin...Bigla pong may dumating na mga tao at sila daw ang tunay na may-ari nang patay na ang ming binilhan, at di raw nila kilala kahit magka apelyido ung nasa cadastral at nasa taxdec. Nagparelocate sila at nagpabakod nang hindi namin alam. Ayaw po silang pumayag na ibigay ang portion sa amin kahit pa ako'y may mga dokumento. Nanggulo na po sila at nangharas, nagpabakod akong di natuloy dahil s panggugulo nila at pagbabanta..Umalis ang mga tao kong nagbabakod. Sila naman ay nagpabakod, na nang tumawag ako ng tulomg sa brgy at pulis para maipatigil ang pagbabakod nila sa aking lupa na may usapin pa nga sa brgy at pinagtatalunan, wala naman tumulong s akin.Natapos ang kanilang pagbabakod. May laban pa po ba ako? Nakapagtanim na po kami ng mga punong rambutan at mahogany noong nabili na ang lupa.Napabakuran na rin namin un ng paulit ulit pero sinisira at nasisira dahil bangyasan lang at burved wire naman.     Hello atty. affected ng airport expansion ang property ko. titled property, may beach house ako na nakatayo sa lupa, at ako ang nagbabayad ng buwis yearly.pero hindi ko po napa transfer yung title sa pangalan ko. 3rd owner of the property na po ako, Unfortunately, hindi ko po kilala yung mga pangalan ng nasa title. kasi nabili ko lang po eto sa 2nd owner which hindi rin po nya napa transfer sa pangalan nya. Deed of absolute sale po ang documents on hand ko.hinihingan ako ni LGU ng mga documents pertaining to the original owners ng title. however, wala na po akong contact sa nagbenta sakin. Another problem atty, kasi yung nagbenta sa 2nd owner is yung anak at tatay(widow) lang through deed of sale., ang title kasi nakapangalan sa anak at nanay married to tatay. and wala po akong mga documents na hawak. Anu po ang magandang gawin ko atty para mabenta ko po yung lupa sa LGU at mapatransfer po nila yung title sa government. Thank you atty.
