    what happens when the spouse dies in these marriage regimes?

      Nolwazi Makibelo ... one will first have to determine the deceased’s spouses estate value. Assuming there is no will, If deceased was married in community, then wife first gets half of joint estate, then deceased’s half gets distributed amongst the descendants. If married out, then you determine the deceased’s estate value and distribute straight after settling liabilities, if married out with accrual, same applies after working out estate value as explained in my video. So with out of community, the living spouse does not have a claim to the deceased’s estate in terms of matrimonial law, but they do in terms of intestate succession (where there is no will). Whereas in community, the living spouse first gets half of the deceased’s estate value before intestate succession kicks in.

    With regards to inheritances under out of community with accrual, does the exclusion apply only to the inheritance itself or does it extend to growth within that inheritance? Example if I inherit R1000 000 which I invest and at the time of divorce it's grown to R2million. Is the whole R2million excluded or just the original R1 million that was inherited? 🙈 Said a mouth full there hope it makes sense

      Hey Mbali. inheritances are automatically excluded, so any inheritance obtained during a marriage is automatically excluded from the accrual system. Inheritance obtained before the marriage should be recorded in the ANC and the growth thereto will be excluded 🌸

      Even with in community of property, an inheritance is excluded when dividing the estate ✨
