    Is there a waiting period of non payment before you recieve payment when terminally ill a d have submitted a terminal illness form and medical report

    If you receive regular EI payment (within 2yrs) I would think it wouldn't be right to put the onset date for your claim before the last EI payment as EI payments are on condition of, ''were you ABLE, willing and available for work.'' By saying ''yes'' to that question I was saying I was well enough to work and receive EI benefits. I was ''terminated without cause'' so I received 10yr severance pay and then EI payments. I had a workplace accident 20 months earlier where I was denied any long term payment and sent back to work within months. The work injury exacerbate my pre existing health condition to worsen that were stable for 10yrs. Yet, were IMO used to deny me any long term WC claim. Also, Imo, added a new condition but no dr will dx me with. I never returned to my pre injury health. Even tho WC said I had. This last yr my health has worsen. I just turned 64 yrs .       The Minimum qualifying period is the 4 of 6 years where you have enough contributions made to the CPP to qualify for disability

      There are two provisions- the child rearing provision and the late application provision, that can extend that minimum qualifying period.

    Hello David,
    I have a question about the onset date and child rearing provision. I was working till 2010, and then mostly stayed home with the kids. My kids were born in 2010 and 2013, so I am applying for child rearing provision from 2010 to 2020. My symptoms are chronic and last for a long time (back pain, depression, and others) but became much worse around 2019. My question is if I put my onset date 2019 or 2020 would it fall within my qualifying period because of child rearing provision? And what would be my last day of work?

    Hello I retired in January 2018 and did intend to get another job but in March of 2019 I was diagnosed with colon cancer. I had surgery in may and a month after surgery started chemo, after chemo I was unable to walk or stand well because of lose of feeling in both feet and hands. About a month ago I applied for CPP disability. What is the date I should have applied for?

      We can't give specific advice online. You should choose the date when you illness or disability got to the point where you could no longer work on a regular basis in any gainful occupation

    Hey David.
    I've had Fibromyalgia since 1982 a sever auto accident caused the onset of a life altering condition. I have 30 or 40 medical reports documenting my illness. I'm almost 60 but have been I'll since I was 20 yrs old in 1982. As time progressed my illness got worse to the point I am unable to work. I've been self employed since the year 2000. If I file for disability do you suggest the onset date to be 1982? I have not ever asked the govt for help and I have not worked since 2015 living off my own money. Now I have Major Depressive Disorder, nonrestorative sleep and widespread chronic musculoskeletal pain and chronic fatigue Syndrome which is actually called myalgic encephalomyelitis according to the CDC. I also have other Fibromyalgia symptons but too many to list. I've been studying FM for 39 years since the onset of my symptoms.
    Without a legal opinion should I use the date of the accident and as the onset date. My pain began about 3 to 4 months after the duel side impact to my drivers side door by a very large vehicle. I was cut out of the vehicle by the fire dept who used the Jaws of Life to free me from the crushed car. I am very lucky that I survived. I had my own business at that time but as the pain got worse I had to close it down and taken up a office job. By the year 2000 I opened my own office type business but still suffered tremendously going from dr to dr trying to get help from the sever chronic pain . Finally in 2015 I became suicidal from the debilitating pain and constant suffering. I was letting my clients down and I decided it was in the best interest to stop and close up shop. I know a great deal of time has passed and I never asked for the Govt of Canada to help me but now I'm in need of help. If anyone never looked for a hand out it was me. I lost my entire family by the time I was 20 years old and I never had parents or siblings or anyone help me through life as young as I was with a debilitating condition that slowly took over any quality of life.
    I may go this alone with CPP but I may very well retain your firm at the end of the day.
    If I attempt to go it alone what are your thoughts on the date of onset which is well documented but the many many medical reports I still have.
    Your channel is likely the best there is for Canadians to clearly understand most every aspect of how to properly file a successful claim. I've watched every video you have made and I have recommended your firm to several friends.
    Even if you cannot help answer my question I'd like to take this opportunity to say thank you for helping me learn so much about the legislation and laws behind the Canada Disability Pension. I'm sure I speak for other who you have helped as well.

      Thank you for you kind words and sharing your story. This is a very good question. The onset date should always be the day when you first became disabled, as defined by CPP disability. In other words, the first day when you no longer that the ability to work enough to earn $15000 or more per year. This doesn't always line up with the date of an event like a car accident, if you were able to return to the workforce and earn $15000 or more per year after that accident, even if it was a few years after that accident. I would recommend you get a copy of your statement of contributions to the CPP and then contact us for a free consultation. You can get your statement of contributions through online via the My Service Canada Portal or you can call Service Canada and they will mail it to you.
