    This is how many dictatorships form, when human beings and members of the public don't assert their legal rights, even people who have researched the Legislation like Marti, will still bow down to social pressure by men in uniforms like these guys. It is little concessions like this that can form peoples rights being eroded over time. We have had dictatorships in Europe in recent history and even today, like in the 80s like General Salazar in Portugal, and we even have tyrants like Vladimir Putin right now, people should never bow down to men in uniform if they believe they are acting lawfully. Good on Marti Blagborough for asserting his rights in a public place.

    There are no signs to ascertain that this is inside the court, the guy is making it up as he goes along, to assert his dominance, as Live Free points out to him. This reminds me of Animal Farm by George Orwell, where 2+2=5, or in this case ''Filming outside the court is the equivalent of filming inside the court, even though they are outside the court''.

    As a guard from a Court they are drastically confusing two different things these guards you're welcome to film outside a court all day and night hell if it was at my court I'd come out to have my picture took with Marti keep up the good work videos entertaining as always

      @UCwd8pSqb7Y1j0AOaOaKThaA as guard at a court the law is inside the court so soon as you enter the building you can't film and it is a criminal offence but outside the court building no offence is being commited, the guards are getting confused as court guards powers of removal etc etc extend outside of the court building covering all of courts property, car park etc but filming is only illegal inside the actual court building

    Pretty sure the courts act 2003 says nothing about "filming" in court.
    It only mentions photography, portraits, or sketches.
    *Doesn't say anything about video or audio recordings.*
    Criminal Justice Act 1925 ...i believe.

    A friend of mine has been stopped 9 times in the last 2 months I've told him to record every time they stop him. I've also told him not to consent to stop and search
    The last time he was sitting in his car eating lunch when I came up to his window and started harassing him I've told him also it's getting yourself a good lawyer and video every single interaction. I think it's taking the piss

    If you're correct about being able to film outside there (or wherever else you are), what's the need for the insults? You're only making yourselves look bad. Educate yourself on what laws enable you to be there so when they tell you to move, you can inform them of your rights to be there. They can't argue with facts.

      @@MartiBlagborough I've just found out about the Criminal Justice Act 1925 and it seems clear from that, that photograpy/recording is not allowed in anywhere in the court or court property.
      It also says in the court precinct (exactly how far that extends, who knows?)
      I think it something you should look into because that law gives quite a bit of power/danger to a potential "tyrant".

    I've gone over the video a number of times and there is one important piece of evidence regarding being in a public place. On the door to the right of the entrance there is a £75 penalty notice. My stop frame is not good enough for any further definition of the sign, however, this notice clearly creates a public area and so any member of the public has the right to enjoy that public area for the purpose of accessing, reading, and acknowledging the content of the notice. You were most assuredly were in a publicly accessable area. Those officials in embroidered stuffed shirts were completely incorrect in their assumption of control of the area. You had every right to be there!
    I'm sure you will be going back!!!!!!!

      @@stevetrueffo3907 Well, the majority of the 1925 act was repealed and the section you refer to was against "photography" which threw up a problem as video hadn't been invented and this created a grey area. In September 2011 Lord Chancellor Kenneth Clarke announced the Government's intention to partially repeal the section covering courts commenting on the need for more transparency.
      The wording you refer to is as follows -
      "of any person, being a judge of the court or a juror or a witness in or a party to any proceedings before the court, whether civil or criminal;"
      So you see, you have always been able to photograph any body or any thing else in the building or it's precinct.
      There is no mention of other such photography being prohibited, except for commercial purposes and we then get into another area altogether.

      @@grouchomarx5649 Well, you are right, the 1925 Act is mostly repealed. However, Section 41 (concerning photography,) isn't repealed.
      You say "you have always been able to photograph anybody or anything in the building or precinct". Yes, that's true except for "Judge of the Court, or a Juror or a witness in or A PARTY TO ANY PROCEDURES BEFORE THE COURT".
      I think it's highly likely that a majority of people entering the courthouse or waiting around in public areas would fit the above category.
      In practical terms you would probably, technically, albeit unknowingly, break this law within minutes of entering and videoing your surroundings.
      If a security type thinks you've captured an image of, say, a court officer and calls the police you can get arrested.
      I think the charge could even be contempt of court. As I say, if it was the bbc, security wouldn't give two hoots, but auditors aren't likely to get MSM privilege. That's why auditors need to be aware of this vulnerability/loophole.
      Re: the grey area of photographs v video's I'm fairly sure I've seen cases where the defense was "I wasn't taking photographs I was videoing" and the outcome was videos are just a (fast) series of photographs. I can't for the life of me remember where I read/saw that info. (I'm going to have a little delve into finding out later)

      In all reality they're is no such thing as a "photograph" anymore. Any "recording" process is a capture of data and stored in one's and zeroes, interpolated and reengineered by software algorithms and then stored on digital media.
      If a photograph still exists, it is the end result of reverse engineering of the data and a final print out, however there is very little hard copy produced these days.
      I'm sure it's why the gray area has shifted over time and probably what has brought about rethinks of what constitutes legal data capture activity.
      My take is that if you are standing in a publicly accessible area then whatever data can be perceived by the eye, can be recorded for future analysis by whatever means you have available.
      But that's only my take!
