    What does it cost to retain an attorney from the HELP law firm? Most people on disability and retired senior citizens don't have the money to retain attorneys. That's why they end up broke and homeless.

    How about simply setting up a Trust or a LLC and opening the bank account in the name of the Trust or LLC? It is very hard for a debt collector to grab a bank account they (a) cannot find and (b) is not in the name of the debtor.

    what if the banks are not following the law? and are ALLOWING THE garnishing the social security anyway!

      The banks do follow the law. I should know I deal with this every day. Rarely a Credit Union will make a mistake which we can correct. But it is not a problem. Eric HELPS

    I had a substantial amount of money in my credit union,My SSI is in my main bank,not my Credit Union.I put the credit union money on a cashiers check from them which I know is untouchable.If I had not put mt credit union money on a cashiers check,could the Discover Card Collection attny`s have found that money?

      Judgment creditors have no reliable source by which they can find out where a person banks. Over time if a person has a bank account then there may be records that let a judgment creditor know that it is likely where a person banks. Eric HELPS

    Can credit card companies sue for property? We live on Social Security but have a paid for family owed farm land. Will they sue us for the land to satisfy the debt?

    • @HELPSNonprofitLawFirm
      @HELPSNonprofitLawFirm  2 ปีที่แล้ว +1

      Your property should not be at risk for a credit card debt even if sued. Here is a video from HELPS discussing this issue: th-cam.com/video/c8KORUeOSDU/w-d-xo.html You may want to call HELPS to go over your options. I am sure you will be fine. Eric HELPS 855 435 7787

I’m on Social Security I get $900 a month I just got papers that are for garnishment summons , non-earnings disclosure and exemptions notices .it Doesn’t have any signatures anywhere. It looks like tenth judicial District . Can you go onto my account I don’t have any money in there but they said they can take up to $10 I don’t understand. I would so appreciate it if you could give me some advice please thank you

    If he is sitting on 40K why not just pay the debts?

    • @HELPSNonprofitLawFirm
      @HELPSNonprofitLawFirm  2 ปีที่แล้ว +11

      He could do that. However his income otherwise was minimal. This was in many ways his nest egg needed to supplement their minimal income.

    If 2 people have a joint bank account and 1 is getting sued and removes himself from that account before a judgment, can the creditors still go after the person who is not being sued?

    I do have a judgement from a credit union. Can will they garnish my bank account? It do not say so on the letter.

    • @HELPSNonprofitLawFirm
      @HELPSNonprofitLawFirm  ปีที่แล้ว +2

      They can however as the video explains twice the amount of monthly Social Security you get is protected from garnishment regardless of the actual source of funds in the account. Listen to the video again it explains this. Eric HELPS

    So quick question .What if the 40,000 was saved from SSDI.The reason I ask is my final payment on my home will be 8,000.They say it has to come directly from my bank by wire,so Iam not sure how to handle that.

    My understanding is if you live in a community property state like California, even tho a judgement is against one spouse that the creditor can garnish the wages or levy the other spouse bank account even if it’s only in one persons name. Is that true?

    • @HELPSNonprofitLawFirm
      @HELPSNonprofitLawFirm  2 ปีที่แล้ว +2

      No, the judgment would have to be against the other spouse as well for a wage garnishment or bank levy to occur. Additionally it is not the practice of credit card companies to sue spouses not signers on a credit card in community property states. Eric HELPS
