- The plaintiff claims that his landlord never paid the bills on time, and he went without heat, electricity, cable, and internet on numerous occasions, so he moved out. Now he’s being hassled out of a security deposit and suing for the money he’s owed. The defendant argues that the plaintiff is a gross exaggerator. Plus, the plaintiff stole his surfboard as ransom and is responsible for damages. The defendant is countersuing for travel costs and missed work.

Any Landlord agreement was voided when there wasnt any power!
That only applies when the tenant has allowed a reasonable amount of time for the landlord to fix the issue and they've moved out shortly after moving in. This guy stayed there for 6 months. If he was smart, he would have paid reduced rent for the following month or sued for the rent that was paid for days he had no power.

@@stephaniehowe0973 I know. What I'm saying is, he had every right to break his lease and leave without notice during that time. He also could've subtracted 5 days worth of rent from the following months payment. He didn't do either of those things.

Facts! I was like this man brought all the defendants property to court just to taunt him. Lol. That's a good surf board too. Although illegal I understand why the plaintiff took it. Whatever potted plant he was trying to get back was not over 150 each bucks at no damn home goods 😄😄

He's lucky the defendant didn't call the cops and press charges for theft. It was a gamble that he could have lost more than the deposit money.
He would have lost the case without the board. The landlord would have claimed the toilet and plumbing was damaged, baseboards, etc. he was very smart for taking the board.
New Jersey law is double the amount without cause or conflict being used against the witheld of deposit.

I’m not saying I agree with everything Harvey says but yes, calling her out by name & where she lives was very uncalled for & could be dangerous for her in the future. There are sick people out there & you don’t know what they will do with that information.

I would’ve had an inkling that I wasn’t going to get my security deposit back the day the electric was turned off and I found out there was $1000 outstanding bill. Men this age that call me “bro” crack me up. They sound like teenagers 🤣😂😅

The show pays the judgement so no money is coming outta the defendants pocket.
The show pays a fee for the litigants' appearance. Depending on the judgement, whoever loses (if money is awarded) pays the difference in the balance from their own appearance fee towards the judgement.
This landlord never picked up the phone but when his surfboard went missing he called him real quick! I probably would have done the same thing. Idc if it’s illegal. The plaintiff should have been playing dumb the whole time like it was accidentally stolen when movers 😉 grabbed it. Let’s meet up and do a walk thru. And when he said oh I don’t have the cash. Surprised the defendant didn’t just call and report the surfboard theft to the police after the plaintiff admitted to having it, or when the two met up in person. It was clearly stolen property and good chance the police would’ve recovered and returned it.
I don't know. In my city, the police don't show up for anything short of aggravated assault or gun related incidents.

@@nunyabiznes3901 the deposit is in dispute b/c the tenant gave it to the landlord, who has to give it back minus damages. The surfboard is not in dispute b/c the landlord never gave it to the tenant so the surfboard is clearly stolen property. The cop would be within his authority in retrieving and returning the surfboard, whereas he has no authority over a deposit in dispute - that would be up to a court to determine.
@@RumbleRish exactly, people act like it (the security deposit) is automatically stolen. I know of a landlord whose tenants called the police on him for stealing his money, when they came and he explained I am a landlord and the law says I have 30 days to return it to him after he moves out or explain why I am not, the first cop wanted the landlord to hand over the cash now, the supervisor then was called and said yeah we don't get into that sort of discussion. that is not within our power to do so.
It takes a judge to determine what the proper damages are and how much is warranted to withhold.
