Sir my wife filled mutual divorce case u/s 13 b and 125 crpc but she filled the date of marriage different in both cases in one place she said in her affidavit that dom is 28 th nov 2013 and in another affidavit she said her dom is 14th aug 2016. Can l file 340 crpc now

It is normally seen that the wife files applications under DV alongwith affidavit supporting her claim to seek interim maintenance, without seeking orders for filing Affidavits simultaneously by the respondent husband,as is the direction under Rajesh vs Neha judgement.
And, the court often passes orders to grant interim orders to pay interim maintenance to the respondent without hearing him.
This is bad and is clearly favouring the applicant..
Is this act of applicant not itself false by law.. And does this not warrant action under 340 crpc.?

there are judgements of allahabad high court and bombay high court which says that if a 340 crpc application is filed in a matter, it should be processed first (before the underlying application).
