Sec 28 is limited to contract and nothing to do with crime so crime example doesn't suits here.see the wording of section enforcing rights acquired under contract

You can file a writ petition in SC u/a 32 of constitution in such matter
The place of agreement is important for choosing an ordinary tribunals for adjudication incase of any dispute arises in the future right?
The case may be referred to any one of the several competent courts
I think you were wrong between 4:00 to 5:00 i.e. arbitration is valid contract and not void .

An arbitration award can be challenged or set aside only on certain grounds.
