Weighing in on court ruling on sharing of property after divorce

In a unanimous judgement, a panel of three justices of the Court of Appeal on Tuesday made a landmark ruling with far-reaching consequences on how matrimonial property will be shared after the conclusion of a divorce. It ruled that a spouse does not automatically get 50% of the matrimonial property after divorce. The court's ruling in the case between Joseph Ambayo Waigo and Jackeline Aserua has raised questions about how matrimonial property should be split. A poor man should not marry, period. A man needs resources (money, land, animals, crops, etc) to take care of his wife and children. Any man who lacks that capacity should stay single, work hard to acquire the resources then marry.

I think a marriage should function as a Unit.
This judgement takes away that. This is a judgement based on commerce rather than family; think of the children’s position if they are part of the dissolved union.
