    Instead of strikes TH-cam should simply remove it and not issue strike, and give the revenue to the owner if it was monetized. Creators have worked their part as well right...

    I downloaded TH-cam's free music from TH-cam's Audio Library, and used it in my TH-cam video as background music. And an alleged copyright owner of the music, who apparently is not the rightful owner of the music but happened to use the same free music in their poem as background music, placed a Content ID claim on my TH-cam video. So I disputed the Content ID, but the alleged owner rejected my dispute.
    Now I'm faced with either having to accept the Content ID claim as is or appeal the dispute, which will lead to a copyright strike on my channel if the alleged owner doesn't accept the appeal. I'm really disappointed TH-cam wouldn't even look into the matter in the dispute or appeal process at all. So I end up being punished for using what TH-cam told me to do (to use TH-cam's free music).
    How stupid is that?

    Your system still needs a lot of work. I had a video that was claimed for music when I uploaded it, and it stayed that way for 3 years. Then out of nowhere I got a strike for it. I would have willingly taken it down if the copyright holder had just informed me of the change. How about some kind of statute of limitations? If a video hasn't been taken down within a month of being uploaded (since most claims are instantaneous anyway), you get 48 hours notice to voluntarily remove the video before being given a strike? Or you can appeal and put that 48 hour time limit on hold until it's resolved?

    • @pokedude900
      @pokedude900 5 ปีที่แล้ว

      @@FightMusic Yeah. I did nothing because it was a valid claim. It was a dance sequence from an anime game, claimed by the owners of the music track. The video was allowed to exist without issue for a few years, then it turned into a strike out of the blue. I couldn't dispute it because it wasn't my music, and I couldn't request that the owners remove the strike because they're a Japanese music company who doesn't care about a random American TH-camr.

      Copyright owners can decide whether or not they want to authorize use of their work. They can change their policies and issue copyright takedown notices at any time, under certain circumstances. Your video's status could change in the future (and may even be removed from TH-cam) if the copyright owner makes a different decision in your individual case or changes the policy that applies to the music in your video. That's up to the owner of the content, not TH-cam. You can avoid this by properly licensing any third party content you include in your videos.

    • @deep46blue-Manos-
      @deep46blue-Manos- 5 ปีที่แล้ว +2

      @@TH-camViewers Well.. but I think in case that owners change their policies it would be more fair to inform the uploader about this change and to give 24 hours notice to remove the video himself without a strike. Maybe this (24 hours notice) would be the ideal solution in any case of copyright issue, to avoid terminations of channels which is to my opinion a very hard action against simple uploaders who dont earn money from this. But in case a channel earns money from uploads that are not free from copyrights, then ok I agree to receive a strike having as limit the number of three that will terminate the channel, as exist. Just a suggestion :)

    the basic explanation of the Content ID system, is great at the 5,000 ft level...but it doesn't work properly for all cases and the solution to the problem is easy. I have tried to communicate this to TH-cam, I have gone to my MCN and they have communicated it to TH-cam, but it falls on deaf ears. I really hope you all figure it out so it works for everyone, not just the people making the claims. You need to learn how to implement a shared revenue model, for instances where a 30 sec audio claim doesn't demonetize an hour long video.

    I think we should be allowed to have content in our videos that contain music in the background. We have no control over this and I have had to put free music over valuable content because there was a song in the background. You Tube should be able to determine this when a dispute is raised but they have failed to do so.

The companies does not need to worry! Stop censoring us for that, you are going to be replaced by another platform if you keep this politically correct censoring up just because companies are scared of being on videos with "bad content".

    What happens if I lose a dispute?
    On September 6th, I notified Team TH-cam via twitter what I believe is someone abusing the Content Id Tool.
    -- I don't paste the URL to my tweet because I don't want this message to be marked as spam :) but let me know if you want the link
    I got a Content Id Tool match but the alleged artist/song DOESN'T match the song I use in my video. I spoke with the artist who created the song and he will not challenge the network that claimed his song as theirs and get a load of this, even the song from this artist, in his own channel is being claimed by the network due to the alleged Content Id Tool abuse.
    I want to dispute but I'm afraid of ill consequences if I lose. I know I can change that part of my video using YTA Editor but there is a reason why I choose that particular song (besides being CC)
    TH-cam Creators, please advise!!! (and take a closer look to this issue, please!!!)

  • @LiftPizzas

    You also allow people to use the Content ID system to make claims on things they do not own. Such as covers. When you record a cover of a song (or public domain music) you only own that recording of it. You do not gain rights over all future recordings of it. How this obvious fact could escape youtube's legal department is beyond me.

  • @For91Days
    @For91Days 5 ปีที่แล้ว +25

    Here is the thing with content ID - it's useless. If I get a notification that someone else used parts of my content I now ALWAYS just file a take down. I used to choose monetization when there was a match but video farmers realized that it's just better to take down the video entirely, re-edit the video in question to take out my footage and to re-upload it to youtube. This way they don't have to share any revenue. On top of it they (and TH-cam) get to keep the revenue of previous views (before Content ID found that match). This leads me to think that TH-cam is playing into wanting video famers! TH-cam makes tons of money off these compilation videos and they have zero interest for them to go way. Which means medium sized content creators like us are always getting screwed. How can we compete with link farmers taking bits and pieces of only the best moments of someone else's video, compiling them into these super fun, long videos, generating millions of views. Plus, everyone knows that that channel most likely didn't film any of it themselves. But TH-cam just sits back, allowing this to happen because they like their profit share of these videos, while the original content creators get screwed. TH-cam, pay back these profits when profits are being generated off content from stolen work and make video farmers pay back their profits as well. Video farms are the death of small and medium content creators. It will make us stop creating new videos - and then these link farmers have to recycle old content over and over again or pick up a camera to record themselves. So TH-cam and TH-cam Creators what are you doing again against video farmers? If I would have received my fair share of people using our videos I would not need to constantly struggle.

    I just don't understand this TH-cam policy. If authors of some original stuff (music or movie scenes) claim the copyright of a video editing, ok fine, let them get the benefits of advertising. But why does this affect the whole channel, even other videos that don't infringe copyright?

      @@mattwo7 some channels do make money and most of them the smaller channels barely get anything or they don't get paid out. I had a partner channel that had millions of views and YT alwasy made some excuses not to pay me out. My algorithm was all over the place and they always kept me at the 50$ cap. When I went over it they took down few of my popular videos due to a copyright strike or other false flag and lost all revenue. I got back those videos but they were all reseted so no revenue on them. By the contract you are also not allowed to talk to anyone how much you make on YT. That is another sketchy thing. At the end I lost partnership stating how I don't perform well. I did but with their constant false flagging me I lost boost. I am not only one who got abused like htis and you can't really put this into the court since they will pull the fake low performance revenue algorithm and win against me. Most the money goes to YT and what the creators get are pennies. I quit YT after that for a year or two and came back just as a viewer now. I hear still this happening to smaller channels even today so I don't consider being a partner anymore like ever. You waste time doing videos and they will just leech you. I also need to pay for advertising my channel I will never make that money back. What is the point. This place is a joke.

All the alternatives wind up failing in one way or another but I'm not going to stop making videos. Course for me it was always little more than hobby. Most channels who are doing more than that have alternate sources of income like patreon and merch. Frankly putting all your eggs into one basket like that when you're not even employed but a contractor with no say over the terms of the contract is kind of dumb honestly. I learned that sort of thing the hard way with Zippcast, lots of videos are gone forever, now I back them up on Internet Archive and while I have no faith in Bitchute, the automatic mirroring is at least handy, I can avoid using the site outright while having another backup lol.

      Good luck getting an answer from anyone but TH-cam. They don't talk to people. I would suggest that if a video is found by Content ID system you are safe, at least safer than you are for those that are not claimed. I have over 2500 videos of me singing and strumming a guitar on TH-cam. I have had 3 copyright strikes, the last of which happened a week ago for Tequila Sunrise. I'd had a version of that song on TH-cam for almost 10 years but they took down and issued a strike for a newer improved version. I live in fear that some publisher is going to go nuts and begin taking down multiple songs. In that case, my channel goes away. TH-cam takes the easy way out and while denying that their platform would be greatly diminished if every copyrighted cover was taken down, they blithely spew that we just shouldn't perform songs we don't own. Pathetic.

    First off, I agree with the copyright laws. The makers of music worked hard to compose and present their work and should be rewarded. The use of their music should be like AMAZON download, in that the owner gets a fixed amount of money (say, $1) and ad money. How can we be expected to contact every record label for permission? Also I am sure that the response time would be months, if any response came from them at all. Besides, the use of the music is free advertising for the recording company and artist. I have several times heard music on YT and then went to AMAZON to pay for a download.
    The policy for copyright claims at the present time on YT is flawed. I made video of a wedding reception. Video is not monetized and only for personal use and to share with the wedding guests. The DJ comes on and the dancing starts and I video the dancers. Of course, the DJ music is captured. I did not put the music in myself. So I got dinged on the upload as a copyright issue. I did not use or place the music. Why not go after the DJ, who I am sure did not write letters to the 50 or so music companies whose music was played. I redid the video and put in some free digitized instrumental music that does not match the dance moves. So the video is pitiful to watch.
    Next situation...Las Vegas....Bellagio fountains at night....the water show comes on and the entire crowd is filming it. I post 2 minutes of the show on YT and get a copyright warning because the music in the background during the water show is unavoidably recorded. With out the music the video would be a "silent movie," taking us back to 1925. Bellagio encourages people to watch and take videos of the water show. There are many videos of the water show on YT with the music intact. But I got hit with the copyright warning. So is the take away point that if you make any video that has obligatory music as part of the performance, even though the performance was free to video, than you will get a warning from YT and a possible strike?
    So I suppose that when filming at a private party you have to post the video without the sound of the DJ's music.
    SOLUTION: PAY TO PLAY!

    It would be helpful to have a system that allows TH-camrs to contact TH-cam. I know a lot of small creators that have to wait months just to receive a message over Twitter (or similar) about their problems. It isn't fair to allow creators to continue to have their videos claimed by 'false copyright claims' or the fact that using 3 seconds of footage of a video can end up in the claimer earning the revenue of the entire video. The rules should be clearer and more concise in order for creators to know what they can and cannot do. With TH-cam changing its rules so often it is difficult to tell what still applies, what has replaced it and what is new. At this rate, you are going to have a lot of angry creators and a lot of small creators that are unable to further their channels. Not to mention all of the people that want to become creators. TH-cam will be left behind when the next big platform comes if it doesn't start caring about its creators over the companies that sponsor them.

    I had a content ID claim on a few bars of a Welsh Hymn sung live by a male voice choir. The claim was for a song in English, but the one in the video was in Welsh, so I'm not sure that they were really entited to grab as high a percentage of revenue as they were since it was only the melody that was valid and not the lyrics. I believe the lyrics were traditional, and presumably copyright free. I don't get many views on my channel typically, so I didn't bother to chase it up.

    TH-cam's copyright rules and automation are an absolute joke. I received another email this morning for a video that wasn't actually guilty (not on this account, on purpose because I don't trust YT). Even clicking the "View Claim" link led to a dead-end (and the video still remains). So we didn't actually have anything removed, we were just told something was, and we assume afterwards it was deemed to be a fake claim, and that was that. This is still something that gets tossed on the pile of reasons TH-cam can't be trusted with our content. So, don't be surprised when it suddenly goes "poof". Maybe some day, this will have gone on so long, that things have to change, but I doubt it.
