    90% of workers comp is setup for the employee to not get no money, they giving yu 2/3 of yur money and at the settlement they take the money back

    I’m on comp due to2 work related shooting incidents. (Bus was shot at twice) I’m a transit driver in upstate ny. I did not get shot but I have PTSD from the shooting and I’m having a lot of psychological trauma from the 2 incidents they happened back to back. My doctors have me out and no set day to return due to the issues I’m having. Any advice?

    I I never lost time from work but I suffered from hearing loss while I was at work and I work in a call center and I was having problems understanding what people were saying and I used to work in a large bullpen with a lot of background noise in the office. I was just prescribed hearing aids which made a big difference so I can now understand what people are saying and I'm not having as much problems. I have filed a workers comp claim but I have never lost time from work.

    I had hip surgery due to a fall ( 4 months prior I was misdiagnosed they didn’t find out I had a fracture for 4 months so walked with a limp snd weak my right leg that had surgery. My job is physically demanding, I have multiply intern about going back to soon as the implant can move or dislocate. My back bothers me after standing for an hour my hip is fatigued. I run a kitchen so lots of bending and lifting, I want 5/6 months to completely heel, I felt strongly if I return to work I’ll have issues and end end leaving the job

    Rotator cuff injury at work, and bicep injury, tendon injury from rotator cuff and bicep . 3 surgeries, reached Mmi. Have 40 loss on rotator and 25 loss on elbow. Out of work still , been 28 months. Doctor says not going back to work. I’m waiting on award amount now

      What state are you in? I’m in this EXACT same situation and don’t know what to do, just got evaluated at 2% impairment & MMI even though I’m still in pain.

    They suspended my benefits for an unknown reason. My attorny said that they didnt see anything in my files. I have keeping up with all appointments since my injury started. I have to continue to work but should I find a job with lower pay? And if so will my workers comp case be affectes as well as my S.s.I. or s.s.d. case be affected?

    I'm on comp. I had injuries to right ankle right knee right lower back right hip bone wash chipped and right neck injuries 2024. I'm taking pain management now but the insurance company suspended my pay after 7 weeks. I have bills wife and children. At the moment, I'm out on 100% disability and I want to know could it be hurtful to my case to seek employment from a lower paying job?

      I’m sorry to hear about your situation, but there are some questions I have and some issues that we need to reconcile here. First is this a New York State claim? Second you indicate that you are 100% disabled but you’re contemplating returning to work. If you’re able to return to work in any capacity at any job in New York State, then by definition you must not be totally disabled. I think your best plan of action would be to speak to your doctor and your lawyer about your current situation and seek at their recommendations with respect to your benefits and your ability to return to work, good luck.

    Hi Rex,
    Does this apply to PPD as well? My case is not yet settled. It has been determined that I have PPD. I injured neck, back and arm in 2021. Injury resulted in 2 surgeries, however, I was told by the doctors office that I would not receive PPD if I returned to work. Here in NY

      Generally speaking, this does not apply to PPD cases. It only applies if you return to work at light duty as a result of your injuries. If you suffer from neck or back injuries or any non-schedule type of injury and you return to work at your pre-accident wages (or more) it is unlikely that you won’t receive monetary awards for your disability. If you do have a schedule loss to your arm, you might be entitled to money for that.

    I’m on comp my foot got smashed by a forklift and from my knee down is numb I have 2 fractures and been out of almost a year now question is that good or bad

    I have been on Workmans Comp and off work for 2yrs at end of this month had cervical spine fusion surgery C-5, C-6, C-7 also Rotator cuff surgery and re entry in same shoulder. My pain is more and motion is not all the way yet have my 2nd QME coming up all Doctors are saying that perhaps it's time to think of a new career I'm about to be 50 and been doing warehouse work for 25 yrs + what should I do or expect to come? Thank you

    If i go back to work only part time i usually work 7 days a week in the summer as a uber driver will workmans comp still pay for my drs and pt etc i need the money ..i cant survive on the money comp pays me. i need the drs more than the money from comp

      knee shoulder and neck/back might back fusion surgery the mri shows i have spinal cord injury myelomalacia c-5 c-6 had prior knee surgery but now my knee is worse after this accident was hit by a drunk driver head on .otho will try gell shots but i will need a knee replacement

      Assuming your case is in NY, then yes, you are still covered medically regardless of your work status. Please make sure you let your lawyer and the insurance company know when you do return to work and in what capacity so they can modify your awards properly you do not want to mess with a potential fraud allegation.

      Thank you so much for your information The black car is very very interesting because they are supposed to be our allies, but they're also in bed with New York state's workman compensation so they are considered my insurance company. Seems like they double dip. Well that's a whole different thing. Yes I will will definitely do that. I'm not sure how much I can work. Being your Uber driver is totally different than it being a W-2 driver because one year I'll schedule c might be good. The next year might not be good. It's all about all about the different miles they give us each year etc. Etc. All you could do is try your best and thank you for your help. You're a blessing

    After you filed out the form C-4.3 from the doctor how long it take to get a hearing for the case can close in works comp!

      First of all, just to be clear, the C - 4.3 form is for your doctor to complete. This is a medical report and is not for a lay person to fill out. You should not be filling out your own forms. I just wanna make that clear.
      Generally speaking, depending on the status of the claim, you might either get a hearing or an administrative notice from the board notifying the insurance company that the board is in receipt of medical evidence of permanency, giving the carrier an opportunity to get their own report or negotiate a resolution. So you don’t automatically get a hearing following the filing of 4.3.
