Toby basically says that there isn't explicit proof 7 years ago, but still denounces Wolff for his irresponsibility. Toby apologises on behalf of Wolff, and even offers to donate 20 THOUSAND DOLLARS to Yellow's favourite charity. He also says he wants to set clearer guidelines for copyright on his music, which would be very much appreciated since his music rights distributors have failed at that already. Furthermore, Toby has also pushed to rectify other Materia Music issues, such as getting Laura Platt, who made piano arrangements of the Deltarune OST, credited again for her work after Materia removed her name from their website when she left the company. Honestly,toby fox is someone who really respects the community of fans making fangames especially Undertale yellow. Undertale yellow is such a very much an interesting fangame.
Since when has a music rights company ever been the good guy in these situations? Wolffe can return to striking down vods any day he chooses as this is a recent development, it'll only end for sure with Toby's intervention. Spec Ops: The Line doesn't have a villain since the "villain" of that game was just made up in the main character's head so he could feel like a hero when in reality he wasn't.
This is mostly caused by a lack of clear terminology and "legal greed". Toby Fox has a more open sentiment of his music that is abnormal in the industry, and because of that he needs to jump through extra hoops to prevent people from assuming the legal default. Lawyers are fueled by money (which is not a bad thing, necessarily, it is their job, and this is money for them AND their clients), and that's likely why Wolff took his stance. It doesn't change how unprofessional, irrelevant, and inconsistent his statements were though.
Mr. Wolff went about it entirely wrong, yes, but he does have some important points to consider. Copyright law is VERY fragile. Ever wonder how the trampoline got its name? It wasn't the name of a product, but the name of the first company who invented it. But, over time, other companies made their own versions of it, and began associating the name "Trampoline" with the name of the product, rather than the company, causing them to lose their trademark on the name. Copyright can usually only be as secure as you choose to enforce it, and if one day there were to be somebody who chose to abuse Toby's music lisence and profit off of it in a way Toby would not want, they would have an extremely strong case to demonstrate that Toby's copyrights don't hold up at all anymore, as he treats it more like a copy-LEFT lisence. If Mr. Wolff was under the impression that his job was to protect that Copyright to some extent, he'd be a bit offput to see that his ACTUAL job basically consists of doing the exact opposite of that by allowing every person who files a dispute to use it freely. Of course, none of this justifies the way he behaved, but that's not the point of what I'm talking about anyway.
But if Toby Fox wants people to use his work however they want,, then let him have that. What right does Wolff have to enforce his own personal of control over Toby's work? Plus, Toby doesn't really care what people do with his work anyway, even for monetary purposes. The TH-camr Alpharad uses "Dating Start!" as his sponsorship background music, and his sponsors were getting concerned that he was using another person's licensed music to advertise products. So he asked Toby Fox if he was allowed to use the music. Fox gave the thumbs-up, saying that since he made the song using free soundfonts, Alpaharad could hypothetically just tell sponsors that he made the music himself. Toby really doesn't care if people use his music for commercial purposes.

One example of him being fine with a youtuber using his music for commercial purposes _does not_ establish that he doesn't care at all, especially when in his initial statement he very clearly laid out that people trying to sell music or throw concerts using his work should buy a license first. Toby is not some laissez-faire guy who lets anyone profit off his work, he's just a way more reasonable than other music creators. But he rightfully wants a cut of the profit if you intend to profit off of his music. He made it very clear in his recent statement that, even though supports the devs of UTY, they made a mistake wrt licensing. As he says, "if well-meaning fans have made a mistake, it should be our job to figure out how to make it right". He does not say they did nothing wrong at all.

Part of me wishes that after resolving the UTY issue, Toby got intrigued about the fangame being so popular and decided to play it himself. While i hardly doubt he'd make it canon to UT universe or something like that, i think even he would be impressed by the amount of work put into it. A public statement by Toby that he played/enjoyed UTY would be even more of a treat (for example, he could mention it in his next newsletter). While unlikely, it's something i would really like to see.

Oh hey, you know when you said use of Undertale music "could" be at risk of being flagged for other content? Change that to is* at risk. My second channel that I stream on got nailed by Materia Music just yesterday which prompted me to look in to this issue.
This whole situation is kinda sad, because Sebastian Wolff is in the right here and I totally get what he’s saying. Undertale yellow didn’t get a license to use undertale music or the logo and yet was generating revenue from the music being on music streaming platforms, that’s definitely a legal issue, and needed to be sorted out. I just wish the whole situation was handled in a nicer way. The worst part is that if you look into Sebastian Wolff it’s clear he’s not doing this “for the money” or anything, he’s just a REALLY strong activist for vgm composers and believes they should receive proper royalties for their work. I think thats a commendable goal to work towards, even if it conflicts with how vgm is essentially treated as royalty free bgm on TH-cam. No, this isn't the CEO's mistake, this is toby fox's mistake for entrusting the music to this company. As long as capitalism exists nothing can be done to force owners of companies to be good people short of toby showing up and suing them for everybody else's damages or something. In every case entrusting something to a company gives them all the power over everyone that doesn't have that ownership, and no accountability. The entire concept of capitalism is that everything has to be managed by somebody exclusively in exchange for nobody else having control over it even to be able to make them be a good person. I think it all started because he's greedy
This whole situation is kinda sad, because Sebastian Wolff is in the right here and I totally get what he’s saying. Undertale yellow didn’t get a license to use undertale music or the logo and yet was generating revenue from the music being on music streaming platforms, that’s definitely a legal issue, and needed to be sorted out. I just wish the whole situation was handled in a nicer way.
The worst part is that if you look into Sebastian Wolff it’s clear he’s not doing this “for the money” or anything, he’s just a REALLY strong activist for vgm composers and believes they should receive proper royalties for their work. I think thats a commendable goal to work towards, even if it conflicts with how vgm is essentially treated as royalty free bgm on TH-cam.
I don’t think Sebastian Wolff is a bad guy, I think he just got frustrated seeing the ut soundtrack get “plagiarized” under the legal definition when he really should’ve been more sympathetic and kind towards the ut yellow devs.

No, this isn't the CEO's mistake, this is toby fox's mistake for entrusting the music to this company.
As long as capitalism exists nothing can be done to force owners of companies to be good people short of toby showing up and suing them for everybody else's damages or something. In every case entrusting something to a company gives them all the power over everyone that doesn't have that ownership, and no accountability. The entire concept of capitalism is that everything has to be managed by somebody exclusively in exchange for nobody else having control over it even to be able to make them be a good person. That is terrifying.
Nobody should put up with this. We should all just demand that "music distribution" can only be handled by state businesses and we are not going to have autonomous businesses separate from society any more, so that they are accountable to democracy instead of accountable to nobody
