Good ideas , it is know as WAQF Al Aulad in our Khandaan and has been valid in our AWADH since ages , but after 1947 , whole system got destabilized and continued till today, BUT by seeing this discussion and some other cases like that Myself is very much interested to get deep knowledge of the system in U.P. the Most Populous STATE of Indian Union.

My mother left us without a will. Left only house.We brother and sister had difficult time after that. I planned to transfer property on everybody's name but also thought of making a trust. I think trust is good.

No nothing like this it is governed under Indian trust act 1882 , it has no relation with benami property act

The cost for Trust on account of lawyer fee of Rs 1 to 1 1/2 lakhs is exorbitant. In the USA it is usually sub $500 for majority people until unless the wealth is complex and complex beneficiary with super complex directives.
Majority people in USA form trust that’s why the cost is less and the succession laws are much simpler that’s why the cost is less compared to India 🇮🇳❤️

Some one assigning own income or asset to a private trust for the benefit of own or own family etc is basically defeating the purpose of personal liabilities. This is like defeating the purpose of having personal liabilities. Contradicting objectives.
If you place assets in a trust you surely defeat the problems of personal liabilities 😊❤️
What about the stamp duty on transfer of assets to family trust?
For financial assets it is minimal and for immovable property it is less in some states and very nominal but in some states it is normal stamp duty only

Anything can be done in the trust as per your wishes it will dissolve only when you want it to dissolve 😊

What is the stamp duty for transferring immovable properry to trust. What are the income tax rates on income of the trust.😊
For immovable property you have to pay the stamp duty but we have ways to avoid the stamp duty ❤️💯

The title is with the trust and the controller is the trustee , from trust deed we can define who can sell , title holder is trust and controller is trustee they are separate that’s why you get asset protection ❤💯

If you are liable personally for alimony or any other thing and you have dictionaries power, can court order you to release money because it’s your money and you have dictionaries power and can revocable trust also protect it or you need irrevocable trust?
If it’s a revocable trust then income tax act doesn’t consider it as a transfer and court can also order to pay money 💴 😊

After making pvt family trust we need to file IT Returns. As everything in trust then do Trustee need to file IT Returns also separately?
