**This is the full video with ASP's video at the end** RECORD BREAKING AMOUNT Trooper's Report: On 10-12-23, I Trooper A. Escamilla, was patrolling in the area of Interstate 40 west near the 184 mile marker. While traveling, I observed a Gray Mercedes Sprinter Van traveling in the number 1 lane. The vehicle was following too close to another vehicle. I initiated a traffic stop on Interstate 40 West near the 183 mile marker. I made contact with the driver identified as Ali Ashabi. I advised Ali of who I was, the agency I represented and the reason for the stop. Ali was informed of the traffic violation and how to correct it. I asked Ali what is travel story was in which he stated the following. Ali was traveling from Tennessee to Little Rock Arkansas to help a friend move. I asked Ali if the vehicle was a company vehicle or a rental in which he stated that the vehicle belonged to a friend. Ali was asked again what he was moving and he stated that he was traveling to Little Rock to pick up things that he would be taking to move into a restaurant. While speaking to Ali, it should be known that he appeared to be nervous. When I asked Ali for his driver’s license, he was shaking. I had Ali exit the vehicle so that I could further conduct my traffic stop. I asked Ali if there was anything illegal in the vehicle in which he stated “no”. I then asked Ali two separate times if I could search the vehicle in which he stated that I could. I went to open the right rear door of the van and Ali stated that I shouldn’t open it because it would not open. I then went to open the rear doors. As I opened the doors, I observed there to be several empty boxes along with a couch across the rear of the van. Behind the couch were several brown paper bags stacked up which read “The Home Depot Garden Club”. The brown bags were taped up and concealed an unknown item. Behind those boxes were several boxes stacked from the bottom to the top of the van. I observed one of the boxes to read “Newport 100’s”. As I looked over those boxes, I observed several Cigarette Cartons throughout the entirety of the van. I grabbed the brown paper sack bundle and opened it which yielded several new Newport Cartons inside. I then opened the carton’s and observed that some had stamps on them from South Carolina. I took a random carton out from the box and observed that those did not have a stamp on them. Due to the large quantity of Cigarette’s located, I placed Ali in the rear of my vehicle to further investigate. I had Ali drive the vehicle from my stop location to the 183 mile marker where I advised Ali to take the exit and pull into a gravel lot in which he did. I then had Ali come back to the rear of my vehicle while I waited for Agent Miller to respond. Agents Miller and Agent Matthew Thomas arrived to Lonoke County Sheriff's Office and took over the scene. All evidence was transferred to them. I was advised by Agents to charge with Arkansas Code 26-57-245 Possession of Unstamped / Unpaid Taxes Tobacco Products. Ali was also charged with Use of another person’s property to facilitate a crime. ***---***---***ARKANSAS STATE POLICE'S NEWS RELEASE***---***---*** LITTLE ROCK, Arkansas - Arkansas State Police (ASP) and Arkansas Tobacco Control agents seized a record-breaking amount of illegal cigarettes on Thursday, October 12. The seizure included 32,671 packs of untaxed cigarettes valued at more than $311,000. An ASP Trooper who stopped a cargo van on Interstate 40 near Carlisle discovered numerous cartons of cigarettes during a search of the cargo area. The Trooper and an Arkansas Tobacco Control Enforcement agent seized more than 3,270 cartons of cigarettes. “Contraband cigarettes are one of the leading sources of funding for terrorism in the United States,” said ASP Colonel Mike Hagar. “We will continue to work with all our partners at Tobacco Control Enforcement to expose and dismantle organizations behind illegal cigarette operations.” The driver, Ali Ali Ashabi, 35, of El Paso, Texas, was arrested and transported to the Lonoke County Detention Facility, where he was charged with Possession of Untaxed Tobacco and Unauthorized Use of Another Person’s Property to Facilitate Certain Crimes. “This stop is a testament to the importance of strong relationships among law enforcement organizations,” said Trent Minner, Administrator of DFA’s Regulatory Division. “Our partners at State Police immediately contacted Tobacco Control, allowing an agent to arrive on scene quickly. As a result, we made what we believe is the largest seizure of illegal and untaxed cigarettes in Arkansas, saving the state a significant amount of tax revenue.” The cargo van was also seized along with the cigarettes. Tobacco Control operates under the Department of Finance and Administration’s Regulatory Division. Arkansas Tobacco Control oversees 5,262 tobacco permits across the state.

@@foltzenlogel He was following about 2 seconds which is the usual distance people drive looking at the line markers. They love pulling over out of state plates and especially large vans or SUV type vehicles because there is a small chance they have something illegal. Whenever I'm on a road trip I always keep a distance of about 3-4 seconds and have never gotten a ticket or been pulled over.

i do agree with what youre saying. but this by law is tax evasion, we have the same issue on the east coast. they will buy cigs from the lower states like VA and transport them to NY and sell them in their stores. it bypasses NY tax and the stores make more money on them because they sell them for a little less than the legit stores. this not only hurts NY (what a shame) but the legit stores because theyre prices are much higher than bootleggers

Exactly. Lots of mules travel on this route and they bust quite a few after stopping for illegal change lanes, following too close, speeding, etc. When I lived in GA there was a section of the interstate that locals knew not to commit even a simple infraction on because they are going to stop you. They do it because of all the bigger drugs and weapons smuggling. If these came across Mexico without inspection, then my concern is what might be in them.
I like how this officer says she's stopped for tailgating and immediately starts searching the vehicle on every video. Tailgating does not give you probable cause to search the vehicle
She merely requested it. There are circumstances that allow you to search a vehicle; Consent Plain view Probable cause Warranted search. You need to do some research you aren't very wise

See, she never made any attempt to address the reason for the stop, but of course that wasn't the reason for the stop anyway. She wanted to see what was in the van.
@@Wingman813 but she never went back to her vehicle to complete the original mission of the stop, she went right into another investigation without reasonable suspicion. That's why Kansas State patrol got in trouble, they called it the KST two step. They actually finished the reason for the stop, went back to the vehicle, handed all the documents back, turned around took two steps toward their vehicle, came back and said, oh by the way..... Technically, they are supposed to complete the original reason unless they smell weed, see something in plain sight, or suspect alcohol or by the totality of the circumstances raise reasonable suspicion for something else.

She didn't have probable cause to search and he should not have consented to it. it doesn't cost you anything to have the trooper get a search warrant.
In a state that is used as a thorough way for drug runners from coast to coast, any van, box truck, etc. with out of state tags can be suspicious, and needs to be checked if possible.

she does her job and she does it very well. The van in this video was OBVIOUSLY following that semi too closely. You are supposed to allow for at least a 2 second interval between you and the vehicle in front of you, but this van only had about a 1 second gap between him and the semi in front of him. the stop was completely legit and she had cause to pull him over. You people in the comments really need to learn the rules of the road so that you dont keep sounding like absolute morons complaining about conspiracy theories and crap.....

Troopers are the law. I was involved in a near-accident in AZ. Trooper said, "You's be glad you no get a CIT-ation." He no friendly "dude." A gal didn't see me enter the freeway, slammed on her brakes. Car broke lose. My car was pulled into this but had luck, was able to drift on to the verge.
She doesn't know the law she is trying to quote. The 200 foot law is for vehicles that are "drawing another vehicle" drawing another vehicle means pulling something. She made up a bs excuse to stop an out of State plate.

The guy didn't have obvious drugs or weapons in plain sight, car didn't "smell like weed" as per the classic case when cops want to unlawfully search your vehicle, cops can't make you sit and wait for a drug dog (it is unlawful for the police to prolong a traffic stop for longer than the original intention of the traffic stop, in this case "following too closely" which is at most a traffic citation), and if he just answered her questions with, "I prefer not to answer questions or disclose my private business for anything unrelated to the reasons for this traffic stop." Then please tell me how could she generate probable cause? He should have handed her the cars paperwork, showed her insurance, and shut the hell up.
Some years ago, my job required that I attend a terrorism, and response academy, put on by the Department of Homeland Security, one of the classes required us to stop at a random store, and purchase a pack of cigarettes, ( even if we didn't smoke ourselves) the instructors then went carefully through, the collected packs, and discovered several suspicious tax stamps, that had either been tampered with or were outright fakes, the locations that sold these packs were then scheduled to receive a visit, from the BATF, ( the instructors were clear we were to make these purchases, at neighborhood mom and pop type liquor or convenience stores or independent gas stations, and not the big chain stores) the reason? It has been determined that terrorist cells, within the U.S. Have been funding their operations through the sale of untaxed cigarettes, and liquor, and after hearing this guy praying in Arabic while the trooper was out of the car, who knows what she stumbled upon?

*I guarantee that this dude or his family owns a convenient store in another state so they buy cigarettes at wholesale then go to sell them at discounted retail price undercutting other local stores in their town. Very easy solution to Ali's situation: No I do not consent to a search of my vehicle. There was no probable cause, didn't even pull out the classic, "vehicle smells like weed". Additionally, you don't need to answer any of those questions about "where are you going/ what are you hauling". It's none of the cops business and is not probable cause to search the vehicle if you reject to answer. Just say, "I prefer not to disclose my private business and do not intend to answer questions that are not directly related to our interaction." Sure, the cop might be a dick to you but then again the cop was never looking for you to have a pleasant day to begin with since they in fact pulled you over. If they drum up some story about "probable cause" you would have a decent cause in court for unlawful search/ seizure. Not saying it's okay to traffic un-taxed cigarettes, just know that Ali did himself no service in giving up his rights.

People if you are stopped by the cops do not engage in a conversation and add to the delay of the stop. Answer no questions and consent to no search even if you’re completely legal.

For the life of me I can't figure out why any officer has the right to ask SO many questions when the reason for pulling him over was a simple traffic violation. He clearly didn't know his rights to simply not answer questions not related to the violation AND now allow her to search his vehicle! Do I condone breaking the law? No - but man, I can't figure this one out at all. I also can't figure out why she is allowed to be that much overweight - real good thing she didn't end up in a foot-chase. Tobacco smuggling is not a rare occurrence, Arkansas currently has the highest tobacco tax rate of our six surrounding states. I agree we are taxed on everything and a lot of things we are taxed too much, people will do whatever they can to slip by. It actually hurts the honest people.

Especially profitable when they hijack a semi full of it, then distribute it on the street corner or small conveyance stores that have no problem selling it. Long haul truckers have taken up collections from friends forever, and legally bought cartons where it's far cheaper than where they live, and return them to their friends and self too. Technically that is illegally smuggling too-even if it's only 10-15 cartons.

That is one nasty habit I’m happy to have left behind long ago. I grew up in the 1950’s and virtually everyone smoked. I grew up breathing cigarette smoke because both of my parents smoked. I had no idea how much it stunk until I quit. How I survived long enough to become a codger I’ll ever know. Apparently if I had known as a child what I know about health today ( and been able to act on it) I would have lived to about 150. 😂

On 10-12-23, I Trooper A. Escamilla, was patrolling in the area of Interstate 40 west near the 184 mile marker. While traveling, I
observed a Gray Mercedes Sprinter Van traveling in the number 1 lane. The vehicle was following too close to another vehicle.
I initiated a traffic stop on Interstate 40 West near the 183 mile marker.
I made contact with the driver identified as Ali Ashabi. I advised Ali of who I was, the agency I represented and the reason for
the stop. Ali was informed of the traffic violation and how to correct it. I asked Ali what is travel story was in which he stated the
following. Ali was traveling from Tennessee to Little Rock Arkansas to help a friend move. I asked Ali if the vehicle was a
company vehicle or a rental in which he stated that the vehicle belonged to a friend. Ali was asked again what he was moving
and he stated that he was traveling to Little Rock to pick up things that he would be taking to move into a restaurant.
While speaking to Ali, it should be known that he appeared to be nervous. When I asked Ali for his driver’s license, he was
shaking. I had Ali exit the vehicle so that I could further conduct my traffic stop. I asked Ali if there was anything illegal in the
vehicle in which he stated “no”. I then asked Ali two separate times if I could search the vehicle in which he stated that I could. I
went to open the right rear door of the van and Ali stated that I shouldn’t open it because it would not open. I then went to open
the rear doors. As I opened the doors, I observed there to be several empty boxes along with a couch across the rear of the
van. Behind the couch were several brown paper bags stacked up which read “The Home Depot Garden Club”. The brown
bags were taped up and concealed an unknown item. Behind those boxes were several boxes stacked from the bottom to the
top of the van. I observed one of the boxes to read “Newport 100’s”. As I looked over those boxes, I observed several
Cigarette Cartons throughout the entirety of the van. I grabbed the brown paper sack bundle and opened it which yielded
several new Newport Cartons inside.
I then opened the carton’s and observed that some had stamps on them from South Carolina. I took a random carton out from
the box and observed that those did not have a stamp on them. Due to the large quantity of Cigarette’s located, I placed Ali in
the rear of my vehicle to further investigate.
I had
Ali drive the vehicle from my stop location to the 183 mile marker where I advised Ali to take the exit and pull into a gravel lot in
which he did. I then had Ali come back to the rear of my vehicle while I waited for Agent Miller to respond.
Agents Miller and Agent Matthew Thomas arrived to Lonoke County Sheriff's Office and took over the scene. All evidence was
transferred to them. I was advised by Agents to charge with Arkansas Code 26-57-245 Possession of Unstamped / Unpaid
Taxes Tobacco Products. Ali was also charged with Use of another person’s property to facilitate a crime.

LITTLE ROCK, Arkansas - Arkansas State Police (ASP) and Arkansas Tobacco Control agents seized a record-breaking amount of illegal cigarettes on Thursday, October 12. The seizure included 32,671 packs of untaxed cigarettes valued at more than $311,000.
An ASP Trooper who stopped a cargo van on Interstate 40 near Carlisle discovered numerous cartons of cigarettes during a search of the cargo area. The Trooper and an Arkansas Tobacco Control Enforcement agent seized more than 3,270 cartons of cigarettes.
“Contraband cigarettes are one of the leading sources of funding for terrorism in the United States,” said ASP Colonel Mike Hagar. “We will continue to work with all our partners at Tobacco Control Enforcement to expose and dismantle organizations behind illegal cigarette operations.”
The driver, Ali Ali Ashabi, 35, of El Paso, Texas, was arrested and transported to the Lonoke County Detention Facility, where he was charged with Possession of Untaxed Tobacco and Unauthorized Use of Another Person’s Property to Facilitate Certain Crimes.
“This stop is a testament to the importance of strong relationships among law enforcement organizations,” said Trent Minner, Administrator of DFA’s Regulatory Division. “Our partners at State Police immediately contacted Tobacco Control, allowing an agent to arrive on scene quickly. As a result, we made what we believe is the largest seizure of illegal and untaxed cigarettes in Arkansas, saving the state a significant amount of tax revenue.”
The cargo van was also seized along with the cigarettes.
Tobacco Control operates under the Department of Finance and Administration’s Regulatory Division.
Arkansas Tobacco Control oversees 5,262 tobacco permits across the state.

When I lived in GA there was a section of the interstate that locals knew not to commit even a simple infraction on because they are going to stop you. That's why Kansas State patrol got in trouble, they called it the KST two step. They actually finished the reason for the stop, went back to the vehicle, handed all the documents back, turned around took two steps toward their vehicle, came back and said, oh by the way..... Technically, they are supposed to complete the original reason unless they smell weed, see something in plain sight, or suspect alcohol or by the totality of the circumstances raise reasonable suspicion for something else.

The guy didn't have obvious drugs or weapons in plain sight, car didn't "smell like weed" as per the classic case when cops want to unlawfully search your vehicle, cops can't make you sit and wait for a drug dog (it is unlawful for the police to prolong a traffic stop for longer than the original intention of the traffic stop, in this case "following too closely" which is at most a traffic citation), and if he just answered her questions with, "I prefer not to answer questions or disclose my private business for anything unrelated to the reasons for this traffic stop." Then please tell me how could she generate probable cause? He should have handed her the cars paperwork, showed her insurance, and shut the hell up.

Some years ago, my job required that I attend a terrorism, and response academy, put on by the Department of Homeland Security, one of the classes required us to stop at a random store, and purchase a pack of cigarettes, ( even if we didn't smoke ourselves) the instructors then went carefully through, the collected packs, and discovered several suspicious tax stamps, that had either been tampered with or were outright fakes, the locations that sold these packs were then scheduled to receive a visit, from the BATF, ( the instructors were clear we were to make these purchases, at neighborhood mom and pop type liquor or convenience stores or independent gas stations, and not the big chain stores) the reason? It has been determined that terrorist cells, within the U.S. Have been funding their operations through the sale of untaxed cigarettes, and liquor, and after hearing this guy praying in Arabic while the trooper was out of the car, who knows what she stumbled upon?

There was no probable cause, didn't even pull out the classic, "vehicle smells like weed".
Additionally, you don't need to answer any of those questions about "where are you going/ what are you hauling".
It's none of the cops business and is not probable cause to search the vehicle if you reject to answer.
Just say, "I prefer not to disclose my private business and do not intend to answer questions that are not directly related to our interaction."

Long haul truckers have taken up collections from friends forever, and legally bought cartons where it's far cheaper than where they live, and return them to their friends and self too. Technically that is illegally smuggling too-even if it's only 10-15 cartons.

First of all I’m very sorry you lost your husband that way. Also lung disease is no picnic. When I finally decided to quit it was the same. I quit cold turkey. But after a few months a long distance friend sent me 3 custom blends of pipe tobacco and a brand new pipe for Christmas.😳 I figured I’d just smoke a bowl after supper once in a while. Nope! Next thing I know I’m smoking like I’d never quit. Anyway, I finally got er done and haven’t looked back. I wonder what is the true number of people tobacco has killed or made sick.
