We lived next to one and he made our lives hell for 20 years until he moved away. He would throw rubbish over into our yard and do all kinds rotten things to my dad for no reason, like borrow something and return it broken or damaged and don't even say sorry, which I know he did it on purpose. The kids were bad too. Bullied us as kids. He would beat up his kids if he had a bad day at work so not really the fault of his kids for becoming bullies themselves.

Today I read an observation online and don’t know the validity of it. This person had read that Silva had tried to leave the scene and then was shot by the homeowner. He was not shot during the commission of his crime. In that instance he would NOT have been shot in self-defense or “stand your ground.” If he was fleeing the scene and was shot, that could conceivably been a revenge shooting, possibly murder in the 2nd degree. No one knows if this is what happened and I’m not saying it did, but it is a logical explanation of the charge and release. The home owner doesn’t seem to be a threat to anyone and considering he’s in deep mourning for the losses in his family, it may have been a compassionate release.
The attacker doesn't have any right to destroy private property where it ended with 3 people dead in the house and some wounded by shooting. The guy who shot the attacker did so to defend himself and others.

Police cannot be everywhere and HPD cannot babysit all these adults. HPD did their job well. Because their has to be an investigation. If you shoot someone, you'll probably get arrested. If your story checks out and it was clearly self defense, you'll probably get released without charges. If it's sketchy and the cops aren't sure what's the truth, you'll go to trial and can present "self defense" as an affirmative defense. Then the jury decides.
People who have guns need to know what the law is around their use. I had a CCP when I lived in NY, but I decided not to carry unless i was going to or from the range, because there were more ways to screw up my life carrying a gun than not carrying one. We lived next to one and he made our lives hell for 20 years until he moved away. He would throw rubbish over into our yard and do all kinds rotten things to my dad for no reason, like borrow something and return it broken or damaged and don't even say sorry, which I know he did it on purpose. Today I read an observation online and don’t know the validity of it. This person had read that Silva had tried to leave the scene and then was shot by the homeowner. He was not shot during the commission of his crime. In that instance he would NOT have been shot in self-defense or “stand your ground.” If he was fleeing the scene and was shot, that could conceivably been a revenge shooting, possibly murder in the 2nd degree. No one knows if this is what happened and I’m not saying it did, but it is a logical explanation of the charge and release. The home owner doesn’t seem to be a threat to anyone and considering he’s in deep mourning for the losses in his family, it may have been a compassionate release.
The point is, it’s futile to rage at HPD. We don’t have all of the information.
