We lived next to one and he made our lives hell for 20 years until he moved away. He would throw rubbish over into our yard and do all kinds rotten things to my dad for no reason, like borrow something and return it broken or damaged and don't even say sorry, which I know he did it on purpose. The kids were bad too. Bullied us as kids. He would beat up his kids if he had a bad day at work so not really the fault of his kids for becoming bullies themselves.

Today I read an observation online and don’t know the validity of it. This person had read that Silva had tried to leave the scene and then was shot by the homeowner. He was not shot during the commission of his crime. In that instance he would NOT have been shot in self-defense or “stand your ground.” If he was fleeing the scene and was shot, that could conceivably been a revenge shooting, possibly murder in the 2nd degree. No one knows if this is what happened and I’m not saying it did, but it is a logical explanation of the charge and release. The home owner doesn’t seem to be a threat to anyone and considering he’s in deep mourning for the losses in his family, it may have been a compassionate release.

Police cannot be everywhere and HPD cannot babysit all these adults. HPD did their job well. They were required to make the arrest, do the investigation and the shooter was subsequently released and not charged. There was no conflict. Stop saying such unsubstantiated made up BS.
So it would seem mr Silva had a reputation for not respecting his neighbors Hiram had the opportunity to peace keeper and instead he chose to murder his neighbors he had no care if there were keiki or kapuna on top of it all, the 42 year old was pushed into responding to protect his family, and the fact that the victims are still worried about retaliation makes you wonder what kind of mentality the rest of the Silva family has, seems as though they have no respect for any of the neighbors because Hiram isn’t the only Silva who could have made their party guest be respectful so all those adults that live at the Silva property are at fault for what happened to that family, they know darn well how the father is they’ve seen it, maybe they should consider suing and becoming the new owners of the Silva property, these neighbors have tried in person and through hpd to ask for courtesy so if you doing what your supposed to then what can you do?

Even if the guy was leave the scene and was then shot/killed it's still self defense imo bc he was known to have guns and would shoot them off in the residential area and you're in fear for your life + the imminent danger of others after what he just did so you can reasonably suspect he was going to get his guns or had guns on him and was going to do more damage/threatening others lives. It's just sad that's neighbors don't respect the community and keep noise down after say 11pm and such. People don't think about others right to privacy/sleep/etc and that causes situations like this bc police don't care or can't really do anything. My neighbors in Hawaii drove us crazy sometimes glad I now live with only a few neighbors around and all are great, can't really do that in Hawaii unless you are rich AF.

Because their has to be an investigation. If you shoot someone, you'll probably get arrested. If your story checks out and it was clearly self defense, you'll probably get released without charges. If it's sketchy and the cops aren't sure what's the truth, you'll go to trial and can present "self defense" as an affirmative defense. Then the jury decides.
People who have guns need to know what the law is around their use. I had a CCP when I lived in NY, but I decided not to carry unless i was going to or from the range, because there were more ways to screw up my life carrying a gun than not carrying one. And that's true in even the reddest, most permissive states. People get charged with murder in states like Texas ALL. THE. TIME. because they got the law wrong.

Opposite? That unpermitted "silver dome" is where the parties were happening. They showed footage of it on other news segments. It appears hiram silva would regularly rent it out for that type of stuff. And the guests would regularly speed through the neighborhood.

We lived next to one and he made our lives hell for 20 years until he moved away. He would throw rubbish over into our yard and do all kinds rotten things to my dad for no reason, like borrow something and return it broken or damaged and don't even say sorry, which I know he did it on purpose. Today I read an observation online and don’t know the validity of it. This person had read that Silva had tried to leave the scene and then was shot by the homeowner. He was not shot during the commission of his crime. In that instance he would NOT have been shot in self-defense or “stand your ground.” If he was fleeing the scene and was shot, that could conceivably been a revenge shooting, possibly murder in the 2nd degree. No one knows if this is what happened and I’m not saying it did, but it is a logical explanation of the charge and release. The home owner doesn’t seem to be a threat to anyone and considering he’s in deep mourning for the losses in his family, it may have been a compassionate release.
The point is, it’s futile to rage at HPD. We don’t have all of the information.

The attacker doesn't have any right to destroy private property where it ended with 3 people dead in the house and some wounded by shooting. The guy who shot the attacker did so to defend himself and others.
