So I did exactly what you said I got my regional office( jurisdiction and also a case number. Made it clear I wanted a callback. I took down the reps name and info. I was then transferred to Waco regional office and a request has been done. Thank you so so much brother. I have 7 rated service connected conditions and rated at 90%. I am at a 92 (VA math)and need 3 point to hit a hundred and I have been deemed unemployable. So this should help, all I want is what I deserve & earned like most of us. I call Waco and supervisor told me all my disabilities are static and permanent. Now just have to hit 100%. Thank you so much, it works if you work it

Here is a nugget i had this problem twice 2022 and 2024 - i called the 1-800 told them my fioa was closed out the 10 days has passed the Rep checked the records she put me on hold put the request in i got the CD in 72 hours it came certified from st.louis - timeframe was 4 months 2 months other ones have taken 6-8 months before they was closed out -

Hey Mr. Kimble, just called the VA White House hotline and spoke to a very nice lady. I followed the steps that you provided, and she took all my requests without any issue. At the end of the call she stated that it can take up to 30 days to receive a call, and submitted my complaint. Thank you for your video.

i called the VA White house hotline, and got the same spiel, about it takes time and it will be processed in the order it was received, but then i got the "theres nothing we can do about it, thats just how the process works"
When I called and said what I said, I didn't get that. If I had, I would call back and speak to someone else. It's not their claim and what do they care about the 12 month period VBA gives you to file a HLR. If it's worked in the order it is received and goes beyond the 12 months. Thanks so much for creating this video. I just called and submitted my complaint and requested my FOIA request to be expedited and a call from supervisor in VBMS in the regional office. My FOIA request was June 1, 2023 and eBenefits shows it was closed out on November 20, 2023, but I never received the CD. The hotline provided me with a case number at the close of the call. 🤞🏾

I did as you said, and they sent me an email. I recalled them and discovered the whitehouse line person did not write that I wanted a supervisor to call me.

Long story .. foia claim updated and closed on my VA website as of 4 March. Still waiting for it in the mail. Called VBA 180O number, and they said the mail could take up to 10 business days. Not sure if I should use your Whitehouse hotline trick to get the supervisor to call me directly. Now worried that my c file and info was sent to the wrong address. Great information thank you. I submitted FOIA request for C-file, STR, DD-214, & Military Personnel Records in Jan 2024. This month the Dept of NAVY sent me a SF-180 form to fill out. Thinking about sending in complaint to Hotline.

@@CharlesSandoval300 I don't think the Navy can provide your C-File. The VA has the C-File. I think the SF-180 is used to get the Navy-only records from NPC; the VA told me to do that but what I need is the VA C-File. I'm at 5 months.....
Clarification: VA sent me a form. They said to fill it out and send to navy personnel command. I didn't do that because what I REALLY need is my C-File from the VA so I can see what they/C&P examiners said. Navy doesn't have C-File; VA does.
How long after you called the WH complain line did you receive the callback? I tried this a few weeks ago. The first rep was completely clueless. I called again the next day and got another clueless rep but she really wanted to help me. I said everything you said to say, word for word. I had to explain every single step in great detail. I’ve been waiting since November for my C-File.
I answer that question in the video, you have to watch the entire video. Doesn't sound like they didn't send your complaint to the VA and a supervisor from VBA didn't call you back. Those reps take the complaint and pass it on, that's it.

If it’s HLR. Why would you need Cfile if you can’t submit new evidence anyways? Can you submit a statement in regards to a mistake that you found in the decision rating sheet? Like the C&P examiner notes a positive IMO that should have been considered for the higher rating? Thanks!
Thanks for the donation. You really need it before the HLR so you can build your case to figure if any VA employee did anything wrong. You would put that statement on the 0996. As it pertain to the higher rating, you would need that exam to show it matches with the next higher criteria for that DX. Yes, Dewayne I listen to your video submitted a VA hotline White House complaint that resulted in zero progress. I turned in the foyer request with the thousand number VO and that was 18 months ago and they I called them four months into it and they said they got it. I signed it. They’re working on it and then the guy looked deeper and he said they stopped working on it two months after I submitted it with no explanation and then he said a message to that department to get back on the sea file because you need to file your Gulf War presumptions and then nothing was ever done. The White House complaint line while the complaint that nothing was ever done because the complaint line is just a system that the VA uses to say we give the veterans a shot and getting their problems solved and reality you have no shot at getting your problem solved because nobody ever investigates a White House complaint line. I have over 500 White House complaint lines that are never solved. They’re always signed off without ever investigating the VA that causes all my problems is Las Vegas VA because they don’t like reporting the truth. The federal agencies at Las Vegas VA treats me terrible.
You can't do a FOIA request with the 800 number. Also, when you called the hotline, did you ask them to put in your complaint to the VA, you would like a call back from a supervisor. The hotline, they only take the complaint, they do not work them.

@DewayneKimble- Quick question sir, as I’m confused about which way to go. I’m 10% service connected for tinnitus, but I’m also service connected 0% for migraines. I have done a lot of research and other vets are doing a secondary claim for migraines with tinnitus as primary. However, I’m service connected for migraines, do I submit for a higher disability, or do I submit migraines as a secondary claim. Thank you sir and keep the knowledge coming.
If you are service connected for that condition, it does not fall under secondary but increase. You have to know if you meet the 10, 30 or 50 percent for migraines under the diagnostic code. I have rhinitis through PACT act. Just diagnosed with sleep apnea. I want to file OSA secondary to rhinitis. With your VA adjuster hat on, should I just file with diagnosis and wait to see if they deny before begging my local doc for nexus or beg and send in right away? Thank you sir

I was just told that the process has changed and that there is a dedicated FOIA liaison office that is separate from the VA that handles FOIA requests now. They basically told me I was SOL. Idk. :/ She said she'll submit, so we'l see.

How long should a veteran wait before making this call? I am a little over 4 months waiting for C-file delivery since submitting FOIA request. Should you wait ONLY until your request has been "closed out" and only if there is a problem? @@productivity5465 I agree, the statement in the video wasn't entirely clear. What I believe Dwane was conveying was that you would like a Supervisor who in VBMS has jurisdiction over your claim from the Regional Office associated with your claim. Hope that helps.
Getting ready to send in the form to request my c-file, I have filed many claims before. On the instructions page it gives 2 addresses, first is the centralized support division, second is dept of VA evidence intake center in Wisconsin. Which should I use???

When should you be trying to get your claims folder? Is this something you want to do after you’ve submitted all of your claim for disability or when you’ve been rated for everything?

Negative. I called two different times and requested to speak to a supervisor from my regional office. I said I wanted a call not an email. They asked for my email address and told them no. I went so far as to tell them I do not have email. Well, they reviewed my claims file or something and got my email address. Both times they sent me the standard email response that they are working on my FOIA request and will be handled asap. Then the issue was closed. If you have an email address on file, you will NOT receive a call.

I asked for my C-file 4 months I called to find where it’s at. The guy said the department that does that stopped after 3 months and he didn’t know why so he said Iam sending a message why did you stopped working on the veterans c-file that was over a year now I still haven’t received anything yet.
Yes I am on the phone with the veterans hot line the people I call every week that does nothing about my complaints. I been calling sine it was call White House hot line. There supervisor,s hang up on me because iam 100% disabled war veteran from the 90-91 gulf war. Be in full disclosure the suicide hotline hangs up on me too because they don’t wanna deal with me either. Of course they do put in and report to Las Vegas VA to the suicide prevention team who doesn’t call me back because no one can make them their VA employees they don’t have to work for their money.. just like the Las Vegas VA call center who I’ve left over a 500 calls to have VA employees. Call me back who never returned my call and violation of federal law, but Vegas VA enjoys breaking federal law including HIPAA violations because the VA employees they can get away with it..

I'm claiming migraines secondary to my claimed tinnitus, please schedule a C & P exam to obtain a medical opinion with rational at the same time as the claimed tinnitus. So I did exactly what you said I got my regional office( jurisdiction and also a case number. Made it clear I wanted a callback. I took down the reps name and info. I was then transferred to Waco regional office and a request has been done. Thank you so so much brother. I have 7 rated service connected conditions and rated at 90%. I am at a 92 (VA math)and need 3 point to hit a hundred and I have been deemed unemployable. So this should help, all I want is what I deserve & earned like most of us.
I call Waco and supervisor told me all my disabilities are static and permanent. Now just have to hit 100%. Thank you so much, it works if you work it

Here is a nugget i had this problem twice 2022 and 2024 - i called the 1-800 told them my fioa was closed out the 10 days has passed the Rep checked the records she put me on hold put the request in i got the CD in 72 hours it came certified from st.louis - timeframe was 4 months 2 months other ones have taken 6-8 months before they was closed out -

Hey Mr. Kimble, just called the VA White House hotline and spoke to a very nice lady. I followed the steps that you provided, and she took all my requests without any issue. At the end of the call she stated that it can take up to 30 days to receive a call, and submitted my complaint. Thank you for your video.

i called the VA White house hotline, and got the same spiel, about it takes time and it will be processed in the order it was received, but then i got the "theres nothing we can do about it, thats just how the process works"
When I called and said what I said, I didn't get that. If I had, I would call back and speak to someone else. It's not their claim and what do they care about the 12 month period VBA gives you to file a HLR. If it's worked in the order it is received and goes beyond the 12 months. Thanks so much for creating this video. I just called and submitted my complaint and requested my FOIA request to be expedited and a call from supervisor in VBMS in the regional office. My FOIA request was June 1, 2023 and eBenefits shows it was closed out on November 20, 2023, but I never received the CD. The hotline provided me with a case number at the close of the call. 🤞🏾

I did as you said, and they sent me an email. I recalled them and discovered the whitehouse line person did not write that I wanted a supervisor to call me.

Long story .. foia claim updated and closed on my VA website as of 4 March. Still waiting for it in the mail. Called VBA 180O number, and they said the mail could take up to 10 business days. Not sure if I should use your Whitehouse hotline trick to get the supervisor to call me directly. Now worried that my c file and info was sent to the wrong address. @@CharlesSandoval300 I don't think the Navy can provide your C-File. The VA has the C-File. I think the SF-180 is used to get the Navy-only records from NPC; the VA told me to do that but what I need is the VA C-File. I'm at 5 months.....
Clarification: VA sent me a form. They said to fill it out and send to navy personnel command. I didn't do that because what I REALLY need is my C-File from the VA so I can see what they/C&P examiners said. Navy doesn't have C-File; VA does.
How long after you called the WH complain line did you receive the callback? I tried this a few weeks ago. The first rep was completely clueless. I called again the next day and got another clueless rep but she really wanted to help me. I said everything you said to say, word for word. I had to explain every single step in great detail. I’ve been waiting since November for my C-File.
I answer that question in the video, you have to watch the entire video. Doesn't sound like they didn't send your complaint to the VA and a supervisor from VBA didn't call you back. Those reps take the complaint and pass it on, that's it.

If it’s HLR. Why would you need Cfile if you can’t submit new evidence anyways? Can you submit a statement in regards to a mistake that you found in the decision rating sheet?
Like the C&P examiner notes a positive IMO that should have been considered for the higher rating?

Thanks for the donation. You really need it before the HLR so you can build your case to figure if any VA employee did anything wrong. You would put that statement on the 0996. As it pertain to the higher rating, you would need that exam to show it matches with the next higher criteria for that DX. Yes, Dewayne I listen to your video submitted a VA hotline White House complaint that resulted in zero progress. I turned in the foyer request with the thousand number VO and that was 18 months ago and they I called them four months into it and they said they got it. I signed it. They’re working on it and then the guy looked deeper and he said they stopped working on it two months after I submitted it with no explanation and then he said a message to that department to get back on the sea file because you need to file your Gulf War presumptions and then nothing was ever done. The White House complaint line while the complaint that nothing was ever done because the complaint line is just a system that the VA uses to say we give the veterans a shot and getting their problems solved and reality you have no shot at getting your problem solved because nobody ever investigates a White House complaint line. I have over 500 White House complaint lines that are never solved. They’re always signed off without ever investigating the VA that causes all my problems is Las Vegas VA because they don’t like reporting the truth. The federal agencies at Las Vegas VA treats me terrible.
You can't do a FOIA request with the 800 number. Also, when you called the hotline, did you ask them to put in your complaint to the VA, you would like a call back from a supervisor. The hotline, they only take the complaint, they do not work them.

I’m 10% service connected for tinnitus, but I’m also service connected 0% for migraines. I have done a lot of research and other vets are doing a secondary claim for migraines with tinnitus as primary.
However, I’m service connected for migraines, do I submit for a higher disability, or do I submit migraines as a secondary claim. Thank you sir and keep the knowledge coming.
If you are service connected for that condition, it does not fall under secondary but increase. You have to know if you meet the 10, 30 or 50 percent for migraines under the diagnostic code. I have rhinitis through PACT act. Just diagnosed with sleep apnea. I want to file OSA secondary to rhinitis. With your VA adjuster hat on, should I just file with diagnosis and wait to see if they deny before begging my local doc for nexus or beg and send in right away? Thank you sir

I was just told that the process has changed and that there is a dedicated FOIA liaison office that is separate from the VA that handles FOIA requests now. They basically told me I was SOL. Idk. :/ She said she'll submit, so we'l see.

Hi Mr. Kimble does this work if I just requested my c file? I have until 10/2025 to request an HLR. Also, where can I see its closed out with the new system? Not sure if this has been mentioned in another video.
In the video I mention calling the VA's call center first to ensure the FOIA request has been received and noted in VBMS. If so, you can use what I discussed in the video.

Negative. I called two different times and requested to speak to a supervisor from my regional office. I said I wanted a call not an email. They asked for my email address and told them no. I went so far as to tell them I do not have email. Well, they reviewed my claims file or something and got my email address. Both times they sent me the standard email response that they are working on my FOIA request and will be handled asap. Then the issue was closed. If you have an email address on file, you will NOT receive a call.
You did it wrong, you don't call them and ask to speak to a supervisor, you ask them to put that in your complaint that will be sent to VBA.

I asked for my C-file 4 months I called to find where it’s at. The guy said the department that does that stopped after 3 months and he didn’t know why so he said Iam sending a message why did you stopped working on the veterans c-file that was over a year now I still haven’t received anything yet.
The VA 800 number are only giving general answers. They have no control on how and when you get your CD.
Yes I am on the phone with the veterans hot line the people I call every week that does nothing about my complaints. I been calling sine it was call White House hot line. There supervisor,s hang up on me because iam 100% disabled war veteran from the 90-91 gulf war. Be in full disclosure the suicide hotline hangs up on me too because they don’t wanna deal with me either. Of course they do put in and report to Las Vegas VA to the suicide prevention team who doesn’t call me back because no one can make them their VA employees they don’t have to work for their money.. just like the Las Vegas VA call center who I’ve left over a 500 calls to have VA employees. Call me back who never returned my call and violation of federal law, but Vegas VA enjoys breaking federal law including HIPAA violations because the VA employees they can get away with it..
Do I file my tennitus claim and migraine connected to tennitus claim at the same time or wait till tennitus gets service connected?

You can claim them at the same time. I'm claiming migraines secondary to my claimed tinnitus, please schedule a C & P exam to obtain a medical opinion with rational at the same time as the claimed tinnitus.
