Andhra Pradesh High Court as told in one Judgement : it is quite apparently clear that there being no serious transaction or seriousness on the part of the appellants/plaintiffs to have the partition decree fully implemented by metes and bounds by way of final decree proceedings, it is not open for them to fall back on the same preliminary decree now at this length of time and more so after facing the several other proceedings as pointed out above and having lost therein and virtually when the same claim having been negatived at all stages, and the present claim of the appellants to fall back on the said preliminary decree Is totally unsustainable apart from being barred by any other principles under law or law of Limitation and also gets barred squarely under the principles of estoppel and res judicata
does final degrees proceeding can happen ?

I want to know about final decree. Prelimanary decree passed, commissioner was appointed to partition the properties in to 50x50 %.
A part 3 members B part 6 menbers both are Brothers sons.
Commissioner partitioned 18 properties in to two parts as 50x50. But he has not devided by meets and bounds.
1.How final decree will pass by the court.
2. Court directed the parties to file Non judicial stamp paper and Valuation certificate of the 18 properties. What cost of stamp paper should be given if so plaintiffs or defendents should submit stamp papers.
Kindly anser, I will be greatful to you.

My grand father has two wives, First wife has 1 son, 2 daughter s, Second wife has 1 son and 1 daughter.
My grand father divided his self aquired property equally and shared to two sons with unregistered will ( forcely written) after 25 days again he did the 70% land given to his first wife son as a gift deed in sub registrar office. Untill my grand father life end he lives with first son.
This total incident happened before 25yrs.
First son lives with his family from 25yrs
Can second son family file the partition suite???
What is the winning possibility to first son??
