@Justin Mathis Also he was advised by his lawyer not to as well. He was also not the person who called the show, either. Whether he did do it or not, polygraphs have been shown to not be 100% accurate, so it's sound legal advice not to take one (especially one from the show as well).

I think whatever was done that night while the sister was passed out was consensual. The younger sister said it wasn't because she wanted to tell her sister about before he did and didn't want her sister to feel betrayed by her. It was a dumb move. But that's why she doesn't want to go to the police and why he won't take the test. He would fail because he did do those things but not against her will and deep down he knows she's not going to the police.
This one has me confused though I honestly don't know who to believe.
There isn’t a single criminal lawyer on TH-cam who says talk to anyone without a lawyer. Here in the U.K. the police aren’t even allowed to interview you at all without one.

The sister's coming out inconclusive is pretty telling. Yes, Dan said that she was in a state of rest because the incident happened under the influence therefore her memories could be a figment of her imagination due to the drug and alcohol usage. The other thing also is when Steve asked the sister if she's going to go to the police if he failed, her answer was very hesitant. Her actions looked guilty in some respect.
I'm not saying she's lying or not taking her statements as falsehood either but, her reaction to that question is concerning to me.
I'm sorry but I see deception from the sister and him. The sister's boyfriend got up and left because, I assume, he couldn't believe that she didn't pass the test. She didn't fail but she didn't pass.

Polygraphs are good for entertainment but the only people who say they’re reliable are people who already rely on them (meaning, psychologists and neurologists agree they’re a joke).
Steve himself has said (not on this show of course, on the Breakfast Club) that you’d be an idiot to put anything important in your life in the hands of a machine. I don’t think it was smart of him to come on the show if he wasn’t going to take the test, but I definitely don’t fault him for not taking the test.

This guy has been accused of something serious whether he is guilty or innocent. He has an attorney to protect himself as he should. The local police where this supposedly happened weren't called, but police from another area were called while they were out of town. Another jurisdiction is gonna tell you to call the local police. Of course his attorney is gonna advise him not to take a lie detector test, ESPECIALLY one on some television show with national exposure.

He is claiming NOTHING happened; he is a liar. Whether it was consensual or not, SOMETHING happened. I find it very strange that the would-be victim isn't showing any emotion at all. She's not afraid of him, she's not crying and she's not breaking down. She's too calm and apathetic so that leads me to believe she willingly had sex with him and instead of facing her sister with her betrayal she's trying to ruin his life.

The guy refused to take the test because SOMETHING happened. Whether it was consensual or not, something happened. He's still a LIAR because he claims NOTHING happened, which is bullshit.

So if Dan couldn't get a result from her because of the drugs/alcohol/lack of sleep most likely he wouldn't have been able to render a decision with the guy either. The guy must have had an attorney or a friend/family member advise him not to take the polygraph.
So people told what the conditions are before a test. I guess she didn't understand. How come no police. When she was asked about the police she stumbled all over her answer. My opinion is that she is not telling the truth. I think she went to the test all screwed up on purpose.

Watching the whole story, it sounds like he would take advantage of her while she's messed up from drugs and alcohol. That would explain why it kept happening, because she was too out of it to stop it.
