      True, if she wasn’t strong she would’ve not survived… whether the victim survived or not that man STILL burried her ALIVE in the intent of ending her life, so he should be charged exactly for what he intended to do, the victim surviving shouldn’t affect the sentence…

    I personally think cases like this, shouldn't be "attempted murder".
    There should be a category such as "murdered but miraculously lived".
    Lot of cases, the murderer went all out to murder the victim, but by a miracle, by grace of God, the victim somehow survived on their own, no thanks to the murderer.
    To me, the killer did commit murder! So should be charged as such.

    • @sudoren7572

      Such situations are supposed to be accounted for with "aggravating circumstances" which are put on top of the crime charged, and bump up the punishment one level up for each circumstance proven before a court (e.g., caused ignominy, done by abusing a position of power over the victim). Although, if every piece on the part of the wrongdoer is done correctly but by some reason the victim survives, that might just end up as "frustrated murder" which is worse than "attempted murder", which nets a lesser penalty than just standard murder simply because the result is not as severe (which can still be offset and even surpass standard murder with enough proven aggravating circumstances). I can't speak for criminal laws in countries apart from mine, though.

      Yes, I agree. What about when they cause the victim to stop breathing or their heart to stop beating. Aren't they dead? Just because they were revived is beside the point. They died. If you kill somebody, it's murder. Just because medics brought them back to life doesn't negate the fact that they freaking killed them.

    • @lostmojo
      @lostmojo 8 หลายเดือนก่อน +4

      @@dorjjodvobatkhuu6457 the meaning of the word is "unbalanced, mad, uncontrollable because of the uterus". The Greek word is hystera. Already in 1900 BCE Egyptians related behavioral abnormalities in adult women to the fact that they - being women - had a uterus. It's important to avoid such language bc getting used to that idea is way worse than misogyny: it works subliminally.

    For sentencing purposes, I've always felt attempted murder should be treated the same as murder... not given a lighter sentence simply because their murder attempt was unsuccessful. Also, fyi, the photo you showed of Thurston County Courthouse is old. That's now some gov't bldg. The current superior court bldg was built in 1978. I was a court reporter there 1996 - 2004.

    For ladies who do not know never meet a DV man in private to discuss a divorce or breakup. Do this on the phone, in public or with several friends and in a public space. They always want to hold on to money that they will waste away instead of allowing the wife and kids to live and invest it.

    I'm getting fed up with these people using mental health as an excuse. There is a heck of a difference between a violent partner and a sociopath. Individuals who are sociopaths are often volatile and one of the biggest causes of men who have committed domestic abuse. They're manipulative and have difficulty forming attachments to others. Psychopaths can be a danger to others because of their lack of empathy or remorse. Therapy can help these individuals develop healthier ways of managing relationships.” He thought nothing of his children and distress all of this was going to have on them. How is 13 years a lengthy sentence when he was sentencing her to death and in a cruel way. Crimes committed like this need a harsher sentence any domestic abuse victim needs to see justice been upheld when they have suffered unimaginable pain degradation the constant walking around on egg shells. This mental health get out of jail card has been over used and needs to stop. People who genuinely need the help are been missed and are committing crimes that are incredibly bad
