This is the voice worth most on this issue. "What permissible need not necessary be right". Surely he will vote against this amendment but I think it's good decision of central government. It's a condition like in Mahabharat where morality compromised to get the justice. The person like Arvind Kejriwal can compromise at any level to fulfill his personal ambitions and being potential threat on such an important constitutional position in NCT. We practically faced his maline intentions under lucrative temptation and indolence during anti CAA protest, so called farmers protest, COVID-19 pandemic and recently during Delhi flood. He misused Delhi Assembly decorum for his political motives, places his party workers in government administrative and constitutional positions to draft the policies to fulfill his corrupt intentions, he knows it that's why while enjoying the privilege of C. M. but not ready to take his administration responsibilities he never signs on any file for this purpose he use his puppet minister's, He planted by big private media houses and foreign NGOs in Indian politics to get indirect control on constitutional positions and government decisions and in return he feed those media houses in form of big advertisement budget (again example what permissible is not necessary be right). The rise of Khalistan movement in Punjab and misuse of Punjab police for political rivalry is clear indicator of his intentions and misadventures attitude. He should be contained thus this amendment is necessary for larger benefit of democracy.

I can't believe the former CJI has this kind of view towards basic structure, he tried to take the most negative meaning of federal structure, SC in their previous judgments made it clear that Delhi is UT with legislature, so they have basic federal powers as of state except 3 matters which was quite agreeable.
Here Mr. Gogoi clearly not understanding the position of answerablity in this case... bureaucrats can make quorum without elected CM to make the final decision on laws made by a legislature (judicial power to executive) how isn't this violation of seperation of power. even after this LG has complete discretion in subject matter, why? What kind of federalism is this. It's almost equivalent to the central govt taking each and every decision regarding services in Delhi.
Mr Gogoi was already in the chair of criticism for taking his own case and making decisions (indirectly) in matter case.
Independence of judiciary is a maya in India 😂
What gogoi meant, as i understand his statement, is specific to delhi territory only. But, in case, if he had meant that the basic structure of the constitution is debatable in toto then the articles, containing the principle of agreement to join the union of india is in jeapordy because it will amount to dishonoring the principle of accession which in turn will encourage states from breaking away from the union of india.
