    I have great respect for Judge Simpson as a fair and learned jurist. However, I have to disagree with his decision to continue the trial. A defendant being obstanant shouldn't force a continuance. It's unfair to the opposing party and puts an unreasonable burden on the jurors who, under penalty of law, are forced to upend their lives to serve. Judge Dorow in the Brooks trial handled obstinance from a defendant perfectly. Participate or don't participate.

    If a was a juror and the defendant pulled a stunt like this, disrupting my life for another week with his silly childish antics, I would have a hard time deciding on a favorable verdict for him. I know, I know, its my duty blah blah blah, but I'm just being honest.

      Because your not required or obligated to be at your won trial. As the judge here said, he can forfeit. He will just go back to jail, and the court case will go forward without him.

These hard-working people probably went to their bosses and said they only needed one day Now they got to go back in a week and tell them they need to come back for the closing arguments so that's an additional day of work they are losing! Judge Cedric got it wrong one this one I hate to respectfully disagree with Judge Simpson on this one.

      Agree, especially because the trial was at the point of closing arguments. All evidence had already been provided. There is no reason to think the defendant's absence would make no difference in what was said in closing arguments.

      I believe Wisconsin has a rule that let's them do that, so long as the defendant is available to the proceedings (as Darrell Brooks proved), so I would've just arrested him for contempt, and continued with him on video (presuming that was an option). Then, to cover his ass, tell the jury that he was sequestered due to a possible concern for covid exposure or something.

      ​@@kayb9979 Depends on the jurisdiction, but in most cases jurors get paid very little if anything, maybe $30-50/day, which may not even be enough to cover parking in big cities.
      Companies in many areas don't have to pay employees who are out on jury duty, but most "good" employers do pay employees for jury duty, because it's the right thing to do and because they want to encourage their employees to be good citizens.

      You aren't obligated to be at your own trial. It's rude, absolutely, but rude doesn't mean automatic contempt.

      Court can make it a contempt, but it's often not beneficial to getting the trial finished faster. Often the court prefers to just keep going and get it done. Especially when the defendant is already staying in custody - going to jail for contempt doesn't really bother a prisoner much. It can even be a way for the defendant to repeatedly disrupt the process by pausing the trial repeatedly while they're held in contempt.

      Had the jury been present in the courtroom at the time, I'm sure the outcome would have been very much different..Maybe even to the point of declaring a mistrial..
      But since they weren't, (and since Judge Simpson is probably SOOOO over Mr. Blooms antics) Simpson was probably more than willing to just let it go and have things proceed, rather than have to spend any more time wasted onm Mr. Bloom and his antics

    Adjourning the trial because the defendant voluntarily decided to not attend was nonsense lawyer games. Now the jurors have to disrupt their lifes for no good reason. How many more ways can this defendant cause problems for the community?

      The worst of it is the jurors receive poor recompense for their input in the US courts and from the point of view of justice the gap between the trial parts one and two disrupt the process. Bloom should simply been allowed to stew in his cell while the case continued in his absence. The jury and members of the court are the ones being punished not the perpetrator of a further crime.

    I’m wondering if Michigan allows a disruptive defendant to “attend“ trial by way of a breakout room as was done in the Parnell trial. I’m a retired California attorney and did not practice criminal law as part of my usual practice. Nevertheless, for those who are impatient or unhappy about Judge Simpson‘s decision, you need to remember that the more disagreeable and unlikable a defendant may be, it is only prudent to be extra cautious so that an eventual appeal made on the grounds the court didn’t try hard enough to make sure he attended his trial meets fallow ground. For people like Bloom, they have nothing productive to do with their day other than try to find some way of messing with everybody else. The last thing anybody wants is a mistrial.

      Quite beyond belief. I'm sure in most countries the trial would have continued in his voluntary absence. Those on trial in most courts risk being denied the right to attend trial if they don't respect the court. At the least Bloom is showing utter contempt to the court.

      Agreed, but I think Judge Simpson is playing it safe here in order to prevent ANY potential appeals argument. Same thing with the prosecutor, she'd rather adjourn this for a week than have to fight it on appeal, even a bogus appeal; better to play it safe and make sure that the appeals court sees zero potential merit in any arguments for appeal.

      This is a right explicitly laid out in the Bill of Rights. So you can't call him out with contempt of court since it has to do with his rights. The defendant may have had the right to to forfeit his right, but the only precedent the judge found from 1975 said the guy needed to be given a chance to make certain he knew his rights and that he forfeited them with full knowledge. Every trial is full of inquiries to the defendant that he understands his rights, especially if he's giving them up. Those other countries may not consider being present at your own trial a right. I am not going to say that the US Constitution is right in every one of its particulars, but before saying something is wrong about it, one should inquire what abuses such a rule was meant to avoid.
      The fact that it was difficult to find a path forward means this must be a very rare occurrence. Also, this path does take into account that neither side nor the judge want a mistrial, or for the case to be overturned on appeal. I feel sorry for the jury in this case, but the biggest disruption would be to have to start all over.

      The lawyer can’t follow him through that door. That leads to a secure area where there could be other inmates, and no opportunity to make sure the lawyer doesn’t unintentionally bring in potential weapons.

      Mr. Bloom has no medical emergency, he once again needed and wanted attention for whatever and as usual doesn't shy away employing whatever he sees fit, to ensure he will get it, WHEN he wants.
      This man is truly insufferable and from all we have seen, he is not doing well in society or any other free setting for he is a malignant narcissist.
      We need a different solution because the cost this man visits on the taxpayer is no longer justifiable!

    So why does what's fair to the defendant take precedence over what is fair to the people & and jurors when the delay is a result of HIS voluntary actions?
    If it's a concern of appeal, you have it on the record, several different ways that not only was this due to his own decisions, but attempts by both the court & counsel to get him back in were refuses by said defendant.

      I hate to say it, but I think the average taxpayer in his jurisdiction is looking forward to the day when Mr. Bloom passes from natural causes.
      Between all of his time in prison/jail/court, plus his medical expenses, Mr Bloom has cost taxpayers hundreds of thousands of dollars.

    Ok. What about fairness to the jurors? How is it right to disrupt their lives because the defendant is a spoiled brat? An attitude that the judge encourages by catering to him. As stated, he voluntarily removed himself from the proceedings. It’s unfair to the jurors that his tantrum causes them over a week of disruption. What if a group of them said they refused to return? What would happen to them? Bet they’d pay a price. No wonder no one wants to serve. There is fairness, but this kind of catering to defendants has to have a limit.

    That poor jury. I highly dislike the jury portion of our legal system as they are among the last considerations. I have been called to jury duty 3 times. You have to apply for compensation for missed work, which is awarded at minimum wage. They didn't even pay for parking which was downtown and thus expensive. In fact, had I applied for compensation and been awarded such, it would have barely paid for the parking, leaving me making about 30 cents an hour. We are told this is our social duty, and I'm all about social responsibility. However, the consideration given/treatment afforded to jury members is obscene.

      My so called “compensation” from the State of Illinois was $15/day. It barely covered my lunch in downtown Chicago and I got the cheapest sandwich I could find. That was at least 20 years ago. I don’t know what it is now. Fortunately my company paid all employees in full for all days missed for jury duty.

    I practiced criminal defense law. They could have finished this if the Judge decided to continue without the defendant. It's called in absentia. We try entire cases that way. Maybe the Judge was afraid that a higher court would overturn his decision. Judges always worry about the Appellate Courts. They'll get the case back & have to start over. You can also put the guy in a video room in the jail. You can cure what the guy did with a jury instruction (as he did.)

    Jurors are surprisingly observant of what goes on at those tables, and Mr. Bloom's behaviour would not have gone unnoticed, which does not help endear him to them. His not wanting to be in the room suddenly is not going to help him nearly as much as he thinks it will either since the prosecutor is going to have more time to refine her closing statement. Glad Judge Simpson used his time to find case law and precedent to make a plan to move forward if Bloom continues to behave like he's the victim of his own poor choices instead of its architect.

      It’s called MAKING A COMPLETE RECORD.
      The entire trial and all pre-trial hearings are taken down word-for-word by sworn court stenographers.
      THE FULL CASE RECORD (transcript) MUST be complete, coherent, and conclusive.
      The jury’s job is simply to DECIDE the outcome based on admitted EVIDENCE and spoken statements by all sides, AND the latter are transcripted into the RECORD.
      A juror must be mature enough to never come off as “insulted” by either side “baby talking” in opening or closing statements. Voir Dire hopefully would detect this tendency before seating such an immature prospective juror.

    Wasting the jury's time can't be healthy to your case. From my experience many juror's are not happy to have been pulled from their jobs and had their pay reduced to $15 for the day.

    Judge Simpson is absolutely one for the best. He always inspires and enlightens me. One does not dare to disrespect him or his court. He is humorous, but steadfast. His fair, but he can also be brutal when necessary, but always professional.

    There are many things that can be taken away from this video but I'm only pointing out one.
    In the mist of the prosecution's argument the judge buts in and tells her to stop. She has no idea why he stopped her or if she was at fault. She immediately starts apologizing then he just tells her to hold on or something like that and she starts apologizing again while stepping backwards. That's power!
