    I gotta say this is phenomenal advice... I've actually had to use my ccw against what I thought at the time was just a junkie with a knife trying to steal my truck but I also just buckled my 2 little nephews in their car seats in the back seat of my truck. I was actually told by the police it's a good thing you called because we already got a call from someone else saying they just seen someone shoot somebody in the parking lot and they were already on the way. It took a couple seconds for me to make the call because after checking to make sure I didn't have anything else to worry about from the guy on the ground I was checking on my nephews who were obviously crying and scared in the truck. Luckily for me they had surveillance in the parking lot and I just so happened to be parked pretty close to a camera so it was clear as day what happened but I was even luckier that I was carrying because what I found out after the fact was this guy was just paroled from prison for stealing vehicles and he's also done time for messing with kids. I never found out what this guy's true intentions were he never made it to the hospital and I'm glad I didn't have to. I also didn't see anyone else around the immediate area and there wasn't really any vehicles in that parking lot but mine so I don't know who seen what or called the cops and I was looking hard for anyone else incase this guy had help. So I would say just assume you were seen doing what you did and definitely get on the phone with 911 as fast as possible. Great advice and video as always keepem coming brother!!!

      @@4randosutube Very much so... I never carried a spare mag and at that time I just started crying a concealed firearm so some days I wouldn't carry especially when I went to work in the refineries because you have a chance your truck could be searched and I didn't want to chance losing my job or getting blackballed from the plants... I always justified it by literally saying to myself "are you really willing to lose your career for carrying something you're never going to use" and it's true chances of a person being in a self defense shooting is very rare especially several years ago when we didn't have all this crazy nonsense going on in the country. But then it happened on a day I just so happened to have my nephews with me and it changed everything to the point unless there's metal detectors and somebody physically there to arrest me for carrying a gun I'm carrying or I just won't go if I can help it.

      @@DanielBoone337 I hear ya. I work at a sensitive site and do not bring a firearm to work per policy . I am fine with that as it is a very secure site and bristling with very well trained personnel who are very well armed. Outside of that environment I take measures to defend myself. For some time have looked at it from a perspective of… If my workplace deserves the level of protection it receives, then why would my own personal safety be less important or less worthy of similar protective measures when I am away from work?

    • @DanielBoone337
      @DanielBoone337 2 ปีที่แล้ว +2

      @@4randosutube normally at the refineries or plants we will have to drive to a designated parking lot to walk in or catch a bus to the job site and they'll have security guard shacks by the road and maybe 1 or 2 before we get to the parking lot and sometimes they'll want to look through your vehicle (center console, glove box, under/behind seats, ect, ect) and they'll do it on the way in and on the way out. So I just keep my gun on me on the way in, lock it in the truck while at work, and put it back on when I get back to my truck for the drive out. You definitely said it right if the job site is secured I should be able to be secured on my trip to and from work.

    Mas is amazing and his knowledge is a true gift. His content should be mandatory viewing for everyone before they leave home with a gun. There are surveillance cameras EVERYWHERE. It takes a monumental amount of stupid to think one won't see you, even if a person doesn't. Unless your life is in danger NEVER leave the scene of a shooting or car accident for that matter. Always make sure you have your phone, a tactical flashlight and a portable charger with you. A dead cellphone is the same as no phone at all.

    Awesome advice. Leave a paper trail as it were. You're fighting your case the moments that lead to a self defense event and afterwords. First blood, call 911 immediately even if someone else already did. It time dates the call and records what you say. When people argue at trial they're also arguing the appeal. It's difficult to change anything later. If you're the innocent party then act like it. Call for help. Thomas Dutkiewicz

    Mas, I'm finding your scenarios less and less difficult to see a clear path of reactions. I've followed your advise and instruction for long enough now, that as you begin presenting any given scenario I find myself sorting out the mistakes as you go and identifying the correct steps to form a more solid defence in court if not avoiding the need for a trial altogether. Having learned most everything about the defensive use of force from you it's good to know that it is becoming more engrained in me. However, refresher scenarios are always good practice. Thank you. You should not sandbox this concept. A few years ago in Denver, the people called 911 and the operator told them to stay where they were. They wanted to drive to the police station. The other party drove back by and shot 2 people dead while they were waiting for the Police to get there. Situational context is important.

      That's correct, never stay in a bad situation which may result in injury or loss of life. As a teenager I was attacked, responded by beating the attacker, left and went home, and never had to deal with the drama. Years later I became a LEO, and knew I made the right decision. There is NEVER a one solution for everything, it depends on the circumstances. I grew up in a rough neighborhood so I fought often, police were never involved for me to have a record to prevent me from being a police officer. Best advice the morons never give though is avoid fighting to begin with.

    Here, Mr. Ayoob discusses one of the many grotesque perversions of ethics that actually drove me to abandon my legal career well before the usual retirement age. Way back when I was in law school, a professor once asked me what I would do if I had shot someone in self-defense, and I honestly replied that I did not know. She then asked me why I would not immediately call the police if I had acted in self-defense and was not guilty of a malicious murder, and I replied that it would be out of fear that I could be railroaded by corrupt/ambitious police and/or prosecutors who simply did not give a damn about true issues of guilt or innocence, truth vs. lies, or the ethical soundness of my behavior. She then stated that she personally understood and agreed with me, but that maleficent actors within the legal system like to pretend that my failure to submit to their authority and place my life in their miscreant hands means that I am a bad person, and as an attorney I would be expected to endorse the parallel fiction that flight equals guilt. This is pure, sheer, absolute nonsense, and the people who work in the legal system know it.
    Throughout my career in civil practice, this issue of criminal culpability being inferred from someone’s reluctance to be victimized by a corrupt system still intrigued me, and I would frequently discuss it with others. I have often asked people if they would stick around if they had been forced to kill someone in self-defense, and many have replied, “No,” or (like I did years earlier), “I don’t know.” When I asked these folks why they would be reluctant to stick around, they voiced concerns essentially identical to my own, that they would be giving corrupt authorities an opportunity to victimize them when they had done nothing wrong.
    The truth is that flight has absolutely nothing to do with guilt, and the authorities know that fully well. Realizing this, if I were ever to serve on a jury hearing a case in which self-defense was asserted, the flight of the defendant would bear absolutely zero weight in my mind, and I would consider only the specific acts taken in the performance of the alleged crime in question. I know that the real reason that miscreants in the legal system want people who flee to be punished is not that they think it adds to the body of evidence showing their guilt, but rather that it simply defies their authority, and they resent the idea that anyone can unabashedly illustrate how corrupt they and their social presence are by rejecting their intervention on their lives and not be punished for it. The fleeing citizen is seeking to slip the bonds of authoritarian repression, and authoritarians like to smear fleeing citizens in retaliation for flaunting their demonstrable disdain for authoritarian corruption.
    This is such a depressing topic that it has actually compelled me not to carry in many years. At this point, I believe that I would rather roll the dice it’s an attacker than willfully offer myself up as victimized fodder for such a crazed, debased, opportunistic, unethical and immoral legal system as we now have in this country. I should be able to defend myself and leave the scene, attempting to spare myself the ordeal of wrongful accusation and authoritarian persecution, regardless of how much ire that causes authoritarians. That the situation is otherwise really removes a good deal of the incentive one may feel to carry a concealed weapon legally in the first place.

    Good advice, Mas, legally correct. A couple of observations: “If you’ve done the Right Thing, it is assumed you’ll remain to defend your actions.” - except, in many places today, you can expect the politico-judicial system to crucify you for doing the Right Thing, especially if your attacker is the wrong color. Your many stories of righteous shootings where the defender just barely escaped prison after a vastly expensive defense involving the very best lawyers and expert witnesses, tend to make people of ordinary means believe they don’t have a chance. With leftist legislatures tying the hands of our police, many rural folk are making the “no witnesses = no phone call” choice. In my neck of the woods, back when it took a long time to get a Deputy here, locals tended to “kill their own snakes.” I’ve discussed this with my battle scarred ex-cop wife and my school days buddy who retired from 30 years doing The Job for King County. If they don’t want vigilance committees to make a comeback, stop neutering our cops.

    • @dergunter1237
      @dergunter1237 2 ปีที่แล้ว +5

      cops are the ones arresting the people for self defense they are the start of the problem. The cops are also the ones looking away when your store or house gets burned by gov protected terrorists. So neutering cops should be the goal

    • @lanedexter6303
      @lanedexter6303 2 ปีที่แล้ว +1

      @@dergunter1237 cops are people, some good and some bad. My wife was a cop in the 90’s and has the scars (permanently retired a child rapist who stabbed her). When I was doing the small town vol. fire chief/EMT thing I worked with a lot of cops, most good and at least one a true psychopath who bounced from job to job, but remained a cop because of family influence with the Sheriff. Cops DO need to clean their own house. But these days, leftist politics has intervened, and mostly the wrong types are remaining cops. The good ones retire.

    There's a beautiful piano tune called "The Wicked Flee" you can hear it in the movie True Grit.
    8:42 They always say that rather than yelling "Someone call the police!" it's better to point at someone and say "You there! Call the police! Now! Because ."
    It's because that way it puts a lot of social pressure on one specific person to take action, and the surrounding people will expect them to follow through and would even help them get the task done. Whereas the non-specific "Someone call the police!" usually results in everyone expecting someone else to perform the task, so it doesn't get done at all, and if anyone later asks the group why they didn't call the police, they'd just finger-point at each other and shrug saying they thought someone else was better informed or whatever reason.
    9:50 Note that the call logs are not cryptographically signed using a public key for which law enforcement have the private key, so a call log of a 911 call made from a "smart phone" that was not within range of any cell network would not be as strong evidence as this video appears to suggest.

    I don't think I have ever had someone tell me I should leave the scene unless it was unsafe to stay. It is good advice to consider what you will do after a shooting so you have a basic plan and don't get panicked and do something you will regret. Don't over think it, it is pretty straightforward advice. Edit: I have heard of SSS, but that was also usually in jest, I thought. Not a good plan.

    I agree with don’t flee the scene and always be the FIRST to report! First report identifies the victim. If the bad guy flees and gets to 911 first, you become the bad guy, guilty at the very least of brandishing. The single exception to this that I can think of is on a lonely country road or deep into the woods. I travel across the Appalachian Mountains frequently. Those woods are home to all sorts of weirdness. From old fashioned moonshiners to Meth cookers and couriers to serial killers to inbred ignorant punks. I get into a gunfight in foreign, unfriendly terrain, I’m gonna UN-ASS the AO (area of operations) and go to civilization and report it.

    There's some seriously bad advice in the comments. I watched USCCA's BJ Baldwin video this morning, and he left the scene of the shooting. Different scenario...another attacker had fled and he wanted to avoid risking another attack. He was upfront with police and wasn't convicted of anything. The cases Mas shared saw the shooters make some egregious errors in their judgement, initial statements, and defenses.
    Unfortunately, given general society nowadays, staying at the scene for minutes waiting for police can escalate the situation. Look at the Sheriff's Lieutenant in Georgia recently, where a crowd rapidly gathers around the scene. Further, look at Kyle Rittenhouse, who had to defend himself while fleeing attackers.
    I had a negative gun related interaction with the justice system shortly after turning 18. Long story short, going to the range with a pistol gripped shotgun and a j-frame revolver, pulled for speeding, told the officer about the firearms, and was promptly charged with two counts of concealed weapons. This being the '90, I was found not guilty on the revolver charge but was convicted for the scary "assault weapon" and this was upheld with a stiffer sentence upon appeal. I'd still trust police more than luck to avoid going to prison for a justified self-defense shooting.
    Most people these days have phones with high resolution cameras and are quick to start recording as soon as voices are raised. Even if a phone doesn't capture a shooting and the immediate actions of those involved, traffic and security cameras are all over most places. Similarly, a lot of police departments use body worn cameras which can be used in favor of the victim or the assailant depending on the initial interaction. Leaving the scene without loudly and visibly announcing your intent or reasons could result in a conviction. Trusting that you'll just disappear without trace is the best way to make that "innocent young kid" that is bleeding out after violently attacking you the victim and see you lose everything.

      I coincidentally watched this just after the explanation of the Kyle Rittenhouse sequence of events and at the time it had made sense to me that Kyle went toward the police, but then I remembered that everyone has these "smart phones" these days. So according to this video, Kyle should have stayed at the scene and called the police using a "smart phone"? A fairly large number of people in the surrounding area converged on the scene to help. So even if none of the "smart phones" were working for whatever reason, wouldn't it have made more sense to send one of them to fetch the police, instead of Kyle leaving the scene?

    I find it disgusting that a person who has just had their life threatened has to jump through so many hoops just to keep their freedom. What it boils down to is that no one other than the victim is interested in the truth. The police are interested in a quick arrest, the courts are interested in fees, and the prosecutor is interested in a quick conviction so they can get to the next one.

Even several hours later your actions can be explained. Possibly not air tight anymore but much better than fleeing. Hard to overcome that.

  • @stephenrussell2013

    I STRONGLY BOTH AGREE AND DISAGREE WITH MASSAD AYOOB HERE. Boy, this is going to be a hard comment. I like the section where he talked about "If you have to flee". Basically, that dealt with multiple attackers; you took someone down, but more may be coming. In that situation, you need to run like hell, or as the saying goes, "Get off the X". In my personal training, and limited experience; the multiple attacker scenario happens more often than you may think. If you ever have to "take someone down", you need to be aware that the "witnesses" out there may be home-boys to the one you just took down - and they can swarm you quickly. Massad, I really respect you, but staying on the scene (staying "on the X"), could be the worst decision a person could make. The way I view it, a self-defense situation is ongoing until sufficient LE arrives. Until then it is you (and yours) against whatever is out there. I will not wait around to see who (or what) shows up first. First things first, I'm getting myself and my family off the X.
