    Objection: Lawyers are on any and all sides of every issues. Let’s not gloss over the history of the oil industry using lots and lots of lawyers to get to where we are today.

      WELL SAID. At every loop hole money uses to get its way there's a lawyer holding that loop hole open for it to go through.
      In the comic strip "Wizard of Id" one of its main characters is Larsen E. Pettifogger en.wikipedia.org/wiki/The_Wizard_of_Id#Main_characters
      One of his most famous lines is "Every man is innocent until proven broke."
      I once heard (sort of 😉🤫) that the Grand Canyon wasn't caused by the Colorado River it was caused by a lawyer who took it literally when they heard a wealthy client was lost down a rabbit hole. 🤔🤦‍♂️🙇‍♀️

    Part of the problem is that legal systems just aren't built for the kinds of really complex damages, taking place over decades or centuries, that characterize ecological problems.

      The change should really start with the politicians. Lawyers and courts are only there to uphold existing laws, or get around it, but for things beyond that scope, it's on the people that have the power to change policies to act on it.

      With court you have to be very specific as to who did what on a date/time, the damage directly caused and the action/remedy in compensation. It was designed to react to a very direct, provable act, like an individual committing a crime, not deal with things like environmental damage where a lot of people contribute to varying degrees over a long period of time.

      That's kind of the point. A few people, no matter how upset (arguably, especially so) aren't representative of everyone. Making decisions with the support of a large group of people is the politician's job, and the fact that people are pressuring the wrong system just goes to show how warped America has become at responding to reality.

      We had way more plants on earth centuries ago and they've never ran out of CO2. CO2 is hardly the limiting factor to photosynthesis, let alone the other bad stuff that comes with the rise of CO2.
      No burning fuel does not feed plants. Oil extraction is just as bad if not worse than mining for batteries.

    Pretty happy you looked at Canada's carbon tax but you would be surprised by how polarized it all is here. The province of Alberta, next to BC, is suing the Government of Canada on whether or not Carbon Tax is constitutional. 🙄

    objection: i do admitt the fact that lawyers fight climate change, but they are also in the position of the defending those creating climate change, such is the nature of the adversarial system. so not just honnor's here, cant pass the blame to the judges and legislators alone.

    Imagine you live in a house. Imagine you can't move out and buy a new one. You have no choice but to inherit this house once the current owners die. Now imagine that you are powerless as the current owners constantly wreck the place. Put holes in the walls, release termites, smear shit into the carpets, etc. Every time you plead with them to stop, they spit in your face as they light the furniture on fire. That's what being under 30 in America is like.

      That's how screwed up our system of government is. Since we have only two parties, it's always going to be relatively close to a 50-50 split of seats in the Senate. And if you have between 41 and 49 of those seats, which is all but guaranteed for the minority party, then you can filibuster to keep the majority from doing anything. Oh, and also, because of the dumbass way we allocate Senate seats, it's possible for the majority in the Senate to come from states that only account for like 18 percent of the total US population.

    As a climate policy analyst in the US, I’ve mostly viewed lawyers as an impediment to change rather than a conduit for change. But that’s because both sides have lawyers.
    I do appreciate my colleagues who have gone or are going to law school to become environmental lawyers-I trust them, I don’t trust the rest of the legal community.

They tell you that 0.0004 percent of the atmosphere will destroy the world if it climbs up to 0.0004 and that has they claim is so bad for the environment is crucial for plants to grow, which means if you reduce co2 you’ll reduce plant growth and then you’ll introduce starvation.

      If what you want is specifically policy analysis and to really crunch the numbers, my recommendation is to take courses in economics (econometrics, natural resource economics) and statistics. At least try that out to see if you like it.
      Personally, I ended up disliking the data-heavy components and have transitioned to a mix of analysis and advocacy, focusing on mobilizing the private sector through green finance and international policy.
      The stuff I do is more qualitative with a good understanding of stats, econ, and accounting. A lot of policy memos/proposals. Basically, I inform decision makers using other peoples’ data crunching efforts.
      If you’re looking for school advice, I double majored in Environmental Science and Economics, and then went to a graduate program in environmental management-I think Yale, Duke, and Stanford are currently top rated-and a lot of those programs let you pair the degree with a law or MBA program (those obviously would only be worth the money if it’s a top 20 school, and I didn’t do any joint program).
      Finally, I really think networking is key for higher-level jobs in this field. Especially if you want to work in DC, it can be hard to get a foot in the door without a contact. So when looking for programs and classes, check out who the professor knows and works with, then try to work with that professor to build your network.

      @@darksideblues135 the whole plant food argument is a half truth. Under controlled conditons, this is sometimes true but plants can't survive on CO2 alone. Warmer temperatures are also shown to reduce the rate at which plants absorb CO2 so it's still not a good thing to increase the atmospheric concentration of it significantly. Finally, the argument that since CO2 is a small portion of the atmosphere, it doesn't have a large impact on climate is not true. It blocks the wavelengths of IR which other gasses don't allowing for warning by reflecting IR back towards the surface. Water vapor, which is a greenhouse gas and makes up much more of the environment will enhance the warning caused by CO2 because warmer air holds more water vapor. You should do research instead of just spouting talking points.

    My daughter would love for her job to be obsolete! It's basically cleaning up after climate change worsened messes. She's a lawyer with specialties in environmental and international law, currently working for her state to help municipalities get FEMA money after disasters. There's never enough time; the work has become endless.

      In Canada they tried implementation of a vacancy tax because a lot of property is owned by Chinese investors. What they ended up doing was allowing Chinese students living in Canada to stay in the house to avoid the tax

You don't have to dig very deep to find stories of people in Vancouver and Victoria being priced out of a place to live. Meanwhile whole neighbourhoods of multi-million-dollar homes sitting were empty and rotting as asset shelters from Chinese tax laws. Wherever those students were renting before, someone else will be able to stay now.

That was suggested by two scientists in the 70's who's work was eviscerated in peer review and was only picked up by one article in a paper with no scientific credibility and soundly and immediately debunked. Global cooling was never the scientific consensus and never put forward as a realistic possibility by anyone but those two hacks.
      When you suggest otherwise I can only assume you're deliberately lying.
      Also climate change is occurring as predicted by many models. Including models created by scientists employed by fossil fuel companies decades ago. Models who's studies they suppressed for decades. You're a complete fool.

      An argument could be made to force me to buy a car with catalytic converter to reduce my impact on polution.
      But there are lots of other problems. Where to store all the energy? What if someone doesnt have the capital to pay for a house with solar?
      We could store it in a centralized location, but then who would pay for it?
      It looks like a clean solution, but its an invitation to a lot more problems.
      A better solution would just be removing taxes on solar, thus creating the incentive for it without the need to force it.
      Other thoughts: bureaucracy is inneficient, how the hell is the gov supposed to find out how many power i need or shall need?

      @@MrFujinko tacked on to the front end of a 30 year mortgage it makes financial sense to me. They last longer that it takes for them to pay themselves off, and adding the cost of the panels over 30 years is less than $100 extra a month. The law doesn't force someone to retrofit an existing building even as a condition of sale, it's just most new buildings need to be built with solar.

    Unfortunately I believe that there is a significant incentive for those parties already invested in inner city real estate to lobby against removal of zoning laws, simply for their own profiteering purposes. A fair amount of the barriers that stand in the way of effective climate legislation seem to be due to landowners / company boards trying to squeeze as much money out of us as they can.

    Legal Question: In Criminal Law, often times the "Victim" is represented by the community at large. District Attorneys officially represent the state or the city or whatever subset of community. So, for environmental law, is it ever possible that the plaintiff would be "The Earth"?

      "The Earth" is not by any definition a legal person, so nope.
      I'm guessing when you say the 'victim' is represented by the community at large, you mean that the criminal is brought before the court because of a law of society, rather than a civil charge made by the victim. So for this to happen in criminal law, the perpetrator has to violate a criminal law of the state making the action a crime against society, which means that in all criminal cases the case is still about the state and its citizens/jurisdiction, and not the planet as an entirety.
      For that you'd need some kind of global criminal law, only then would a 'crime against the planet' make sense, but then you'd still be talking about its inhabitants and not the object 'Earth'.

      Not a lawyer and just going out on a limb here, but... I'll bet most national courts would claim that either the court doesn't have jurisdiction, or that the litigants don't have standing, or both. If we had a functional world court instead of the various "non-binding" clownshow courts, it seems like your idea would hold water. If the Planetary Prosecutor is bringing a case in the Earth Supreme Court, then it seems like it should be "The People Of Earth vs. Defendant" like any smaller jurisdiction does.

    Next year I will actually begin law school at your alma mater with a focus on environmental law. I have a multiple degrees in environmental studies and the more I learned about what was happening the more I realized that the law and legal processes was how I wanted to enact change.     In Wisconsin, there's actually a hefty fee on your yearly vehicle registration if you own a hybrid (or, I assume, a fully electric) because you aren't paying as much in gas taxes as people with fully gasoline-powered vehicles. Incentive to be less environmentally friendly!

    Can you do a video about the animal agriculture industry and how they are linked to climate change also how they are a steadily declining industry yet they get bailed out constantly by government with subsidies, and how 80-90% of the rainforest destruction is directly caused by clear cutting for cattle raising and the monocroping for feed crops

    climate change has been much more devastating in some regions. This winter it didn't snow in the city I live, but I remember when I was a kid the snow was like 30 to 50 centimeters in the City and much more in rural areas. Right now because of the lack of snow, many rivers and springs have been drying and many are now gone.

      As a question, do you buy anything imported from Asia? The cargo ships that carry everything across the pacific produce more greenhouse gases than all the cars in North America.
      One of the few good things about the pandemic is that many of the older ships are being scrapped, but the collosal fuel hogs are still going.

    You need help from lawyers, and the lawyers need to be environmentally conscious, then they need help from politicians, and then in turn they need to be environmentally conscious.... and you really need USA and China to lower emissions, then it really means, slow down growth and suffer, of course every step is one big impossible mission.     Please do a segment on “natural personhood”, which is environmental lawyers’ answer to “corporate personhood” - aka the ability to sue on behalf of natural landscapes, which are individual entities with protected rights. New Zealand and several other jurisdictions have successfully used this tactic to fight climate change. It’s time to think outside the box and change people’s thinking when it comes to nature.

    Meanwhile accountants are pushing their clients to use on site solar with panels on the roof of factories - so grid power consumption decreases. Good for the environment and its cheaper in the long run. South Africa has a nice tax incentive on photovoltaic solar generation.
