    A conditional green card allows a non-citizen to enter and stay in the United States after marrying a US national. Conditional resident status is valid for two years, and the non-citizen spouse must apply for removing conditional status on the green card within that period.
    What will happen to the conditional green card or residential status if separation or divorce occurs within that period? Does it mean the non-citizen will be deported? Will it impair his or her ability to apply for removing conditional residency? Does it stop him or her from getting permanent US resident status?

    thank you for the informative exposition. i had a question, i understand that i-751 waivers can be filed at anytime especially after you get a divorce decree, but can one still decide to wait for that 90 days window before filling if they so desire? or what are your thoughts? and in this case, does the 18 months extension does it start counting from the date of green card expiration of the date of filling?

      18 month extension starts from the end of the green card.

    Me and wife we file removal of condition i751 after 5 months we have Wvrytime argue and we separated. I try many times to comeback but not work out. My question is can still get my 10 year green card?

    Hi, i am filing for divorce and am in the process of mediation currently. My husband and I fell in love in grad school, after couple years of dating we got married in the US, had our big wedding celebration in India, bought our first house in texas and then it all fell apart. We did not marry for immigration purposes and can prove that easily.
    My question is, can I mark divorced on the document to remove conditions off of my green card and have my soon to be ex-husband sign it to validate my situation? I saw in one of the comments you suggested a lady to not sign on the form as she is unwilling to help her ex husband's immigration case..

    Mr. Zavala, I would love to see videos on what the US spouse/sponsor can do in these situations. My immigrant spouse became abusive to me, carried on an affair, was secretly funneling significant funds overseas, and I suspect married me in bad faith. Can I prevent her from removing conditions on her conditional 2-year visa in our marriage-based adjustment of status case?

    Hi Attorney Charles, please I have a question, I have a 2years green card and am married in good faith and I love my husband so much but I always have a problem with him because he want me to use my documents to buy him a GUN 🔫 and I said NO, this is the second time he is asking me to buy him gun with my documents and we always have issues and he threaten to divorce me. When I met my husband, I never knew he was a felon and he do not have the right or permit to carry a GUN but he has about 4 guns right now and he still want me to buy him 2 additional Guns with my documents and I don't want to buy any Gun in my name.
    Please I do not know what to do kindly advise.

    I got married to a US citizen and after 1 and a half years we split up. We were currently procession the adjustment of status and were only waiting for an interview. Unfortunately it didn’t work out do to a domestic violence case, so I filed for vawa and while my vawa was still procession USCIS sent a letter requesting evidence for the validity of the marriage and also my physical exam to finalize a decision in my case. I got a 10year greencard without interview and now I don’t know what to do because I have a 4 month pending vawa case. I’m currently not divorced but have started divorced procession… what gonna happen? And what should I do ?

    Hello thank you for the video. I am going through a divorce and my ex has a conditional residency. My ex’s lawyer emailed me and asked if I object of him helping my ex with his immigration case? Why is he asking that? I don’t plan on helping him and we have no children, house, or cars together.

      He is probably asking if you would be willing to sign the I-751 Removal of Conditions form. If you two are getting divorced I would not suggest you sign that document. Signing that document is YOU consenting that you are still married and that he should have his conditions removed.

      Don't sign shit, alot of them only marry people to get a green card and immigration need to come up with even stricter laws for such people. 🙄

      @@ZavalaTexasLaw yea and if she doesn't sign it he will have to pay his lawyer even more money to help him get the conditions removed I'm thinking and if that's the case so be it. Some of them don't deserve no damn green card. Only coming to the U.S. to get benefits.

    I just have a question if anyone can help me please answer?
    I came to The USA 5/12/2017 on K1 visa
    I got married with a US citizen
    We have 2 kids we live together everything is fine but on 2019 we got in argument she called the police I was charged for domestic violence and assault but the case was dismissed
    Now I have to remove the condition of my green card do you think I’m facing a problem
    Even if the case was dismissed and we are still married???

      You can still show proof other ways... joint bills, lease agreement, taxes, etc
