  • The number of digital accessibility (a11y) lawsuits in US has increased almost tenfold in the last decade. And so it's time to revisit the industry standards and the not-so-pleasant side of legal issues that come with poor product design strategy and priorities. Inclusive design is no longer an optional treatment for certain experiences, and as such product teams must focus on building accessibility-first products and services.

    When I was with an agency, a client of ours lost a color contrast lawsuit. We had to introduce a web-specific color alternative to their primary brand color. Short of it, orange is a terrible web color for accessibility.

    these lawsuits are predatory and not usually in the best interest of those with accessibility issues but more of a easy way to GREED

      the data shown definitely shows a vigilante approach to this "10 plaintiffs filed 42%" of the lawsuits

    "We target only a specific segment of the market": there are people with disabilities in every age group or demographic group. Saying that people with disabilities aren't part of the market segment you are targeting comes down to confessing that you discriminate against people with disabilities.

    The new California law is so vague and subjective that if they want, they can file a lawsuit for literally anything. This will bring more damage than good. It will be exploited by trolls to make easy money. I’m getting my E&O insurance ready as a dev.

    I agree with this for websites that are government-related, esp those that are providing services. We all should be trying to be accessible, but overall, private businesses should be exempt. (and their own decision if they want to lose potential customers). This is just more government overreach by dictating these rules.
    And those accessibility overlay tools are absolute shit. Surprised no one has bothered to sue them.

    I'm not going to sue you 😂 but the "get notified" button has a contrast issue. I'm talking about the buttons"Like" , "Subscribe " and "Get notified" which comes in your video.

    I love your channel, i recently finished a bootcamp and immediately got my internship. It is hard to find a good UX content as i like that part more than UI, but your content is serious and provides me with some good daily bits of new knowledge.

    I just wish websites/software would stick with legacy looks, far simpler to make accessible and it's easier to navigate for regular ppl too. Modern software UI loves to triple space everything, waste tons of space and make buttons huge.

    Can a design of a digital agency website be prone to get lawsuit filed against them??

      Potentially, depends on severity and what users/customers tried to achieve. The bigger and maybe only case could be exchange in value. Btw anyone can file a lawsuit against anything/anyone it doesn't mean there is actual merit.

    "we don't market to disabled people" is the worst take ever. "disabled people" is not a niche, it's not specific enough. imagine saying that your target demographic is college students who travel, then saying "disabled people not included". but how? there are disabled people who are college students and disabled people who travel. disabled people do so many things. there are so many disabilities to think about. 1 in 5 Americans are disabled. this covers SO MANY ages, severities, and types. just sounds like a load of bigotry if you ask me

    Whilst I agree with the premise of adhering to accessibility guidance for some sites, I think allowing people to sue for damages is simply going to make an industry for those feeling slighted. Forcing behaviours is like something from Blackrock's wet dream. Agreed that mandatory services should have strict adherence, but considering they are usually government services, they SHOULD abide by their own laws. But for small businesses, this limits their potential to grow, by catering to a possible 0.0001% of their customer base. Catering to everyone, often leads to user experiences which appease no one.

      Dude, I saw your comment on my post. Imagine thinking that the term "disabled" means quadriplegic wheelchair user. Disabled means nothing. Diagnosis means everything. This is why it's bigotry.

    Your conclusions regarding the drop in legal claims brought forth by Florida are incorrect. It has more to do with the growing mindset in that state to disregard the rights of others that require accommodation. They consider people who need accommodations to be weak, and in their opinion catering to them will only make them weaker. Sadly, it's all part of the "Pull Yourself Up by Your Bootstraps" authoritarian mentality that is prevalent and growing in Florida.
