सरजी ! नमस्कार 🙏 हमारे एक रिश्तेदार ने हमारी माताजी से एक भूमि को 30 वर्षों के लिए पट्टा करवाया था। माता जी का अब देहांत हो चुका है। पट्टे को 6 वर्ष बीत चुके हैं ,अभी तक उसने न तो माताजी को किराया दिया था और न ही माताजी के मरणोपरांत हमें ही किराया दे रहा है। पट्टा लिखने में भी धोखाधड़ी की है,पट्टे की भूमि से लगे हाईवे को नहीं दर्शाया था जिससे उसका किराया भी कम आंका गया था। उस भूमि के वारिस के तौर पर हम उस पट्टे को कैसे निरस्त करा सकते हैं??
Since it is a registered lease deed it can be cancelled through a registered cancellation deed. The cancellation has to be bilateral. The tenant should personally sign the cancellation deed which you can then present for registration in the office of the sub-registrar. since he has not paying any amount, please initiate the Legal procedure through an Local Advocate u will get your property back, and always put valid clauses in any agreement, that non payment will terminate the agreement please File a Case after giving him Notice wishes
lease is for a period, if u dont complete a period or u vacate the property it doesnt effect your payment schedule in your case, u wont be able to get any refund
yes, u have to cross check that he is a valid holder of power of attorneyand u should ask with real owner also that u have connaivance or not.to be extra precatious u can request him his declaration on a stamp paperwishes
