    If you can, can you kindly cover divorces in terms of customary marriages. And how pre-nups could apply if people enter into customary partnerships. I'm struggling to put this they way i want you to receive it, but I do hope you get me..

    Thank you for talking about this. Sadly in Africa and Asia (I’ll speak for Thailand as that’s where I’ve been) dupes are so so much but we have bigger problems to deal with right now than confiscate those due to corruption but overall it’s good to see places like eBay, Alibaba and AliExpress caught up real quick to ban them.

      Thanks for sharing this 🙌🏽 yes, we really need to talk about the unlawfulness of selling replicas/ dupes under the guise of “Great quality” when these people are committing a crime.

    Very interesting conversation. Never even crossed my mind that there's a legal element to these counterfeits especially considering how popular they've become

    Very informative video indeed. Intellectual property law is a speciality area that most attorneys (including myself) rarely go into. Thank you for sharing your insights into IP law. 👏🏾

    Great topic. The price difference between the parallel imported goods and “others” is massive.

    Nice topic, Africa is a great market for counterfeit goods. Unfortunately there is nothing that can be done by law enforcement to prosecute those who sell fake goods. What some smart companies do is blurring and they make products which closely look like an original luxury brand for example Zara.

    7:51 you're speaking the truth Atlegang There's a lot of complacency and corruption Studio 88 has been allowed to operate unabated for years and years with literally no blowback... In South Africa we're being taken for a ride, an unsolicited one at that!🤞🏾🤣😂😭

    This was so informative! Now I'm so curious about these "look alike" fashion clothes that mr price and Steve Maden sell. MrP sells it for R250 while SteveMaden sells it for R2500 but the original item costs like R25000 I'd like to know how they legally get away with.

      Perhaps I’ll do a follow up video or shorts on this one. But the short answer is that, Mr Price isn’t committing a crime because they only copy designs which can be argued to be quite common. They also do not use SM or LV logos on their products so they are not infringing anyones trade mark.
      I’ll expand on this in a video

    Hey
    Can we touch on the current trend where people get touched because their designs are being copied. How do they go about copyrighting a wedding dress design

    There are influencers who promote these counterfeit designer items... I've always wondered whats the law on these.

    • @atleganggovuza6733
      @atleganggovuza6733  2 ปีที่แล้ว +2

      Eish tricky coz I don’t want to involve influencers lest I be attacked. But it is unethical to buy/ promote counterfeit goods. Not illegal but unethical. But the people selling them? Definitely committing a crime 💯

  • @mphonyatlo
    @mphonyatlo 2 ปีที่แล้ว +1

    Isn't a Dupe a copy of the design but you use your own logo like what Zara/MrP etc are doing? Then Replica is when you use the design and logo of someone?🤔

    • @atleganggovuza6733
      @atleganggovuza6733  2 ปีที่แล้ว +1

      I’m not sure of the difference between dupes and replicas but on your interpretation, my discussion is on counterfeit goods = replicas. The emphasis should be on counterfeit goods, being the infringement of another persons intellectual property, more specifically trade mark.

      You are correct. A dupe is inspired by...a counterfeit is an exact copy including brand name.
