    8:26 Not sure if Simon realised this in post, but it sounds like it was more than just the juror needing to get married a little later and at a venue different from their original choice. From the sounds of it, jury duty straight up cost the juror their marriage - as in they didn't get married and the relationship fell apart - due to their serving jury duty and the disruption is caused in their life and relationships. That's why it got lumped together with the people who lost their jobs and placement in university.

      @@ceeno9042 Do you know how expensive weddings are? Depending on how many reservations were nonrefundable, the couple could've been out $20,000 or more. That kind of financial stress can kill a relationship, even if it was previously solid. Imagine pouring your savings into this and losing all of it. Even if it's not the woman's fault, I can imagine why her fiance might've felt some resentment

      @@lanfae9353 I'm of the opinion that if you're setting up *non-refundable* weddings, well ahead of time, and you're not able to weather any potential financial problems that could result from it, you're not planning responsibly to begin with.
      Weddings CAN be expensive, but they are not de-facto expensive.

      @@Jaccep Yeah, I mean, ideally you'd communicate with your fiance to work things out, and if some money was lost along the way, plan a cheaper wedding for the reschedule, but don't forget, they probably couldn't even talk to each other for most of the time she was gone. Depending on how high-profile the case is, they can force the jury to stay in hotels and have only limited contact with family. So that would make it hard to communicate and sort out any misunderstandings or resentment about the whole situation. I don't think the fiance was in the right for leaving her, but I'm just saying I can understand what sort of position this put them both in, and the court should've been forced to pay out compensation for the losses all those jurors experienced.

    I've gotten jury duty notices a few times and got dismissed as soon as I tell them I do securities litigation consulting. They don't want people in a jury that have knowledge of the legal system. The dumber/easier to sway the better

      @@matthewgeorge234 I've only seen a handful of academics get jury duty. Most of us would happily serve but if they can get rid of anyone knowledgeable about anything, they try to. My PhD advisor ended up serving on a case once and it is one of the only times I have ever seen it happen. He's a genius and I wonder if they just asssumed he would be a fish out of water in a murder trial since he researches physics. While it is true that being an expert on a niche physics topic makes you an expert in nothing else, being smart and hard working enough to get a PhD tends to come with the ability to listen to biased arguments, consider your own biases, take decent notes on boring subjects, and make some level of hypothesis about where your vote should lie based on the jury instructions the counsel will basically spoon feed you.

    I honestly was excited to be on a Jury. I was hoping to nullify if there was a victimless crime. But it ended up being a violent felony, and the guy admitted to the requirements on the stand. We convicted him in about 5 minutes on the first charge.

    I was always a little on edge with the whole "just tell them how you're an asshole" line of thought when it comes to getting out of jury duty, and now when I get called to jury duty I tell them im really excited to sit on a jury and cant wait to do my civic duty! I've still never never sat on a jury.

    My dad was once being considered for jury duty and the Defense lawyer asked him if he believed in “street justice”. He replied “the law is the law” and they immediately requested that he be replaced. 😂

    I've had to serve on a jury before, and I didn't try to get out of it. Mainly because if I ever happen to be on trial myself, I would hope that the "jury of my peers" actually includes my peers and not just "the people who couldn't figure out how to get out of it." Some of us crazy people actually want to do our civic duty. I know, crazy. lol

      Maybe I can cheer you up further with a little anecdote.
      A couple of years ago I was pet sitting at my brother's and his girl cat informed me that it was dinner time. As I was opening the tin I decided to entertain her, and began to sing for her.
      She was stunned; she went stiff and folded her ears back as a look of horror was plastered over her little face, with eyes staring in the distance and her mouth agape due to the audial torture.
      After a minute or so she regained her composure and set off, far away from the horrors in the kitchen.
      I promised her to never ever sing for her again, but I have considered making mix tapes of me singing and selling theseto people who do not want the neighbours' cats loitering on the property. Any time a cat approaches, the neighbourhood is filled with my "singing" but the cat would run away ASAP. Of course the human neighbours might find this a tad annoying too, but, oh well. The best thing that I wouldn't really have to care about holding a tune or knowing the lyrics as long as it sounds godawful.

    I got called for jury duty this year. On the reply I just checked off a box that asks if I have a mental or physical condition that would affect my ability to do my duty. I just checked the box "yes" and they move on. It says they may check up on this but usually just take your word for it. They do make accommodations for disabilities to fit your needs, but I am a homebound agoraphobic and I was mid medication change, so suddenly having an emotional meltdown for no reason would have been not great. This is Canada, btw. I thought they would need my doctor's note for proof, but it seems like they changed that requirement during the pandemic.

    I've sat on quite a few juries. I find it fascinating, even though it's a lot of "hurry up and wait," but I worked for the military for 22 years so I'm used to that. One of them was a murder/arson trial, and the prosecution absolutely didn't prove their case. This was decades ago, so I can talk about it now. Also, don't knock us grannies (and us ladies who are granny-aged but not grannies) because a lot of us have learned how to spot nonsense from light years away. Since I'm retired I'm a good bet for juries, unless they don't want someone smart on the jury. A good way to not fall asleep while on a jury is to take very copious notes. Oh, and Simon - my husband plays Sudoku. He's a big brain.

      Too right about our oldies. My ma is still working in antenatal clinic at 72 and is valued so much by all her student nurse and midwife students. A mind sharp as a tack with 50 years of active nursing experience goes a long way.
      Yes they slow down and the generation now that age didn't have the exercise and health advice my GenX generation started getting so they're slow and stiff but not the mind.

    I served on a jury once, I rather enjoyed it.
    Everyone knew what they were there to do and got down to it, everyone took it seriously and approached it professionally, plus the jury members got to know each other a little and that was fun. Different people from different walks of life. People you may otherwise never have met. Its one of those times where you see people pull together with a communal understanding, knowing that what we're doing in that room matters and has someone else's future in our hands. Seeing the other side of the law system that you never see... not even in court dramas!
    Talking to the Tipstaff (the judge's right hand man, he handles the jury among other things) and he mentioned that you need 20 years military experience to be a Tipstaff! He served as a peacekeeper in Eat Timor! Also, that the longest case he'd been on... 18 months!!
    Despite the case we had, it was a great experience. Learning something new, seeing something new, and certainly something I'd do again.
    The case was... drumroll please.... multiple sexual assault and rape of a 12 year old girl.

    Heh, back in the 90s, I was on jury duty and there was a panel who'd been hearing a fraud case for more than 18 months. I don't know what the verdict was, but the 12 of them did establish a great deal of camaraderie and rapport. They all sat together for lunch, and not one of them talked about the case outside being sequestered in the jury room.

      Yeah I've done it too just for the experience, also cuz I thought it important to " be a peer" cuz the person on trial was in my age group and nobody else selected for the jury was so I thought I owed it to the person and also as my civic duty if I was ever in their position I'd want to see someone my own age it was really interesting and by the way I graduated top of my class some of us actually do feel duty-bound it's the right thing to do 🤓

    My reason for avoiding duty was so great a judge had to meet me.. they ACTUALLY wanted a 36 week pregnant woman to sit Dury duty.
    The judge was a little astounded I said I was willing as long as when I went into labour they allowed me to come back and breastfeed on demand...
    I got released.

    Just recently in Australia we had a rape trial get dismissed because one of the jurors did their own research at home, printed it out and brought it in for the other jurors to read. As a result, the victim faced the prospect of having to go through all the stress again, with MSM (it was a political staffer raped by another political staffer so was high profile) constantly attacking the victim.
    I'd like to know how much the guilty juror was paid to force the trial to be abandoned (Allegedly).

    It is SO incredibly easy to "get out of" jury duty in America that EVERY person I've spoken/listened to discuss their attempts at making it onto the jury after a summons has been unsuccessful in doing so... I can't imagine what the criteria could possibly be, given that the folks in reference tend to be bright enough to understand how to appear unbiased... but maybe those working in the court system are so bigbrained that they can see through that and are looking for something different

    I remember the Jury duty I couldn't get out of. Normally this is the only time I used disability to get out it's 90% effective. Apparently there was someone who was worse than me and it was coin toss. My own mom got a jury duty and I had to go to the jury selection office to explain why she couldn't make it. Well being dead was the first reason why and second she was cremated ash. The office person asked me if I was sure she was dead even with a death certificates.

    The writing was great, and dripping with snark. It's unfortunate that the names of Gillian Guess and Peter Gill are easy to get confused with each other, which kinda derails the story a bit, but the trial against Guess afterwards was a pretty big deal and set legal precedents in multiple areas of Canadian law.

    Simon I have to just protest on the matter of Pink Floyd, the Wall, which you were singing. Its about the British school system crushing the individuality of children. That's why the chorus you were singing drones the way it does. Its an artistic choice. Its not representative of the artist's work himself.
    Another crimeshow meme I wholeheartedly approve of, Criminal Minds is good at first, but it gradually becomes more and more focused on plots involving the characters rather than the criminal psychology. And there went a perfectly good series that fit your casual criminalist rule "CSI not Saw" even more than CSI does. Mandy Potimpkin (sp?) the actor you showed, was also of Princess Bride fame. And I was so upset when his character Gideon left the show. :( Gideon's faith was broken by an asshole serial killer named Frank. Though he was also traumatized by killers repeatedly using God or the Devil to justify their crimes. Criminal minds is getting a reboot, and the plot is going to be that a network of serial killers formed to work together during COVID. Can't wait.
    Simon... simon... homie... simon... listen to me... I have a little secret. AMERICA'S JUSTICE SYSTEM IS RACIST! Its like Austin Powers with his coffee IT IS SHIT AUSTIN! There are all these little rules to both the legislative and judicial branches that allow for extremely racist decisions and laws that can still persist to this DAY. If you want an example of this haunting American politics in the 21st century still look no further than a little rule in our Senate called "The Filibuster." There's a reason why I tweet "Fuck your feelings and your Filibuster" to republican senators so much. Its because it was originally meant to prevent laws that were racially just from getting out there and it became a way for scared old white men to air their grievances that nobody else cares about. I desperately want to see it gone and to laugh in Mitch McConnell's turtly face when his platform for being a whiney little manbitch is taken away. And he IS a whiny manbitch. Him and that turncoat Joe Manchin need an attitude adjustment and because of their social standings neither are likely to get it. The filibuster requires that most forms of legislation (and you get a few exceptions per year), get a 60/40 vote instead of a majority vote. Environmental and social justice related bills do not qualify. Which means just about any bill that could make things easier in the United States for poor people like me is nearly impossible.
    What bills are allowed, such as spending, Build Back Better or the Inflation Reduction Act, you only need one or two people to decide they don't want to work with the rest to completely tank it. In this case Joe Manchin (West Virginia, but not a mountain mama) and Kristen Sinema (a big pharma shill) tanked some of the most important parts of the bill. Now we can't stop drilling for oil in ANWAR, which will destroy its ecosystem, and big pharma can charge medicare whatever the fuck they want for insulin. Do yourself a huge favor, if you move to the USA, take extra care of your body because if you or a loved one get diabetes and need insulin, there goes your disposible income. Or don't move here, that would be the safest bet. Kristen Sinema was so reviled because she paid lipservice to Progressive Democrats to get into office and then turned around and did Big Pharma's billing instead. She openly LIED to her constituents to get into office. Her recent move to go Independant is a last minute play to save her neck now that democrats have a slim majority in the Senate. Either she or Joe Manchin no longer have bargaining power. So she's going to have to either give in to the progressives she pissed off and lied to or move camp. In the Mexican Standoff, she blinked, and in the American political system, third party candidates never win. Instead they take votes away from a side causing the other one to win. Which means she is now a professional wrench thrower. She can't do anything else.
    Aaaah Arbury, peremptory challenges couldn't save these three dicks from serious hard time.

    I got out of jury duty by telling them about my PTSD. I grew up in an abusive household and every time the cops were called, they sided with my parents. I don't trust law enforcement anymore.

      I get rejected because I was victim of crime as a child. It’s an automatic dismissal despite that I am very open minded. Working as an ER RN exploded me to all kinds of people from all walks of life. You wouldn’t believe some of the stories and totally hard to believe experiences they come in with.

    I have been called (and dismissed) from a couple of big cases. Well, one was a change of venue from Tarrant County (Texas) that was a rape/murder case. I was dismissed because I knew too much about certain parts of sentencing. The defense was going to try for an insanity plea and I knew what that meant. The JUDGE leaned over and asked me how I knew so much. Well, I have an interest in serial killers... don't judge, so did my wife. The other was a retrial that actually lead to a change in explaining sentencing in Texas, explaining what lengths of time would be associated with the sentence. However, because the first trial was so public and the State agency I worked for at the time was partly involved (not in the actual trial) I had read everything that the clipping service had given the agency. I was dismissed because I knew too much.

    I actually want to be on a jury, it sounds interesting to see it from that side of things. The only time I was sent a jury notice, however, I was still only 17, so I had to tell them I was not actually eligible. My wife is currently "on call" for jury duty, but I believe her term is up at the end of the year, so I don't think she's going to get called.

    2:10 -- The jury serves as a finder of fact in the case. When the jury "gets it wrong" then that's indeed the legal outcome of the case, but it doesn't change the actual facts behind the case. When they "get it wrong" it means they came out with a verdict not supported by, well, reality.
    It happens all the time, and it's not terribly amusing when it's a criminal case and they find an innocent defendant guilty. Sometimes it's due to police or prosecutorial malfeasance (incompetent investigation, lying on the stand -- cops do this literally all the time, and everyone knows it -- or concealing exculpatory evidence) but sometimes the jury is just stupid or bigoted.

    My husband has jury duty coming up… luckily it’s for off season at work. Some states pay $50 a day for jury duty, but that’s $300 less than what he makes in a day at work. He’s my 24/7 carer right now since I had major knee surgery that’s left me basically completely immobile. But he’s going to try to go, it’s better now than during the summer.

    I've gotten dismissed from Jury Duty 3 times. Lawyer calls my name asks me if I'm that [Last Name]? I follow up with yes, and they tell me I can leave. If you aren't lucky enough to have a name known in the court system; stress your excitement and enthusiasm in the court process because all you do is watch court room dramas and listen to crime podcasts, you will likely get dismissed as to not pollute the jury pool.

    I’d like to serve on a jury at least once, if just for the experience. I’ve gotten a jury summons four times. The first two times were while I was in college, so Not Available. The other two times were in the last several years, and both times when I called the day before (which you do to see if you are actually needed) the automated system said “Nope, don’t need you tomorrow. Thanks for being available, and your service is considered complete.” Which is unfortunate, as my current employer pays you for 8 hours each workday you’re on jury duty, so I wouldn’t have to worry about paying bills with the nominal juror “pay”.

      Any trial requiring a jury does indeed have the verdict set by the jury. They have parameters based on what charges are being pressed, so they can't just randomly pick a sentence.

    It boggles me the Canadian criminologist was allowed to sit given her work with the RCMP. I'm a sheriff's deputy in Texas and my department provides court room security (bailiffs). I got called to jury duty twice since I joined my department several years ago. I was dismissed the first time when all the courts with pending trials got their needed jurors. A senior bailiff told me then it was unlikely I would be seated for a criminal trial for obvious reasons. However there was a decent chance I could be seated for a civil trial as civil lawyers consider cops better judges of character.
    The second time I was called was a few years later. At this time I had worked a year as a part time bailiff and got to know a few judges. I got to the assigned court and I knew the judge. The judge ended up dismissing everyone as the defendant pled out. He did recognized me thanked me for answering my jury summons. He did acknowledge he would have dismissed me due to being a cop and former bailiff. I wonder how much that criminologist used her status with the RCMP to sway her fellow jurors?

    I got a court summons at the start of the year. Then they canceled it but kept me on the role.
    Then summoned again but I managed to postpone it for 3 months
    Got another summons then had covid
    Got yet another summons so I showed up. But they ran out of cases before they ran out of jurors so I got off jury duty. They can't legally summon me for another 2 years and the likelihood is supposed to be low but this year's summons was 2 years after my last. So someone is obviously hell bent on getting me into a trial

    Answering Fact Boi's questions:
    1:51 The jury are "finders of fact"; they're the final word on what happened. Appellate courts can reverse verdicts only on the grounds that the law was applied wrongly.

    9:16 There aren't plea bargains, but there are what are called Goodyear directions, where the defendant can ask (without the jury finding out, and without prejudice to their defence) during the trial what sentence they would get if they changed their plea to guilty there and then, the judge gives a rough sentence, and then has to (approximately) stick to that if D does then plead guilty.
    10:57 Jurors aren't under oath in the same way as witnesses, but do have to take one of various pledges to assess the case diligently, fairly, honestly, etc.

      It is worth mentioning though that recently goodyear directions have faced a lot of scruitny in the Court of Appeal. Plus due to how we sentence here it is fairly easy for most offences to just work out what the maximun semtence is likely to be.
